On average there are over 100 workers on site each day, working in all areas of the project as scopes become available. Work hours have been extended to Saturdays for those scopes quiet enough to occur within the parameters of the noise ordinance. The focus on the structures has moved from the completion of the structural shell of the buildings and the installation of MEPs, to the installation of finishes. Scopes such as cabinets have been in progress for several months, with cabinet shops being approved ahead of time to allow cabinet fabrication to sequence just in time to allow for installation to occur as areas become available after drywall. The same has been true for the interior doors, the wood ceiling paneling, and hardwood flooring. The landscape scope [has] also progressed with the majority of the hardscape concrete scopes being completed. And, with the rain season coming to an end, the hardscape and softscape scopes are being accelerated. Rough grading, soil import, fine grading, softscape installation and utility installation have all continued through the rain season, when weather permitted, and are moving full steam ahead. Further, I have consulted with Mr. Davis and Mr. David Whiteside, Construction Manager and Project Consultant representing the owner, and both have unequivocally asserted that the project will be completed before the December 23, 2014, deadline. Attached are recent project photos. May 1, 2014 Page 2 of 3 Town of Tiburon MEMORANDUM CONSTRUCTION SITE MANAGEMNT PLAN REVISIONS: Due to ongoing neighborhood concerns regarding parking and construction traffic attributable to this project, I have requested the project management team to revise their site management plan to better address these issues. They have, and these revisions include: establishment and enforcement (by both Thomson Brooks and the Building Division) of a maximum 1 to 4 ratio of on- street parked vehicles to workers on the site on any given workday; no parking on both sides of the street; cessation of parking in the third turnout on Gilmartin Court, which will be blocked off and only available for guests visiting the residents of Gilmartin Court; no parking in areas immediately in front of 111 Gilmartin Drive; and increased utilization of on -site parking areas for worker commuter vehicles. May 1, 2014 Page 3 of 3 CONSTRUCTION SITE MANAGEMENT FOR 110 GILMARTIN Revised: 4.23.14 Dust Control: • During all phases of construction, aspects of the work that generate dust (demolition /deconstruction, site grading, landscaping, masonry) will be mitigated with moisture. The moisture will be used only where necessary and will be contained specifically within the construction areas. • Piles of debris will be consolidated and covered with tarps to minimize the potential effects of air born dust. Facilities: • All chemical toilets and wash stands will be placed on site within the outlined staging areas in such a way as to minimize exposure to neighbors and restrict their view from Gilmartin Drive. Depending on the number of individuals on site, the chemical toilets will be serviced at least once a week. Toilets will need to be located appropriately to allow access for the service trucks. Fire Safety: • Prior to the start of the Deconstruction phase of the project, Thompson Brooks, Inc. met with the Tiburon Fire Marshall to surrey the site and review the plan for the deconstruction. As a result, Thompson Brooks, Inc. has adopted several suggestions made by the Fire Marshal, including the following: • The use of cutting torches for the removal and installation of structural steel will stop one hour prior to the daily job closing and the general area where the scope is taking place will be monitored and inspected prior to departure. • Fire Department access to the site through the upper and lower entry gates will be achieved through the use of non case hardened chains and a padlock system. During the deconstruction phase, the upper and lower entry gates will be unlocked and open during the site hours of operation. • A means of constant communication (cell phone) shall be on site during the deconstruction phase to report emergencies. Fire blankets are required to protect any combustible adjacent areas. • ABC fire extinguishers will be on site at all times. Hours of Operation: • Hours will be limited to times specified by Chapter 13 of the Tiburon Municipal Code: o Monday — Friday: 7am — 5pm o Saturday:9:30am -4pm o Sunday & Holidays: No Work Permitted o Heavy Equipment: Monday— Friday Sam — 5pm Neighborhood Notifications: • Prior to the commencement of the project, a Letter of Introduction will be sent to all neighbors. The Letter will contain contact information for Thompson Brooks, Inc. personnel, hours of operation, projected duration of overall project, etc. • Signs will be posted at all entries to the site. These signs will contain all information required by Chapter 13 of the Tiburon Municipal Code, including the job site address, hours of operation, name of the General Contractor, emergency contact, and contact information for pertinent Thompson Brooks, Inc. personnel. • Prior to the commencement of the Deconstruction phase, the Project Superintendents will make every effort to introduce themselves in person to neighbors living adjacent to the project site. • In the event it is deemed necessary to notify neighbors of upcoming scope (i.e. major events, large deliveries which could impact traffic, etc.) Thompson Brooks, Inc. will attempt to contact the neighbors by telephone, email, and /or in person (door to door). Parking: • Thompson Brooks, Inc. requires all site personnel to carpool to achieve the goal of an average of 4 people per vehicle. The only exception may be those trucks and vans that are required on site to perform scope, and those vehicles should be used for carpooling whenever possible. Parking for the project will be contained within the site whenever feasible, but street parking will occur in designated areas only. Designated areas include: • South of the Lower Driveway, along the property between 110 Gilmartin and the Fire Road (300 Round Hill). No parking is allowed South of the Fire Road, and definitely not along the curved section of Gilmartin Drive. • Area between the Lower and Upper Driveway along Gilmartin Drive. The area immediately in front of the driveway for 111 Gilmartin Drive will be blocked off to allow the neighbor easier access in and out of his driveway. o North of the Upper Driveway, along Gilmartin Drive, until the property line. o Gilmartin Court, at the first and second turnouts and along the job site side of the road towards the East property line. At no time will vehicles be allowed to park on both sides of a street, even if turnouts are available. For example, parking will be allowed in the turnout on the West side of Gilmartin Drive, but not on the East side of the street. Parking will not be allowed in the third turnout on Gilmartin Court. This turnout will be blocked off and remain available for guests visiting the residents of Gilmartin Court. Non -heavy equipment vehicles (pickups, cars, motorcycles, scooters, mopeds, priuses, etc.) may enter and park on the site anytime provided no equipment, lumber, or other building materials are off- loaded before 7am or after 5pm. Noise Control: • Thompson Brooks, Inc. will follow all noise ordinances and guidelines per the Town of Tiburon, as well as limiting the hours of operation per the requirements specified in Chapter 13 of the Tiburon Municipal Code. Street Maintenance: • Every effort will be made to maintain Gilmartin Drive & Gilmartin Court free and clean of debris potentially left by incoming and outgoing construction traffic. Traffic Control: • Traffic control will be implemented and adhered to throughout all phases of the project. • Thompson Brooks, Inc.'s policy is to have traffic control in place when trucks are entering and exiting the site. Traffic control will include having 2 lookouts, one at each end of the property on Gilmartin Drive. The lookouts will wave down oncoming traffic with signs to proceed cautiously, and /or stop until the road is clear and safe for passage of other vehicles. Managed access will be maintained at all times for all local traffic and emergency vehicles. Deliveries to the site will only be accepted and scheduled to take place during accepted construction hours (Monday — Friday: Sam — 5pm), as outlined in Chapter 13 of the Tiburon Municipal Code. The trees are located along a spur of the Old Rail Trail between the Richardson Bay Sanitary District plant at 500 Tiburon Boulevard and the Tiburon Boulevard right -of- way and are approximately 80 to 100 feet tall. The applicants have agreed to pay for removal of the trees and planting replacement vegetation. A copy of a site plan showing the location of the trees is attached. In accordance with the Town's policy for prominent trees located on Town property, on April 30, 2014 the Parks, Open Space and Trails Commission reviewed this tree permit application. After hearing testimony from the applicant and other residents, all of whom supported the request, the Commission recommended that the tree permit be approved. Today, I approved the permit. The applicants will need to obtain an Encroachment Permit from the Public Works Department before removing the trees. Please let me know if you have any questions about this permit. a. Counsel Hurd recommended that the Library Agency amend the Bylaws to modify the term limits for the "at- large" Trustee, change the rules of parliamentary procedure, and make the Bylaws internally consistent. The agency held a public meeting on the proposed Bylaw amendment on April 21, 2014, and at the meeting, this Agency heard and received all oral and written protests, objections, and evidence which were made, presented or filed, and all persons present were given an opportunity to hear and be heard with respect to the proposed Bylaw amendment. The Library Agency voted to change the bylaws as follows: 1. Article 3, Section 4 - Term. Term Limits for Reed Union School District Trustee. The earlier bylaws stipulated that the terms of office for Trustees from the City of Belvedere and Town of Tiburon were for a three year term and that the appointee could apply for one other three year term. The Reed Union School District appointee had a two year term and the appointee could apply for one other two year term. The Agency voted to make all appointments equal and change the RUSD appointment to a three year term with the option to be appointed for a second three year term. The approval of the RUSD appointee by Tiburon and Belvedere Councils remains in the bylaws. 2. Article IV, Section 7 - Conduct of Meetings At Counsel Hurd's recommendation, the Agency voted to adopt the Rosenberg's Rules of order in conducting their meetings. 3. Counsel Hurd corrected typos and other general corrections to the bylaws. 3 RESOLUTION NO. 209-2014 RESOLUTION OF THE BOARD OF TRUSTEES OF THE BELVEDERE - TIBURON LIBRARY AGENCY AMENDING THE BOARD'S BYLAWS WHEREAS, there is currently a need to amend the Belvedere- Tiburon Library Agency Bylaws to modify the term limits for the "at- large" Trustee, change the rules of parliamentary procedure, and make the Bylaws internally consistent; and WHEREAS, this agency called for and held a public meeting on the proposed Bylaw amendment on April 21, 2014, and at the meeting, this Agency heard and received all oral and written protests, objections, and evidence which were made, presented or filed, and all persons present were given an opportunity to hear and be heard with respect to the proposed Bylaw amendment. NOW, THEREFORE, the Belvedere - Tiburon Library Agency RESOLVES as follows: 1. That the Bylaw amendment attached as Exhibit "A" is hereby adopted and incorporated by reference as the Bylaws of the Board of Trustees. 2. That, because the Bylaw amendment attached as Exhibit "A" extends the length of the term of the "at large" Board member, the currently sitting "at large" Board member may serve two more years after her current term expires on June 30, 2014, if said further term is recommended by the Reed Union School District Board of Trustees and approved by the governing bodies of Belvedere and Tiburon. This would result in a total term of six years for the currently sitting "at large" Board member, which is the maximum length of time a Board member may serve under the proposed new bylaws. The Board of Trustees ( "Board ") shall govern the Belvedere- Tiburon Library Agency's ( "Library Agency ") construction, ownership, operation and /or maintenance of public library facilities. ARTICLE II OFFICES PRINCIPAL OFFICE. As the location of the principal office of the Board must be within the city or town limits of Belvedere or Tiburon, the principal office shall be at the library, 1501 Tiburon Boulevard, Tiburon, California, 94920. ARTICLE III TRUSTEES SECTION 1- NUMBER OF TRUSTEES The Board shall consist of seven (7) Trustees, three of whom shall be appointed by the Town of Tiburon, three of whom shall be appointed by the City of Belvedere, and a seventh Trustee who shall be designated an "at large" member and shall be recommended by the Reed Union School District Board of Trustees. The governing bodies of Belvedere and Tiburon shall approve the appointment of the at -large member. SECTION 2- APPOINTMENT PROCESS The Board shall utilize an appointment process, which includes an advertised and open application opportunity for interested Belvedere and Tiburon residents to commence each year during the first week of April. The governing bodies of Belvedere and Tiburon make the appointments by June 30. SECTION 3- REMOVAL OF TRUSTEES Each Trustee shall be subject to removal and replacement at the pleasure of the appointing government body(ies). The at -large Trustee may be removed and /or replaced by action of the Reed Union School District and both councils. Page 1 of 6 SECTION 4- TERM The terms of office for each Trustee shall be three (3) years commencing July 1 of the year of appointment. The terms of the Trustees shall be staggered so that no more than three (3) Trustees' terms expire during any one fiscal year. Trustees may be reappointed for one successive term of three (3) years at the discretion of the appointing authority. SECTION 5- COMPENSATION OF TRUSTEES Trustees of the Board shall not be compensated for their services, but the Board in its discretion may reimburse Trustees for actual expenses incurred in carrying out Board business. SECTION 6- TRUSTEE VACANCIES A vacancy among Trustees because of death, resignation, removal, disqualification or any other cause shall be filled in the manner prescribed in these Bylaws for regular appointments to that office. ARTICLE IV MEETINGS SECTION 1- PLACE OF MEETINGS All Board meetings shall be held at the library, 1501 Tiburon Boulevard, Tiburon, California, 94920 unless otherwise specified in accordance with the Brown Act. SECTION 2- REGULAR MEETINGS Regular meetings of the Board shall be duly noticed to the community and held monthly, normally on the 3rd Monday of each month, at 6:15PM unless otherwise determined by the Chair, in consultation with the members of the Board. SECTION 3- SPECIAL MEETINGS Special meetings of the Board may be called by the Chair or by a majority of Trustees of the Board. Written notice of the time and place of any such special meeting shall be delivered personally or by mail to each Trustee and to each local newspaper of general circulation, or radio or television station requesting notice in writing. This written notice must be received at least 24 hours before the specified time of the meeting. The notice shall specify the business to be transacted and the Board shall consider no other business. Page 2 of 6 SECTION 4- QUORUM A majority of the authorized number of Trustees shall constitute a quorum for the transaction of business, except to adjourn as provided in Section 5 of this Article. Every act or decision done or made by a majority of the members present at a meeting duly held at which a quorum is present, shall be regarded as the act of the Board. A meeting at which a quorum is initially present may continue to transact business notwithstanding the withdrawal of members, if any action taken is approved by at least a majority of the required quorum for that meeting. SECTION 5- ADJOURNMENT A majority of the members present, whether or not constituting a quorum, may adjourn any meeting to another time and place. Telephone notice should be given to all Trustees not present at the meeting in which the motion to adjourn takes place. SECTION 6- NOTICE OF ADJOURNMENT Notice of the time and place of holding of an adjourned meeting need not be given, unless the meeting is adjourned for more than 24 hours, in which case notice of the time and place shall be given before the time of the adjourned meeting, in the manner specified in Section 3 of this Article. SECTION 7- CONDUCT OF MEETINGS The Board shall utilize Rosenberg's Rules of Order in conducting its meetings. Meetings shall be held in compliance with the Brown Act. SECTION 8- ABSENCE FROM MEETINGS Trustees, as a matter of courtesy, shall notify the Chair of any anticipated absence from a scheduled meeting. SECTION 9- PUBLIC COMMENT Persons desiring to address the Board on any agenda item or on a new item during the Open Forum portion of the agenda should utilize the following procedures: obtain recognition from the Chair, clearly state name and address (optional), address all remarks to the point in question and to and through the Chair. SECTION 10- MINUTES Minutes shall be taken at all meetings of the Board. The minutes for each meeting shall be transcribed and approved by the Board with any changes added by Trustees, at its next regular meeting. Copies of all approved minutes shall be available at the library office. Page 3 of 6 SECTION 11- REGULATIONS The Library Agency will adopt the "FPPC" (Fair Political Practices Commission) Conflict of Interest Code and all Trustees will file disclosure statements. The Library Agency shall keep at its principal office the original or copies of the Joint Powers Agreement, the Ordinance creating the Library District, and the Bylaws. Additionally, the Library Agency shall keep adequate and correct books and records of account and written minutes of the proceedings of its meetings. Each Trustee shall have the right at any reasonable time to inspect these books, records and documents. SECTION 12- AGENDA Trustees who wish to place an item on