A RESOLUTION OF THE TIBURON TOWN COUNCIL
REPEALING THE CURRENT CALIFORNIA ENVIRONMENTAL QUALITY ACT
(CEQA) GUIDELINES (TOWN OF TIBURON ENVIRONMENTAL REVIEW
GUIDELINES) AND ADOPTION OF STATE OF CALIFORNIA CEQA GUIDELINES
BY REFERENCE THROUGH INCORPORATION
WHEREAS, the Town of Tiburon has previously adopted local environmental review
guidelines pursuant Section 15022 of the State CEQA Guidelines, said local guidelines having
been most recently amended on November 6, 2002 through adoption of Resolution No. 62-2002;
and,
WHEREAS, the Town has determined that its local guidelines are in need of updating to
reflect changes in the law and in the State CEQA guidelines since 2002; and,
WHEREAS, the Planning Commission considered recommending repealing the current
Environmental Review Guidelines (2002) and adopting the State CEQA guidelines through
incorporation by reference at a public meeting held on March 27, 2019; and,
WHEREAS, at that meeting, the Planning Commission voted 4-0 to adopt a Resolution
recommending the Town Council repeal the current Environmental Review Guidelines (2002)and
adopt the State CEQA guidelines through incorporation by reference; and,
WHEREAS, the Tiburon Town Council held a Public Hearing to consider repealing the
current CEQA guidelines and adopting the State CEQA guidelines through incorporation by
reference at a meeting held on April 17, 2019; and,
NOW, THEREFORE BE IT RESOLVED that the Tiburon Town Council does hereby
repeal the Town's Environmental Review Guidelines(2002) and adopt the State CEQA guidelines
through incorporation by reference.
PASSED AND ADOPTED at a regular meeting of the Tiburon Town Council on April 17,
2019, by the following vote:
AYES: COUNCILMEMBERS: Fraser, Fredericks_ Kulik, Thier, Wehner
NAYS: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS: None
