HomeMy WebLinkAboutTC Res 2000-09-20 / RESOLUTION NO. 3448 ,- A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TffiURON P ARTIALL Y GRANTING THE APPEAL BY MICHAEL REX ASSOCIATES OF THE APPROVAL OF SITE PLAN AND ARCHITECTURAL REVIEW AND IMPOSING AN ADDITIONAL CONDITION OF APPROVAL FOR PROPERTY LOCATED AT 14 PLACE MOULIN WHEREAS, on July 20, 2000, the Design Review Board held a public hearing to consider the approval of an application for Site Plan and Architectural Review for the construction of a new single-family residence at 14 Place Moulin, proposed by Star Two LLC ("Owner"); and WHEREAS, testimony was received from Michael Rex Associates ("Appellant"), representing the owners of the adjacent property located at 16 Place Moulin, regarding concerns over potential privacy impacts and excessive mass and bulk which could be created by the proposed dwelling; and WHEREAS, after receiving public testimony and considering the application, the Board detennined that the design of the proposed dwelling was consistent with the Hillside Design Guidelines and would not result in unnecessary privacy impacts on the adjacent property owner, and conditionally approved this application; and WHEREAS, on July 31, 2000, the Appellant filed an appeal of the Board's decision to ,- conditionally approve the application for Site Plan and Architectural Review for the construction ofa new single-family dwelling at 14 Place Moulin; and WHEREAS, the appeal came before the Town Council of the Town ofTiburon on September 6, 2000, at which time the Town Council held a duly-noticed public hearing on the appeal; and WHEREAS, on September 6, 2000, after hearing all testimony and reviewing all documents on the record, the Town Council found that the proximity of the proposed house to the adjacent home and the presence of several windows on the side of the proposed house facing the Appellant's house would result in unwanted privacy impacts on the adjacent home at 14 Place Moulin; and WHEREAS, based on the above findings, the Council determined to partially grant the appeal by the Appellant, with the condition that the proposed garage window and the lower floor windows on the west side of the house shall be deleted, (a vote of5-0). Tiburon Town Council Resolution No, 3448 September 20, 2000 1 ,- -- r-- -- -- NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Tiburon to memorialize that the appeal of Michael Rex Associates was partially granted, subject to the following additional condition of approval: 1. The garage window and the lower floor windows on the west side of the house are not approved and shall be deleted.
