A RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF TIBURON
APPROVING AN AMENDMENT TO THE
RING MOUNTAIN PRECISE PLAN (PD #10)
ASSESSOR PARCEL NO. 34-012-53
WHEREAS, on September 25, 2002 the Planning Commission held a public
hearing to consider the approval of an amendment to the Ring Mountain Precise Plan to
amend the building envelope for the property located at 46 Via Los Altos; and
WHEREAS, on September 25, 2002, after receiving public testimony and
considering the application, the Planning Commission adopted Resolution No. 2002-10
recommending to the Town Council that the Precise Plan Amendment be approved; and
WHEREAS, on October 16,2002, after hearing all testimony and reviewing all
documents on the record, the Town Council concurred with the findings made by the
Planning Commission and found that the proposed precise plan amendment to establish a
new secondary building envelope for the property located at 46 Via Los Altos would be
consistent with the overall intention of the Ring Mountain Precise Plan and the policies
contained within the Land Use Element of the Tiburon General Plan.

. NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of
Tiburon does hereby approve of the requested amendment to the Ring Mountain Precise
Plan, subject to the following conditions:
1. The building envelope for the property located at 46 Via Los Altos is
adjusted to the configuration and location shown on drawings dated
August 26, 2002 (one page) prepared by I.L. Schwartz Associates, Inc.,
said drawing being on file with the Tiburon Planning Division, as
amended such that the building envelope shall extend no closer than five
(5) feet from the rear property line, and that the expanded area be
designated only as a secondary building envelope.
2. This Precise Plan Amendment approval shall be valid for 36 months
following its effective date, and shall expire unless subsequent zoning
and/or building permits have been issued pursuant to this approval. A
time extension may be granted if such request is filed prior to the
expiration date.
3. This approval shall in no way alter other provisions of the Ring Mountain
Precise Plan not specifically described herein.
