RESOLUTION NO. 3317
A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF TIrnURON AUTHORIZING THE TOWN
ENGINEER TO IMPLEMENT A TRANSmON PLAN TO
INSTALL CURB CUTS SO AS TO RENDER THE TOWN'S
PEDESTRIAN WALKWAYS ACCESSmLE TO PERSONS
WITH DISABILITIES AS REOUIRED BY LAW
WHEREAS, the federal Americans with Disabilities Act requires the Town to make its
existing facilities accessible to persons with disabilities unless to do so would present an undue
financial burden or require a change in the fundamental nature of its programs; and
WHEREAS, the Town owns and maintains pedestrian walkways that are subject to the Act,
consisting primarily of sidewalks; and
WHEREAS, although the Town sidewalks serving the downtown, Town Hall and other
public facilities are fully accessible, Town staff has identified some public sidewalks in residential
areas where curbs may pose a barrier to persons with disabilities. Said sidewalks are identified in the
attached memorandum dated October 28, 1998 from the Superintendent of Public Works; and

WHEREAS, the Council intends to adopt a transition plan to provide for access at all such
sidewalks.
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Tiburon to
adopt the following transition plan to install curb cuts where necessary to remove barriers to access:
In conjunction with the Town's routine street maintenance program, the Town Engineer will select
three to five intersections identified in the attached Memorandum for modification pursuant to the
Americans with Disabilities Act. Intersections shall be selected based on the following criteria:
1. The extent to which the intersection currently contains barriers to persons with disabilities (i.e.,
the difficulty such a person currently encounters in using pedestrian walkways,
2. The amount of use that the intersection's pedestrian walkways are likely to receive from persons
with disabilities.
3. Economy and efficiency, in light of the Town's on-going street maintenance program and long-
term goal of full accessibility.

sections that need to be done, at an estimated cost of$24,500 (median cost),