the next agenda should give the appropriate material to the Chair 5 days prior to the regular meeting, except in an emergency items may be placed on the agenda as allowed under the Brown Act. The agenda, supporting documents and minutes of the previous meeting shall be given to each Trustee at least 3 days prior to the meeting. ARTICLE V OFFICERS SECTION 1- OFFICERS The officers of the Board shall be Chair, Vice - Chair /Secretary, and Treasurer. At the discretion of the Board, an employee or citizen volunteer may fill the position of Treasurer. SECTION 2- ELECTION OF OFFICERS The officers of the Board shall be chosen by the Board to serve for a term not in excess of one (1) year unless otherwise decided by five members or more of the Board. Elections shall take place at the first regular meeting of the Board held in July and the terms of the officers shall commence as of the date of the first regular meeting in July. The Chair of the Board shall not succeed him /herself unless otherwise decided by five or more Board members. SECTION 3- SUBORDINATE OFFICERS The Board may appoint, and may empower the Chair to appoint, such other officers as the business of the Board may require, each of whom shall hold office for such period, have such authority and perform such duties as are provided in the Bylaws or as the Board may from time to time determine. Page 4 of 6 SECTION 4- RESIGNATION OF OFFICERS Any Officer may resign at any time by giving written notice to the Board. Any resignation shall take effect at the date of the receipt of that notice or at any later time specified in that notice; and, unless otherwise specified in that notice, the acceptance of the resignation shall not be necessary to make it effective. SECTION 5- VACANCIES IN OFFICES A vacancy in any office because of death, resignation, removal, disqualification or any other cause shall be filled in the manner prescribed in these Bylaws for regular appointments to that office. SECTION 6- CHAIR OF THE BOARD The Chair of the Board shall preside at meetings of the Board and exercise and perform such other powers and duties as may from time to time be assigned to him or her by the Board or prescribed by the Bylaws. SECTION 7- VICE -CHAIR In the absence or disability of the Chair, the Vice -Chair shall perform all the duties of the Chair, and when so acting shall have all the powers of, and be subject to all of the restrictions upon, the Chair. The Vice -Chair shall have such other powers and perform such other duties as from time to time are prescribed by the Board, by the Bylaws, or by the Chair. When the Vice -Chair is absent, the Chair shall appoint a temporary Vice -Chair to assume those duties. SECTION 8- TREASURER The Treasurer of the Library Agency shall be bonded and shall deposit all money and other valuables in the name and to the credit of the Library Agency with such depositories as the Board may designate, shall disburse the Library Agency's funds as the Board may order, shall render to the Chair and Board, when requested, an account of all transactions and the financial condition of the Library Agency, and shall have such other powers and perform such other duties as the Board may prescribe. SECTION 2- ANNUAL BUDGET The Board with the Treasurer shall prepare an annual budget using a July 1 through June 30 fiscal year. Our large extended family contributes time on daily basis to make their final years as comfortable as possible. With our transient society, many families do not have this luxury. Right now I have a hard time contemplating how the needs of our generation will be met with the increased numbers in our age group. We also provided grants to various agencies such as the Marin Community Clinic and Ritter House and helped fund emergency services at Marin general for those who could not pay for treatment. We were forced to close several years ago as we did a lot of small grants and the cost of administration was becoming equal to the amount of the grants. To the best of my knowledge, we were the only resource for some of the small grants for prescription drugs etc. for seniors and others. I am concerned about the number of seniors in Marin whose needs are not being addressed. I have also served as a member at large on the Marin County Dental Society Board, on the board of the Del Mar Property Owners Association, Marin Rowing Association Board as president for 7 years and as board member for 20 plus years. While President I presided over a 1.2 million dollar expansion of the boathouse and helped fundraise the entire amount needed for construction. Lastly I was president (8 years) and on the board for18 years