RESOLUTION No. 619
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
ACCEPTING FINAL SUBDIVISION MAP OF THE HILARITA PROJECT
WHEREAS, the final subdivision map for the Hilarita Project has been
filed for approval; and
WHEREAS, said map is consistent with the City's General Plan; and
WHEREAS, an Environmental Impact Report has been completed in compliance
with the CEQA and the State guidelines and the City Council has reviewed and
considered the information contained therein; and
WHEREAS, the Planning Commission has recommended to the City Council that
said map be approved;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tiburon
does hereby find that the final subdivision map for the Hilarita Project is con-
sistent with the City's General Plan, and does hereby approve said map.
BE IT FURTHER RESOLVED that the City hereby accepts the following offers
of dedication:
1. The roadway designated Parcel D.
2. Parcel B.
3. Access easement on Upper Hilarita Drive.
BE IT FURTHER RESOLVED that the said map is approved subject however,
to the following provisions and conditions:
1. The subdivider shall enter into and execute a subdivision improvement
agreement and such bonds as may be required by the City Engineer.

2. Prior to recordation of the final map, an agreement in the form attached
hereto as Exhibit "A" shall be entered into between the City and the owner of the
project.
3. Prior to recordation of the final subdivision map, there shall be delivered
to the City an offer made by the Marin County Housing Authority to sell Parcel C to
the City of Tiburon for the sum of $36,000; said offer shall provide that it may be
accepted by the City at any time within six (6) months from its delivery to the City,
and shall be in a form acceptable to the City Attorney.
4. The subdivider shall be responsible for paying up to 50% of the costs
of the construction of a left turn lane into the project.
5. Prior to recordation of the final map, the drainage fees shall be paid
pursuant to Ordinance No. 109 N.S., the amount thereof to be determined by the
City Engineer.
6. No occupancy permit shall be issued until the following work has been
completed to the satisfaction of the City Engineer; slide repaired, erosion control
work completed, internal street, including paths, completed, and the left turn lane
constructed.
The Mayor is authorized to execute the subdivision improvement agreement
on behalf of the City.

Tiburon held on April 22, 1974, by the following vote:
