RESOLUTION NO. 1114
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN
OF TIBURON APPROVING THE PELLEGRINELLI PRECISE
PLAN
WHEREAS, the Planning Commission and Town Council have
received and considered a Precise Plan submitted by Marino
Pellegrinelli to subdivide a 10 acre parcel into five lots and
an open space area; and
WHEREAS, the Town Council has approved a Master Plan by
Ordinance No. 222 N.S.; and
WHEREAS, the Planning Commission has reviewed the Precise
Plan drawings for the project and has found the drawings to be
in substantial conformance with the approved Master Plan, subject
to conditions, and had recommended approval to the Town Council; and
WHEREAS, the Town Council has reviewed the Precise Plan
drawings for the project and has found the drawings to be in
substantial conformance with the approved Master Plan and does
hereby approve the Precise Plan for the Pellegrinelli project
subject to the following conditions:
1. The applicant shall comply with all applicable subdivision
regulations.
2. The applicant shall comply with all appropriate mitigation
measures as contained in the Final Environmental Impact Report on
pages 32, 29, 54 and 55, 62, and 79 and 100,..for the pellegrinelli
land division dated September 19, 1979, prepared by Del Davis.
Associates, Inc.
3. All utilities shall be guaranteed by the serving district
or company in writing prior to the recordation of the Final Map.
4. The water supply provided shall meet with the approval of
the Town Engineer and Fire Protection District.
5. The roadway proposed on the property to the intersection
of the driveways to Parcels 2 and 4 may remain private. Applicant
shall offer an easement 10 feet in width following the roadway
alignment from Paradise Drive to the open space parcel.
6. All utilities serving the development shall be undergrounded.
7. The applicant shall submit all proposed deed and title
restrictions to the Department of Community Development for review
and approval by the Town Attorney prior to the filing of the Final
Map. All ar~as proposed for permanent open space shall be satisfactorily
guaranteed as open space in perpetuity.
8. No structure shall be erected in the development until
same has receive a site plan and architectural approval in compliance
with the appropriate sections of the Tiburon Zoning Ordinance.
9. The applicant shall offer for dedication to the Town of
Tiburon a pedestrian easement in a width approved by the Town but
not to exceed 20 feet in width over the proposed open space as
marked in the site plan by Edward Beattie.
10. The applicant shall offer for dedication to the Town for
trail purposes an easement across the southwest corner of the property
in a width approved by the Town but not to exceed 15 feet in width,
as marked on the site plan by Edward Beattie. Town shall accept
or reject the offer at the time of approval of the Tentative Map.
11. The applicant shall comply with all requiremenmof the
Town Engineer, including the conditions as stated in his letter
of September 3, 1980.
12. The applicant shall comply with all Fire Department
requirements.
13. The applicant shall comply with the provisions of any
Ordinance of the Town requiring contribution to a Tiburon
Boulevard traffic improvement fund.
14. Floor areas of all residential units shall not exceed
the square footage shown on the Precise Plan.
PASSED AND ADOPTED at a regular meeting of the
Town Council of the Town of Tiburon on October 1 , 1980,
by the following vote:
