.A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
DECLARING THE FILLED DPJ~INAGE DITCH OVER I3l.l.CKIE' S

~nmT~AS, pursuant to the prov1s1ons of Ordinance No. 59 of the
City of Tiburon, notice was duly given pursuant to the provisions of
Section 3 of said ordinance to the property owners of that certain real
property in the area commonly known as Blacki~'s Pasture, assessors
parcels 55-071-01 and 16, to shm~ cause why the filled drainage channel
over said property should not be condemned as n public nuisance and
said nuisance be abated by cleanin0 the channel, and why the cost of
such abatement should not be assessed on the property, such cost to
constitute a lien thereon:

1967.~nd continued to October 23, 1967;
AND rnmT~LS, the matter duly came on for hearin~ this date before
the City Council and the City Council heard and considered all objections
and protest to the proposed abatement of said public nuisancE;
AliD WHEREAS, there were no objections and no protests to the proposed
abatement of said public nuisance;
NOH THEREFOP~ BE IT P.ESOLVED:
The City Council of the City of Tiburon does hereby declare the filled
draina~e channel over assessors parcel 55-071-01 and 16, owned by Thomas Connell
et al and Anthony L. Connell in the area commonly known as B1ackie's pasture,
to be a public nuisance and hereby orders the city manager of the City of
Tiburon to take all necessary steps to immediately abate said public nuisance
following expiration of the period all~ed by law unless waived.
