A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
ADOPTING THE COUNTY OF MARIN AND MA.RIN OPERATIONAL AREA
EMERGENCY PIAN AS THE SINGLE, COUNTY WIDE, COMPOSITE WAR
OR PEACETIME EMERGENCY PIAN
WHEREAS: Article 9 of the California Emergency Services Act designates
each county area as an "Operational Area" and authorizes the local formation of an
emergency organization representative of the local political subdivision therein; and
WHEREAS: the County of Marin is authorized a County Emergency Services
Organization and a Marin Operational Area which provides for use of personnel and
resources of the county and cities during an emergency; and
WHEREAS: the County of Marin and the incorporated cities within said
county have entered into the California Mutual Aid Agreement which requires the devel-
opment of county wide and local mutual aid plans to become operative in time of a Local
Emergency, State of Emergency and/or a State of War Emergency; and
WHEREAS: the State of California has organized the State into Mutual Aid
Regions for the more effective application, administration and coordination of mutual
aid and other emergency-related activities in the event of a State of Emergency or
State of War Emergency; and
WHEREAS: the Mutual Aid Region will recognize the County of Marin as an
Operational Area to expedite and coordinate emergency operations during a State of
Emergency or State of War Emergency; and
WHEREAS: the County of Marin, hereinafter referred to as the County, and
the incorporated cities within the County signatory hereto, hereinafter referred to as
the City or Cities as required by the context, are desirous of establishing a unified
emergency services organization hereby recognized as the County of Marin and Marin
Operational Area Emergency Services Organization, for the purpose of preparing mutual
plans for the preservation and safety of life and property and making provisions for
the execution of those plans in the event of a State of War Emergency, State of Emer-
gency, or Local Emergency as defined in the california Emergency Act of 1970, and as
augmented by the County of Marin and Marin Operational Area Emergency Plan, the pro-
visions of which include mutual assistance in the event of a national disaster; and
WHEREAS: because disasters know no political boundaries, and because a
unified organization provides a basis for conducting County wide programs designed to
provide the highest level of readiness possible for all the citizens of this County,
and their governments in the event of a war-caused disaster or a significant natural
disas ter; and
WHEREAS: the governing bodies of the Cities and the County have concern
for, and recognize their respective responsibilities toward the direction of emergency
9perations in their respective political jurisdictions, and also recognize the need of
a Coordinator for the unified organization who can provide the Directors of Emergency
Services of each political jurisdiction with a central point for coordination and
control of mutual aid and the use of county wide emergency services and resources; and
WHEREAS: the County of Marin and the incorporated cities therein do
hereby agree that the emergency organizations of the County and the Cities may be
coordinated by the Marin Operational Area Coordinator for that period during which
a Local Emergency, State of Emergency, or a State of War Emergency exists; they, in
consideration of the mutual covenants herein contained, do mutually resolve as follows:
A. The County will perform the following services:
1. Advise and assist each City in the preparation and development of an
emergency plan for that city.
2. Develop and maintain on a current basis the County of Marin and Marin
Operational Area Emergency Services Plan which shall provide for the
needs of the Cities and of the unincorporated areas of the County and
which, in addition, will take into account and be coordinated with the
needs of the Cities in the event of a major natural disaster.

3. Advise and assist the Cities with the training of public em-
ployees through the city's emergency organization.
4. Provide an operational area emergency services program as
contemplated by the emergency plan, which will include but
not be limited to the following:
a) Direction and Control, including Emergency Intelligence
and Public Information;
b) Counnunications and Warning;
c) Health and Medical, including radiological safety and
Coroner services;
d) Law Enforcement and Traffic Control;
e) Fire and Rescue;
f) Engineering (Construction and Housing);
g) Shelter and Welfare;
h) Utilities;
i) Manpower;
j) Supply and Procurement;
k) Industrial Production;
1) Economic Stabilization;
m) Petroleum; and
n) Transportation.
5. Develop and keep current with the cooperation of the Cities, on
a county wide basis, an annual inventory of all the equipment and
supplies available in the County for use in event of an emergency
involving activation of the Operational Area Organization, as out-
lined in 7 and 8, below;
6. Provide technical assistance in obtaining any Federal or State
funds which may become available to the Cities for emergency ser-
vices purposes;
7. In the event of a disaster confined to one city, the County will
offer assistance within the limits of its emergency services
organization and will coordinate assistance furnished by other
cities in accordance with the California Master Mutual Aid Agree-
ment, and this agreement;
8. In the event of a disaster within the County affecting an area
greater than anyone city, the County shall offer assistance to
the extent of its emergency services organization's resources and
shall direct and coordinate assistance furnished by other cities.
B. The City of Tiburon shall:
1. By being signatories hereto, and pursuant to the passing of the
ordinance establishing their respective emergency organizations
as required by the California Emergency Services Act of 1970,
become members of the County of Marin and Marin Operational Area
Emergency Services Organization.
2. Become parties to such mutual aid agreements as shall be deemed
necessary by the County of Marin and Marin Operational Area Emer-
gency Disaster Council established hereby, and to be comprised of

the fo 11 owing :
a) The Area Coordinator - Chairman;
b) One representative from each City's Emergency Services Organi-
zation's Disaster Council;
c) One representative from the unincorporated areas of the County,
to be appointed by the County Board of Supervisors;
d) One representative from the County of Marin Emergency Services
Organization Disaster Council, to be appointed by the Board of
Supervisors.
3. Accept primary responsibility for the development within that
city of an emergency plan for its own jurisdiction which shall
be acceptable to and approved by the State of California Office
of Emergency Services and/or the State Emergency Services
Council, when submitted to those agencies as annexes integral
to the County of Mlrin and Marin Opera tional Area Emergency Plan.
4. Delegate to the Chairman of the County Board of Supervisors,
who by mutual agreement of both parties is designated hereby and
recognized as the County of Marin and Marin Operational Area Co-
ordinator, whatever authority it is lawful for the Cities to
delegate when such delegation shall be deemed necessary by the
Coordinator. This delegation of authority shall be restricted
to whatever expenditure of City funds and use of City personnel,
equipment, and supplies are made available by the Cities for
emergency purposes during a Local Emergency, State of Emergency,
or State of War Emergency condition as contemplated by the State
of california Emergency Services Act of 1970.
c. In consideration of these mutual promises, it is hereby mutually agreed:
1. That the County will pay the cost of establishing and maintaining
the County of Marin and Mlrin Operational Area Office of Emergency
Services staffed by at least one full-time County employee whose
title will be Coordinator of Emergency Services, and clerical
support.
2. The Coordinator of Emergency Services when appointed pursuant to
this authority is hereby empowered to coordinate the efforts of
the parties to this agreement for the accomplishment of its pur-
poses.
3. The County, and all Cities signatory hereto hereby adopt the County
of Marin and Marin Operational Area Emergency Plan as the single,
county wide, composite war or peacetime emergency plan, to be in
effect in emergencies other than war, where the emergencies require
Operational Area coordinationo
D. This resolution shall become effective as to each jurisdiction on the
date the governing bodies of each jurisdiction authorize the execution
of this document.
E. This agreement may be terminated as to any of the parties by written
notice given by such party to all the other parties at least twenty
days prior to the commencement of the fiscal year in which it is to
take effect. For this purpose the fiscal year is defined as July 1st
of a calendar year through June 30th of the succeeding calendar year.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of Tiburon held on the 12th day of Auqust 1974, by the following vote:
