HomeMy WebLinkAboutTC Res 1974-05-24 RESOLUTION NO. 633 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON AMENDING RESOLUTION NO. 619, WHICH RESOLUTION ACCEPTED THE FINAL SUBDIVISION MAP OF THE HILARITA PROJECT WHEREAS, Resolution No. 619, adopted April 22, 1974, approved the final subdivision map of the Hilarita project; and WHEREAS, the subdivider has requested amendments to said resolution; and WHEREAS, the City Council finds that the amendments provided for herein are in the public interest; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tiburon does hereby amend the provisions and conditions contained in said Resolution No. 619, to read as follows: 1. The subdivider shall enter into and execute a subdivision improvement agreement and such bonds as may be required by the City Engineer. 2. Prior to recordation of the final map, an agreement in the form attached hereto as Exhibit nAn shall be entered into between the City and the owner of the Project. 3. Prior to recordation of the final subdivision map, there shall be delivered to the City an offer made by the Marin County Housing Authority to sell Parcel C to the City of Tiburon for the sum of $36,000.00; said offer shall provide that it may be accepted by the City at any time within eighteen (18) months from its delivery to the City, and shall provide for three extensions of time for acceptance of ninety (90) days each, and shall be in a form acceptable to the City Attorney. 4. The subdivider shall be responsible for paying up to 50% of the costs of the construction of a left turn lane into the Project. 5. Prior to occupancy of the Project, the drainage fees shall be paid pursuant to Ordinance No. 109 N.S., the amount thereof to be determined by the City Engineer. 6. No occupancy permit shall be issued until the following work has been completed to the satisfaction of the City Engineer: slide repaired, erosion control work completed, internal street, including paths, completed, and the left turn lane constructed. 7. Occupancy shall not be permitted of more than ninety-five per cent (95%) of the buildings in the Project until such time as all structures have been removed from Parcel C, and all occupants of the buildings located in Parcel C have been removed or relocated.
