RESOLUTION NO. 734
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
DECLARING A PUBLIC NUISANCE AND ORDERING ITS ABATEMENT
WHEREAS: pursuant to Section 38773 of the Government Code
of the State of California, the City of Tiburon did adopt Ordinance
No. 59 to provide for the summary abatement of any nuisance and es-
tablishing procedures therefore, and
WHEREAS: it has been found that an unlawful dwelling unit
exists upon certain property located at 1820 Centro West Street des-
cribed as a lot 6,1 and portion of lot 60, Lyfords HYgeia, Map # 3,
(AP59-061-34) and
WHEREAS: the aforementioned unlawful dwelling unit is detri-
mental to the public health, safety and welfare of the citizens of
Tiburon, in that the use does not conform to the restrictions placed
on similar property in the same vicinity and zone, and further, the
increased density creates congestion and adds to the discomforts of
the neighboring properties, and
WHEREAS: the owners of the subject property have not evi-
denced any inclination to conform to the requirements of the Zoning
Ordinance of the City of Tiburon,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Tiburon finds and does declare that the unlawful dwelling unit
on that certain property located at 1820 Centro West St. described as
a portion of lot 60 and lot 61, Lyfords Hygeia, Map No. 3 (AP59-061-34)
is a public nuisance, and does order that the City Attorney proceed
to abate the subject nuisance by the removal of the basement apartments
as provided by law, and further,
THAT the City Council of the City of Tiburon does order that
the costs of the abatement will be assessed upon the described property
and shall constitute a lien upon such property until paid.
PASSED AND ADOPTED AT a regular meeting of the City Council of
the City of Tiburon held on
June 23rd
, 1975, by the following vote:
