HomeMy WebLinkAboutTC Res 1980-07-16 RESOLUTION NO. 1101 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON APPROVING THE PRECISE PLAN FOR THE DEVELOPMENT OF 3 ACRES OFF ROLLING HILLS ROAD (SPRING LANE) ASSESSOR'S PARCEL NO. 58-111-19 WHEREAS, William Kuhns has submitted a Precise Plan for the development of 3 acres of land off Rolling Hills/Spring Lane in the Town of Tiburon; and WHEREAS, the combined Master and Precise Plan is more particularly described and is herein defined as follows: A. Map entitled, 3 Unit Subdivision, Spring Lane, Tiburon, for Mr. William Kuhns, by Kurtzman and Kodama, dated 2-27-80. B. Geological Reconnaissance Report, Harding-Lawson Associates, Job No. 9717,002.01 dated June 8, 1979. WHEREAS, the Planning Commission has reviewed the environmental impact of the project, has reviewed the geological reconnaissance and has found that the project wi 11 not have a sign i fi cant effect on the envi ronment and has recommended a Negative Declaration of Environmental Impact; and WHEREAS, the Planning Commission (Commission) has held duly noticed Public Hearings for the purpose of reviewing the application and receiving comments and recommendations from the public and has recommended approval of the Master Plan and Precise Plan; and WHEREAS, the Town Council (Council) has reviewed the environmental impact of the project, has reviewed the geological reconnaissance and finds that the development will not have a significant impact on the environment and adopts a Negative Declaration of Environmental Impact; and WHEREAS, the Council has held a duly noticed Public Hearing for the purpose of reviewing the Precise Plan and recommendations of the Commission and to receive comments and recommendations from the public; and WHEREAS, the Council finds that the requirements of subsection 1 through 5 of Section 10.4 of the Tiburon Zoning Ordinance have been satisfied; and WHEREAS, the Council finds that the Precise Plan as amended and conditioned herein conforms to the Town1s General Plan as well as other applicable regulations; and WHEREAS, the Council has adopted Ordinance No. 226 N.S. approving the Master Plan; NOW, THEREFORE. BE IT ORDAINED by the Town Council of the Town of Tiburon as follows: The Precise Plan for a 3 unit subdivision is hereby approved upon the following terms and conditions: 1) A Tentative and Final Subdivision Map shall be submitted in accordance with the requirements of the Town Engineer. 2) All conditions and requirements of the soils report prepared by Harding-Lawson Associates. dated June 8. 1979 shall be fulfilled. 3) Each dwelling within the proposed development shall be subject to site plan and architectural approval in accordance with Section 11 of the Zoning Ordinance. 4) The applicant shall comply with all conditions and requirements of the Tiburon Fire District. 5) The applicant offer for dedication in perpetuity to the Town of Tiburon the area identified as "Open Space 25,140 sq. ft." on the Master and Preci se Pl an . 6) The applicant shall comply with all conditions and requirements of the Town Engineer. -2- 7) All utilities serving the development shall be underground. 8) ~" ~t~\~t~es shall be guaranteed by the serving district or company in writing prior to the recordation of the final Map. 9) The Tentative Subdivision Map shall be reviewed and approved by the Planning Commission. 10) The maximum square footage shall not exceed 3,600 sq. ft. per each unit of gross floor area including the garage. 11) Stabilization of the proposed dedicated open space shall be done in a manner acceptable to the Town Engineer, prior to recordation of the Final Map. 12) Cut and fill areas shall be landscaped as soon as work is completed. 13) The applicant shall submit Conditions, Covenants and Restrictions or a maintenance agreement to the Department of Community Development for review and approval by the Town Attorney. The C.C. & R. 's or maintenance agreement should clearly state the responsibility for maintenance of the roadways between the property owners and should guarantee the maintenance of the roadway in perpetuity.
