On November 7, 2018, the Council held a special meeting as follows: CALL TO ORDER AND ROLL CALL Councilmember Fredericks, Councilmember Thier, Councilmember Weiner, Vice Mayor Kulik, Mayor Fraser CLOSED SESSION CONFERENCE WITH REAL PROPERTY NEGOTIATORS (§ 54956.8) Property: 500 Tiburon Blvd., Tiburon, California; APN's 055-093-06, 07, 08, 09 Agency Negotiators: Greg Chanis, Benjamin Stock Negotiating Parties: Town of Tiburon and Richardson Bay Sanitation District Under Negotiation: Price and terms for possible property acquisition. ADJOURNMENT - to regular meeting REGULAR MEETING - 7:30 P.M. Mayor Fraser called the regular meeting of the Tiburon Town Council to order at 7:35 p.m. on Wednesday, November 7, 2018, in Town Council Chambers, 1505 Tiburon Boulevard, Tiburon, California. ROLL CALL PRESENT: COUNCILMEMBERS: Fraser, Fredericks, Kulik, Thier, Wehner ABSENT: COUNCILMEMBERS: None PRESENT: EX OFFICIO: Town Manager Chanis, Town Attorney Stock, Director of Community Development Anderson, Director of Public Works/Town Engineer Barnes, Associate Planner O'Malley. Town Clerk Stefani ORAL COMMUNICATIONS Victoria Fong, Chair of the Heritage & Arts Commission, said the H&A is in the process of updating guidelines for public art. Page I of 4 T own Council Minutes #23-2018 November 7, 2018 Richard Rozen, Artist Laureate, said one of his goals as Artist Laurate was to find opportunities for public art and invited the Council to an upcoming event at the library to learn about innovations in public art. Lalita Waterman, Southridge West, requested the Council consider installing additional electric vehicle charging stations closer to the freeway. Ken Weil, Hilary Drive, said he was having trouble getting a response from the Town about updates to the Hawthorne undergrounding project and requested the Town update the website with new information. CONSENT CALENDAR CC-1. Town Council Minutes - Adopt minutes of October 17, 2018 regular meeting (Town Clerk Stefani) CC-2. Municipal Code Amendments - Adopt amendments to Chapter 2 (Administration) of the Tiburon Municipal Code Correcting Certain References and Clarifying Provisions of the Planning Commission, Design Review Board and Planning Agency (Community Development Department) CC-3. Stewart Drive - Authorize budget amendment in the amount of$31,000 to fiend design work for safety improvements to pedestrian crossing at Stewart Drive and Tiburon Boulevard Intersection (Department of Public Works) MOTION: To adopt Consent Calendar Items 1-3, as written. Moved: Fredericks, seconded by Thier VOTE: AYES: Unanimous ACTION ITEMS AI-l. Wireless Regulations - Consider adoption of Resolution malting amendments to the Town's Wireless Communications (WCF) Standards (Community Development Department) Associate Planner O'Malley said the Town maintains Council-adopted standards for Wireless Communication Facilities and has made various updates to the standards over the years. She said the Federal Communications Commission (FCC) recently published a ruling that aims to streamline approvals that will reduce local government control over the location and design of small cell wireless facilities, prompting staff's recommendation to make amendments to the Town's adopted standards. She said the amendments are intended to insert clear and reasonable criteria for applicants in an expedited manner within the limits of state law. O'Malley said the new regulations are being challenged in court and therefore, staff views these amendments as temporary `stop-gap' measures pending a more comprehensive understanding of the rannilications of the new Page 2 (?f'4 Town Council Minutes 923-2018 Novemher 7, 2018 regulations. She added staff anticipates future updates to the standards, and possibly the "Town's Zoning Code, may be required to bring the Town into optimal compliance. Councilmember Fredericks noted that it may be helpful to add in a point that there is a desire to minimize view impacts for ground mounted equipment. Mayor Fraser suggested including visuals to the standards, and Fredericks agreed. Director of Community Development Anderson agreed. Councilmember Thier asked if the standards would be amended again after the legal challenges are over. Town Attorney Stock confirmed this point, and said there were multiple challenges of the new regulations. He said it is important to have published standards in place now, because the new regulations may go into effect in January. Thier also corrected an incorrect reference in the standards and recommended making better distinctions between private and commercial property references. She also asked about regulation on Highway 13I/Tiburon Boulevard. Town Attorney Stock said the Town could regulate anything outside the right-of-way. Vice Mayor Kulik inquired about the 60-day time limit to act on eligible facility applications, and pointed out that there may be a situation where the Town does not anticipate holding a meeting within that time frame. Stock advised that these applications would not necessarily by- pass the approval process. Mayor Fraser recalled a previous issue with installations on water tanks. Director Anderson recalled the same issues and said the Marin Municipal Water District does not allow it. Mayor Fraser opened the floor for public comment. There was none. MOTION: Adopt Resolution adopting standards, as amended. Moved: Fredericks, seconded by Thier VOTE: AYES: Unanimous TOWN COUNCIL REPORTS Councilmember Thier said she and Councilmember Welner were working on a resolution to bring to the next Council meeting and said there is a potential conflict with the January Council meeting date due to a training course. TOWN MANAGER REPORT The Town Manager reminded the Council he would be out of the office for several days, and said he can coordinate with the Council to determine the best January meeting date.
