RESOLUTION NO. 701
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TIBURON REQUESTING THE BOARD OF SUPERVISORS
OF THE COUNTY OF MARIN TO INSTITUTE PROCEEDINGS
FOR THE ESTABLISKMENT OF A COUNTY SERVICE PRESENTLY
BEING PROVIDED BY THE MARIN COUNTY SHERIFF'S OFFICE
IN THE UNINCORPORATED TERRITORY OF THE COUNTY OF
MARIN.
WHEREAS, the Sheriff's Office of the County of Marin provides
police protection services consisting of police patrol and investi-
gative services to the unincorporated territory of the County of
Marin, but does not provide such services on a county-wide basis,
both within and without cities; and
WHEREAS, said services provided by the Sheriff's Office of the
County of Marin constitute "extended police protection" as defined
in the County Service Area Law (Government Code Section 25210.1, et
seq.); and
WHEREAS, said County Service Area Law provides that areas
receiving such extended services should pay therefor and provides
for the levy of taxes within such areas for said purposes:
NOW, THEREFORE BE IT RESOLVED, ORDERED AND DECLARED AS FOLLOWS:
1. The City Council of the City of Tiburon does hereby
request that the Board of Supervisors of the County of Marin insti-
tute proceedings under the County Service Area Law for the estab-
lishment of a County Service Area within the territory more par-
ticularly described as all of the territory within the boundaries
of the County of Marin excluding the territory within the incorpor-
ated cities of Belvedere, Corte Madera, Fairfax, Larkspur, Mill
Valley, Novato, Ross, San Anselmo, San Rafael, SAusa1ito, and Tiburon.
2. That said County Service Area be established for the
purpose of levying taxes in an amount sufficient to pay for extended
police protection now being provided to said territory by the
Sheriff's Office of the County of Marin in the form of police
patrol and investigative services.
3. That the City Clerk be and is hereby directed to cause a
certified copy of this resolution to be filed with the Marin County
Local Agency Formation Commission and that said Commission be and
is hereby requested to institute and conduct necessary proceedings
for the formation of said County Service Area.
PASSED AND ADOPTED at a regular meeting of the City Council
of the City of Tiburon on the 10th day of February , 1975 by
the following vote:
AYES: COUNCILMEN: Aramburu, Ellman, Littman, Ross, Tayer
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: None
