OF THE TOWN OF TIBURON OPPOSING SENATE Bll..L 402 WHEREAS, Senate Bill 402 mandates a system of compulsory and binding arbitration of the resolution of public sector collective bargaining disputes with police and fire unions; WHEREAS, Senate Bill 402 would transfer the authority of the Mayor and Town Council over these critical service areas in a city's budget to outside, non-elected arbitrators who are not accountable to Town residents; WHEREAS, the success of this legislation would give police and fire unions first call on the Town's treasury to the detriment of other services; WHEREAS, Senate Bill 402 would give unilateral control to police and fire unions to declare an impasse, against the wishes of the Mayor and Town Council, and call for arbitration; ,-, WHEREAS, Senate Bill 402 imposes a clear and costly mandate on all local public agencies in the hundreds of million of dollars statewide, both for the arbitration process and the cost of the arbitrator's award above the employer's last best offer; and WHEREAS, the proponents of said legislation claim it is necessary to prevent strikes by police and fire unions when strikes by these employees are already illegal under current law and court decisions; NOW, THEREFORE, BE IT RESOLVED, that the Town Council of the Town of Tiburon declares it opposition to Senate Bill 402, and calls upon state legislator and the Governor to recognize the importance of local control of local budgets and public services, and to vote against this unreasonable intrusion, and PASSED AND ADOPTED at a regular meeting of the Tiburon Town Council on March 15, 2000, by the following vote: AYES: NOES: ABSENT: cOUNcll..MEMBERS: cOUNcll..MEMBERS: cOUNcll..MEMBERS: Bach, Gram, Hennessy, Thompson None Ma e TOM GRAM, MA TOWN OF TmURON - ATTEST?:i2.
