RESOLUTION NO. 703
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TIBURON DECLARING PUBLIC NUISANCE AND ORDERING
ITS ABATEMENT
WHEREAS, pursuant to Section 38773 of the Government Code of
California, the City of Tiburon did adopt Ordinance No. 59 to pro-
vide for the summary abatement of any nuisance and establishing
procedures therefore; and
WHEREAS, it has been found that an abandoned vehicle and mis-
cellaneous clutter including old automobile tires, aluminum cans and
old lumber is in evidence upon certain property located adjacent to
1655 Mar West Street, described as A.P. 59-051-01 and 15; and
WHEREAS, the aforementioned accumulation is detrimental to
the public health, safety and welfare of the citizens of Tiburon; and
WHEREAS, the owners of the subject property have not evidenced
any inclination to clean up the area or conform to minimum standards
on their own initiative:
NOW, THEREFORE, BE IT RESOLVED:
THAT the City Council of the City of Tiburon finds and does
declare that an abandoned vehicle and the accumulation of clutter on
that certain property located adjacent to 1655 Mar West Street, des-
cribed as A.P. 59-051-01 and 15, is a public nuisance, and further;
THAT the City Council of the City of Tiburon does order that
the costs of the abatement will be assessed upon the above described
property and shall constitute a lien upon such property until paid.
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Tiburon held on February 10, 1975, by the following vote:
AYES: COUNCILMEN: Aramburu, Ellman, Littman, Ross, Tayer
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: None
