RESOLUTION NO. 609
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
APPROVING THE TENTATIVE MAP OF THE HILARITA PROJECT
WHEREAS, the Tiburon Ecumenical Association, having an
option to purchase property 0wned by the Marin County Housing
Authority, has applied for approval of a Tentative Subdivision
Map of the Hilarita Project; and
WHEREAS, review has been made with reference to an
Environmental Impact Report; and
WHEREAS, the Planning Commission has recommended to the
City Council that the Map be approved; and
WHEREAS, the City Council finds that the Tentative Sub-
division Map is consistent with the City's General Plan;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Tiburon does hereby approve the Tentative Subdivi-
sion Map for the Hilarita Project, consisting of two (2) sheets
as prepared by Frost & Meglio, dated February 4, 1974, and six
(6) sheets as prepared by Kaplan and McLaughlin, Architects &
Planners, dated March 23, 1973, and subject to the following con-
ditions:
1. All improvements are subject to final design
and approval.
2. Streets and drainage facilities are to remain in pri-
vate ownership, except that the fir.st seventy-two (72) feet of
the street shown on the Map east of Tiburon Boulevard is to be
offered for dedication to the City as a public street.
3. No vehicular left turns shall be allowed from Tiburon
Boulevard into the property Jr from the property into Tiburon
Boulevard until such time as a left turn storage lane is con-
structed on Tiburon Boulevard; said left turn storage lane must
be constructed prior to occupancy, with the developer to pay up to
fifty per cent of the costs of construction.
4. Prior to recordation of the Final Subdivision Map, the
drainage fee shall be paid.
5. Parcel "B", as required to be shown on the Map pur-
suant to Condition No. 7, an~ an easement for public access to
Parcel "B", shall be offered for dedication to the City for
park and recreation purposes.
6. Landscaping Drawings L3 and L4, Underground Utilities
Plan, Sheet C-ll and Building Elevations, Sheets C-8, C-9 and
C-lO, all dated March 23, 1973, shall be considered as part of
the Tentative Subdivision Map.
7. A new parcel line shall be shown on the Tentative Map
dividing Parcel "B" into new Parcels "B" and "C", containing

2.75 and 2.0 acres, respectively; all structures are to be
removed from Parcel "C" prior to occupancy of any portion of
the property.
8. Prior to filing the Final subdivision Map, there shall
be delivered to the City an offer made by the Marin County Hous-
ing Authority to sell Parcel "C" to the City of Tiburon for the
sum of $36,000; said offer shall provide that it may be accepted
by the City at any time within six (6) months from its delivery
to the City, and shall be in a form acceptable to the City
Attorney.
9. Prior to recording the Final Subdivision Map, the
developer shall submit such documents to the City Attorney which
will provide, to the City Attorney's satisfaction, that the
City is the primary beneficiary in all agreements between the
developer and its limited dividend or other partners, and that
the property shall be used solely for moderate and low income
housing for a period of at least twenty (20) years.
10. The developer shall assure that two of the eight
members of the project's tenant selection committee shall be
selected by the Tiburon City Council from among the residents of
the City of Tiburon.
11. The City Engineer shall be responsible for the
supervision of all mitigating measures referred to in the
Environmental Impact Report that had been prepared for the
project.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tiburon held on March 11, 1974, by the
following vote:
