RESOLUTION NO. 728
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
DEClARING A PUBLIC NUISANCE AND ORDERING ITS ABATEMENT
WHEREAS: pursuant to Section 38773 of the Government Code of the State
of California, the City of Tiburon did adopt Ordinance No. 59 to provide for
the summary abatement of any nuisance and establishing procedures therefore, and
WHEREAS: it has been found that an unlawful dwelling unit exists
certain property located at 110 Solano Street described as lot lc Sec. 6
Lyfor-d's Hygeia, Map #3 being A.P. 59-143-35, and
WHEREAS: the owners of the subject property have not evidenced any
inclination to conform to the requirements of the Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Tiburon finds and does declare that the use of the third floor of the garage
building, on that certain property located at 110 Solano Street, described
as lot lc Sec. 6, Lyford's Hygeia map #3 (A.P. 59-143-35), as a dwelling unit,
is an unlawfull dwelling unit contrary to the provisions of the Zoning Ordi-
nance and is a public nuisance, and does order that the City Attorney proceed
to abate the subject nuisance by requiring the removal of the kitchen from
the building and prohibiting its use as a third dwelling unit on the property,
as provided by law, and further
THAT the City Council of the City of Tiburon does order that the costs
of the abatement will be assessed upon the above described property until paid.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of Tiburon held on June 9th , 1975, by the following vote:
