RESOLUTION NO. 1102
A RESOLUTION OF THE TOWN COUNCIL OF THE
TO~VN OF TIBURON ABATING A NUISANCE
WHEREAS, pursuant to Section 38773 of the Government
Code of the State of California, the Town of Tiburon did adopt
Ordinance No. 192 N.S. to provide for the summary abatement of
any nuisance and establishing procedures therefore; and
WHEREAS, it is believed that a certain nuisance, a
privately owned residential structure located on certain property
located at 1810 Vistazo West Street, being in a state of
disrepair; and
WHEREAS, an inspection has been made of the subject
property and upon the findings of said inspection, the Town Council
of the Town of Tiburon ordered the owners thereof to show cause,
if any, why the aforementioned hazardous structure should not
be declared a public nuisance and directed that a copy of said
order be posted upon the subject property; and
WHEREAS, the owners of the above described property
have on this date, June 25, 1980, entered an appeal and do
protest to the abatement of subject nuisance by the Town of
Tiburon; and
WHEREAS the Town of Tiburon does find that the abatement
of this hazardous structure is necessary to the public health,
safety and welfare.
NOW, THEREFORE, BE IT RESOLVED, that the Town Council
of the Town of Tiburon, in the interest of public health, safety
and welfare, does hereby overrule any and all protests and
objections to the abatement of the hazardous residential structure
located upon certain property located at 1810 Vistazo West Street
and directs and authorizes the Town Manager and Town Attorney
to abate said nusiance including legal action necessary, provided
however, that such action shall not be undertaken if applicant
complies with the following:
a. Obtain building permits to make improvements
described in the letter from Kenneth Frost,
dated August 14, 1980, within thirty (30) days
hereof.
b. The repairs required by Mr. Frost to make the
building safe and habitable are completed within
sixty (60) days after the issuance of the building
permit to the satisfaction of the Town Engineer.
PASSED AND ADOPTED at a regular meeting of the Town
Council of the Town of Tiburon, held on August 20 , 1980,
by the following vote:
