A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
DECLARING THE FILLED DRAINAGE DITCH OVER BLACKIE'S
PASTURE A PUBLIC NUISANCE.
WHEREAS, pursuant to the provisions of the !hnicipal Code of the
City of Tiburon, notice was duly given pursuant to the provisions of section 24-3
of said !hnicipal Code to the property owners of that certain real property in
the area commonly known as Blackie's Easture, Assesspr's Elrcels 55-071-01 and
16, to show cause why the filled drainage channel over said property should not
be condemned as a public nuisance and said nuisance be abated by cleaning the
channel, and why the cost of such abatement should not be assessed on the pro-
perty, such cost to constitute a lien thereon:
AND WHEREAS, the matter was duly set for hearing on September 23, 1968;
AND WHEREAS, the matter duly ~e on for hearing this date before the
City Council and the Council Council heard and considered all objections and
protests to the proposed abatement of said public nuisance;
AND WHEREAS, there were no objections and no protests to the proposed
abatement of said public nuisance;
NOW, 'lHEREFORE, BE IT RESOLVED:
The City Council of the City of Tiburon does hereby declare the, filled
drainage channel over Assessor's Earcels 55-071-01 and 16, owned by Thomas Connell
et a1 and Gerald Connell in the area commonly known as B1ackie' s Basture, to be a
public nuisance and hereby orders the City Mlnager of the City of Tiburon to take
all necessary steps to immediately abate said public nuisance following expira-
tion of the period allowed by law unless waived.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of Tiburon held on
November 13.
1968, by the following vote:
