RESOLUTION RESCINDING RESOLUTION NO. 196 OF THE CITY COUNCIL
OF THE CITY OF TIBURON AND AUTHORIZING EXECUTION OF AGREEMENT
BE'l'WEEN mE CITY OF TIBURON AND THE COUNTY OF ~RIN IN CON-
NECTION WITH THE HANDLING OF BOND COLLECTIONS, EL ~IUNERO
ASSESSMENT DISmICT NO. 1967-1, CITY OF TIBURON, MARIN COUNTY,
CALIFORNIA.
WHEREAS, on February 26, 1968, the City Council of the City of Tiburon,
Marin County, California, authorized the execution of an agreement with the
County of Marin in connection with the handling of bond collections in El Marinero
Assessment District No. 1967-1, City of Tiburon, Mirin County, California; and
WHEREAS, subsequent thereto, the County of Marin declined to execute
said Agreement, and after study requested that the bond service charge set
forth therein be increased fram $20.00 per bond to $30.00 per bond; and
WHEREAS, there are ample funds in the proceedings for said assessment
district to cover such increased costs;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Tiburon, Mirin County, California, as follows:
L 'D1at Resolution No. 196, adopted by the City Council of the
City of Tiburon on the 26th day of February, 1968, be and it is hereby rescinded;
2. that the Mayor of the City of Tiburon is hereby authorized to
sign and the City Clerk is hereby authorized to attest that certain Agreement
attached hereto between the City of Tiburon and the County of Mlrin.
I HEREBY CERTIFY that the foregoing resolution was duly and regularly
adopted by the City Council of the City of Tiburon, Marin County, California,
at a regular meeting thereof, held on the 12th day of August, 1968, by the
following vote, to wit:

THIS AGREE}'lENT, made and entered into this 12th day of
August
,1968, hy and bet\<;een the COUNTY OF HARIN, a political
subdivision of the State of California, hereinafter referred to as
"County," and the CITY OF TIB,URON, a municipal corpora tion of the
'State of California, located ,dthin the County of ~{arin, hercin-
after referred to as "City,"
lV, I T N E S S E T It :

WHEREAS, City has heretofore established a bond service
charge in the amount of $30.00 for each special assessment bond
issued, pursuant to the Imprqvement Act of 1911; and
l~IEREAS, City desires that County, by and through its Tax
Collector-Treasurer, perform, on behalf of City, required services
in connection with the collection and payment of said improvement
bonds;
NOW, THEREFORE, THE PARTIES HERETO DO HEREBY AGREE AS FOLLOlI/S:
1. County hereby agr~es to perform the fqllowing" services
for and on behatf of City in connection with its improvement bonds
issued pursuant to the_Improveme~t Act of 1911,

(a) Collections of all assessments;
(b) Payment of all bonds and coupons;
(c) All adQinistrative and clerical services required
in connection with the foregoing.
2. For and in consideration of the services to be performed
by County, City hereby agrees to pay to the County the SUR of $30.00
for each bond serviced by County.
3. City further agrees to appoint the Tax Collector-
Treasurer of the County of ~larin to the position of Deputy Treasurer
of the City of Tihuron, and in connection therewith, City will provide,
without cost to the County, any additional surety bonds whicll may be

4. This agreement shall apply to all special assessment
proceedings, the resolution of intention for which hG,ls been
adopted prior to "the date of this agreement.
s. This agreement may be amended at any time upon the mutual
consent of the parties hereto.
6. "This agreement shall remain in effect for a peri04 of
one year from the date he~eof and shall be deemed to be renewed from
year-to-year thereafter, .~nless within 30 days prior to the termina-
tion of any term hereof, either of the parties give 3D-days' written
notice to the other of its intention to terminate this agreement.
IN WITNESS WHEREOF, the parties hereto have authorized
their duly autho!ized representatives to execute the within instru-
ment, the day and year in this agreement first above written.
