RESOLUTION NO. 114
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TIBURON AUTHORIZING JOINDER IN LITIGATION
WHEREAS, the General Insurance Company of America issued its sub-
division bond No. 473919 as surety for the faithful performance and
completion of improvements for that certain subdivision known as
Francisco Vista, naming as beneficiary the County of Marin; and
WHEREAS, said bond was issued and given pursuant to an agreement
dated September 25, 1962, between F4ancisco Vista, Inc., the princi-
pal under said bond, and the County of Marin; and
WHEREAS, said principal has not complied with the provisions of
said agreement and has not faithfully performed the terms of the said
agreement; and
WHEREAS, after demand, said surety has failed to fulfill its
obligations under said bond; and
WHEREAS, the said subdivision is located within the city limits
of the City of Tiburon;
NOW, THEREFORE, BE IT RESOLVED:
That the City Attorney is hereby authorized to jo~n the City
of Tiburon as a co-plaintiff with the County of Marin ~n such action
or actions at law that the County of Marin shall file to enforce the
provisions of the said subdivision surety bond.
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Tiburon held on 27 June 1966 , 1966, by the follow-
ing vote:
