r~SOLUTION NO. 132
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON WITH-
DRM~ING ALL PORTIONS OF THE TIBURON LIGHTING DISTRICT WITHIN
THE CITY OF TIBURON FROM SAID DISTRICT
WHEREAS the Tiburon Lighting District, formed under provisions of
the Highway Lighting District Act contained in the Streets and Highways Code
of the State of California, consists almost entirely but not exclusively of
land within the City of Tiburon;
AND WHEREAS Section 19290 of said Streets and Highways Code provides
that any territory within a city may be withdrawn from a Highway Lighting District
by resolution of the City Council;
AND ~vHEREAS on 26 September 1966 the City Council did adopt a Minute
Order intended to accomplish the withdrawal of territories within said city
from said district;
llliJD WHEREAS it was subsequently determined that the intent of the
Council required the adoption of a resolution in order to comply with the terms
and conditions of Section 19290 of the Streets and Highways Code of the State
of California;
NOW, THEREFORE, BE IT r~SOLVED:
THAT the territories of the Tiburon Lighting District lying within
the boundaries of the City of Tiburon, more properly described on Exhibits A
and B attached hereto and made a part. hereof, ought to be and are hereby with-
drawn from the Tiburon Lighting District;
THAT the City Clerk shall file a certified copy of this resolution
with the State Board of Equalization, Board of Supervisors of the County of
Marin and the Assessor of the County of Marin;
THAT, in further compliance with the provisions of Section 19290 of
the Streets and Highways Code, the Treasurer of the County of Marin be asked
to deliver to the Treasurer of the City of Tiburon all unencumbered funds,
including all taxes levied and collected by the District in any year in which
taxes are levied and collected by the District after the date of withdrawal on
property withdrawn from the District in proportion to the assessed value of
the real property of the territory hereby withdrawn and the portion remaining;

THAT the Board of Supervisors of the County of Marin be asked to
instruct the proper official of said County to deliver to the City of Tiburon
an. inventory of any and all property belonging to said District, if any,
together with a statement of the value of said property.

City of Tiburon held on