of the Kingswood property owners association at Lake Tahoe. I managed my dental practice in Marin for 28 years and have been retired for 20 plus years. I am also an experienced investor. I have been married to my wife, Pat, for 48 years and have two married daughters. My wife and I travel a lot but I have usually been able to schedule our travels around my board meeting schedules. I attended Oregon State College where we have endowed 2 full scholarships in the School of Science. I also spent my junior year at UC Berkeley and then four years at UCSF School of dentistry. McKegney Green Use and Management Policy. • Director Anderson presented the staff report. • Vicky Sodaro, Tiburon Peninsula Soccer League (TPSL) official, stated that McKegney Green is not a $60 per hour field because its amenities are not like other fields; painted lines, better quality field condition, equipment, close restrooms, etc. She noted that parents pay property taxes to support the Town's parks and they feel as if this is "another tax ". She distributed calculations showing how much costs would rise for TPSL if the $60 rate were adopted. She said the soccer board had met and were disappointed because the increased costs would make it difficult to retain membership levels. She noted that the bill for all of last year was only $6,800. The new rates would be a huge amount to absorb. She would like to see a capital improvement plan adopted for the Green, and believes the Green is in worse shape than it has ever been, even though it has been a dry year. • Mark Minturn, TPSL President, acknowledged the competition for field space within Marin County. He did not feel that young kids should have to leave the community to find soccer fields to practice or play on. He said with 700 members, the league's cost per child would rise by at least $50 with the new rates. He questioned how the field maintenance costs used in the developing the draft policy were derived. He would like to better understand them and see if they can be justified. • Greg Bohannon, Southern Marin Lacrosse, questioned why the policy prohibited simultaneous mixed sports use of the field, and thought it could be easily accomplished given the large size of the Green. • Commissioner McMullen expressed support for the draft policy and emphasized that the hourly cost is a best estimate at this point and future cost accounting must be implemented to better assess future costs. The TSMG report showed that the cost of maintaining the field is far more than has been collected in past years. He sympathized with the TPSL, but said that $50 /year to stay in town is a deal versus carpooling or driving out of town. He noted that Town staff would keep more detailed records of costs and review after one year. He said that the capital improvement plan (CIP) called for in the policy should be established with the help of the public and Commission within a year of the policy implementation. • Commissioner McDermott found the policy reasonable and explained how the hourly rate was estimated and established. He understands that the costs are a concern for TPSL but that the rate may change in the future via more detailed cost tracking, including administrative costs. He believed the CIP would establish a wish list for improvements to the field, with input from users. He supported the draft policy. • Commissioner McMullen echoed the concern about the policy banning simultaneous mixed sports use. TPSL representative Stibich indicated that TPSL prefers exclusive (not shared) use for safety reasons, and that most field holders don't allow simultaneous mixed uses. McMullen suggested allowing the permit.form to specify if exclusive use is requested by the user. Consensus of the Commission was to leave the policy "as is" with respect to simultaneous uses. • Commissioner Allen noted that McKegney is not the same quality as most sports fields used by the leagues. Chairman Winkler suggested an "incremental cost" approach. It was the consensus of the Commission that additional data regarding costs to maintain and administer the field should be collected by Public Works for use in establishing a reasonable hourly rate for use in implementation of the policy. It was moved by Allen and seconded by McMullen to: 1) Refer the matter to its ad -hoe McKegney Green subcommittee for further study of costs and the pricing model before returning to the full Commission; and 2) Direct that staff and the ad -hoc subcommittee work with the field users to renegotiate for 2014 an interim policy based on the adopted 2013 interim policy, with possible modifications to Section 4 as appropriate.
