HomeMy WebLinkAboutTC Res 768 ~ RESOLUTION NO. 768 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON APPROVING THE PRECISE PLAN AND TENTATIVE MAP FOR THE CAHN/LEWIS DEVELOPMENT. WHEREAS: the Precise Plan and Tentative Map of Cahn/Lewis development has been submitted to the Planning Commission and found in compliance with the approved Master Plan and Text for the Cahn/Lewis development dated July 28, 1975, and WHEREAS: the City Council has held a~public hearing on the Precise Plan and Text and Tentative Map':ap.d considered all argUments both for and against said plan arid map, and WHEREAS: the Precise Plan and text and Tentative Map as Exhibit A, dated October 5, 1975 have been conditionally recommended for approval by the Planning Commission, and WHEREAS: said maps meet the requirements of Section 10-4 G 2 and 27 of the Tiburon Zoning Ordinance and Chapter 14 of the Tiburon Municipal Code. NOW, THEREFORE BE IT RESOLVED: that the Tentative Map and Precise development Plan for the Cahn/Lewis development prepared by Berline Associates dated September 19, 1975 consisting of 8 pages, as revised by composite attached hereto as Exhibit A, and water use and reclamation report, prepared by Gonzales/Oberkamper, dated July 1, 1975 consisting of 15 pages, and soils mechanic report prepared by Cooper Clark dated September 2, 1975 are approved by the City Council of the City of Tiburon subject to the following conditions: 1. That the Precise Plan shall be subject to all conditions of the City of Tiburon's Zoning Ordinance, prior to the City Council approval of the Final Map. 2. That all subdivision improvements shall be subject to the approval of the Board of Design Review. 3. That all conditions specified on Sheet liT" of the Precise Plan shall constitute conditions of approval of the Precise Plan and Tentative Map. 4. That In-lieu park and recreation fees of $4,737.70 shall be paid to the City of Tiburon in accordance with the applicable ordinance and prior to recordation of the Final Map. These funds are to be spent in conformance with Section 14-50 of the code and Chapter IV, Article III of the Subdivision Map Act. 5. That parcels A, B, and C consisting of 16+ acres of Open Space Preserve excluding waste:~ater reclamation facilities and easements shall be dedicated to the City of Tiburon prior to recordation of the final subdivision map in a form suit- able to the City Attorney. The Precise location and extent of the waste water reclamation facilities and easements shall be subject to the approval of the City Engineer. 6. That prior to the recordation of the Final Map the applicant shall submit to the Department of Community Development a copy of the deed and title restrict- ions for approval by the City Attorney. 7. That the drainage system shall be installed as shown on sheet 7 of Exhibit A dated September 19, 1975 as set forth and before described in Ordinance 161 N.S., Section 2 D. 8. Prior to approval of the final subdivision map, applicant shall submit evidence satisfactory to the City that all utilities serving the entire develop- ment are available. -1-
