HomeMy WebLinkAboutTC Res 1975-06-24 (3) RESOllJTION' m. 733 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON APPROVING AMENDMENT TO PD PRECISE PLAN FOR PROPERTY LOCATED AT 7-11 MAIN STREET WHEREAS, a Master Plan for property located at 7-11 Main Street, was approved by Ordinance No. 120 adopted April 23, 1973; and WHEREAS, a precise plan for said property was approved by Resolution No. 530 adopted on April 23, 1973; and WHEREAS, the owner of said property has submitted for appro- val an amendment to said precise plan; and WHEREAS, the Planning Commission has approved the proposed amendment to said precise plan subject to certain conditions: NOW, THEREFORE, it is hereby resolved: 1. The amended precise plan consisting of 2 sheets of draw- ings by Mario Gaidano, architect, dated May 6, 1975, is hereby approved subject to the following conditions: A. Final construction drawings shall be approved by the Board of Design Review. In reviewing said plans, the board shall consider, among other items, the materials used, colors and tex- tures of exterior surfaces, appearance of the roof and roof equipment, lighting and pedestrian promenades, walkways and decks. B. The premises shall be used for the following purposes only: fish sales, bar and restaurant. Preparation of food for immediate consumption adiacent to the premises shall not be permitted. C. Seating capacity for the premises shall not exceed 219. D. Valet parking shall be permitted only upon issuance of a use permit. E. Provision shall be made, by dedication or other method satisfactory to the city Council, for a permanent pedestrian Draft date: 6/24/75 1. promenade and walkway. Said walkway shall connect to the present ferry landing. F. Docking of boats on the property shall be permitted only upon issuance of a use permit. G. Entertainment and live music shall be permitted only upon issuance of a use permit. H. The owner shall provide and at all times maintain public liability insurance in amounts satisfactory to the City Manager. The City shall be named as an additional insured and provisions shall be made that said policy shall not be cancelled without prior notification to City. I. Parking shall be provided for 68 automobiles. Covenants applicable to said parking spaces and the other parking spaces which the owner is required to provide pursuant to the "SUMMARY OF ZELINSKY PARKING REQUIREMENTS AND AVAILABLE SPACES" attached hereto executed in accordance with Section 13(b) of the Zoning Ordinance shall be delivered to the City for proper recordation. Said covenants shall be in a form satisfactory to the City Attorney. No building permits shall be issued until conditions A, E, H and I have been complied with.
