TO: Tiburon Town Council
It has been called to our attention that the construction project at 110 Gilmartin will be on tonight's
agenda. We reside at 109 Gilmartin Drive directly across the street from this project and would like to
comment.
We have been impacted as much as any other adjacent neighbor to this project with noise (and
associated loss of use of our yard and inability to open our windows), dust and dirt (on everything),
many mice (especially during grading), cigarette smoke entering our home, trash left on our property
(workers eat in their cars on our side of the street leaving cans /fast food wrappers, etc.), foul language
by workers, (we have young children), etc., etc., etc., On the other hand, we have benefited from the
removal of several very flammable and view - obstructing Monterey Pines (and are hoping the Redwoods
will also be removed as they are out of place on this hill). In any event, we are certainly looking forward
to the completion of this project as soon as possible.
I believe that fines as specified by town ordnances should be levied (these were known at the start of
the project) and would like to suggest that some portion of these funds go towards improvements on
Gilmartin Drive for the benefit of those who have endured this project.
Two specific ideas come to mind:
1. Around 7 or so years ago, a developer had proposed removing French Broom and planting Oak
Trees on Gilmartin Drive as mitigation for trees removed in a development on the other side of
Tiburon. As French Broom is non - native and invasive, not to mention highly flammable, I
would love to see its removal and replacement with native Oaks. This would beautify Gilmartin
Drive and reduce fire hazard to the benefit of all the neighbors.
2. Left turns out of Gilmartin Drive onto Tiburon Boulevard can be very difficult, particularly at
peak times. Adding a left hand turn lane at the base of Gilmartin Drive would be very helpful
to allow those turning left to not block (sometimes for a lengthy wait) those who need to turn
right (most trips, I would imagine).
I never believed that the project at 110 Gilmartin would be completed within the allowable
timeframe, despite the Contractor's assurances to the contrary at the approval meetings. However,
I also never expected it to take as long as it has taken. We have "construction fatigue" —and can
only hope that something good for the neighborhood comes of it.

BACKGROUND
Tiburon has accumulated approximately $614,645 of Rule 20A underground conversion credits
and can borrow up to five years of additional credits at the accumulation rate of $30,000 /year.
PG &E has informed the Town that any proposed Rule 20A project needs to initially gain a
position within the PG &E queue of future Rule 20A projects. Additionally, PG &E has projected
that any new Rule 20A project will not reach the construction phase for 5 to 7 years.
Staff is proposing that the next Tiburon utility underground district should be on Tiburon
Boulevard from Lyford Drive to Ned's Way. This approximate 960 linear foot section of Tiburon
Boulevard includes Reed School District and Sanitary District #5 properties that "front on" to
Tiburon Boulevard but no private properties. Staff is proposing that the District extend up Lyford
Drive approximately 150 feet to accomplish the undergrounding of the entrance to Reed School.
It is important to note that the Town's effort to gain a position within the PG &E queue of future
Rule 20A projects for this location does not preclude the Town from switching underground
district locations in the future before this project reaches the design stage. The Town will retain
its position in the PG &E queue if the Council decides to switch locations.
ANALYSIS
The proposed Tiburon Boulevard Underground Utility District involves the removal of
approximately 12 utility poles on both sides of Tiburon Boulevard. Certain utility poles outside of
the public right of way on the School District property will remain. These poles are difficult to
see from Tiburon Boulevard because of existing landscaping. Street light poles and traffic signal
poles on Tiburon Boulevard will remain as -is.
FINANCIAL IMPACT
The Town will have approximately $764,645 of credits "booked" with PG &E in five years when
this project could go to the construction phase. Additionally, the Town could draw on as much as

$150,000 of future credits if necessary. The projected cost of the project is approximately
$900,000.
RECOMMENDATION
Staff recommends that the Town Council:
1. Open the Public Hearing; receive comments from the public; and close Public Hearing
2. Move to approve a Resolution approving the Tiburon Boulevard Overhead to
Underground Utility Conversion Project (Lyford Drive to Ned's Way) as the next
priority underground project.
3. Direct staff to formally submit Resolution and accompanying exhibits to PG &E to
gain position within PG &E queue for Rule 20A projects

A RESOLUTION OF THE TOWN COUNCIL OF
THE TOWN OF TIBURON APPROVING THE
TIBURON BOULEVARD OVERHEAD TO
UNDERGROUND UTILITY CONVERSION
PROJECT AS THE NEXT PRIORITY
UNDERGROUND PROJECT FOR THE TOWN
WHEREAS, the California Public Utilities Commission (CPUC) has authorized electric
and telecommunication utilities to convert overhead utility lines and facilities to
underground pursuant to Electric Rule 20 and Telecommunication Rule 32, and
WHEREAS, pursuant to certain criteria, CPUC rules allow participating towns, cities and
counties to establish legislation authorizing the creation of underground utility districts
within which existing overhead electric distribution and telecommunication distribution
and service facilities will be converted to underground, and
WHEREAS, the Town of Tiburon (herein referred to as Town), has adopted an ordinance
authorizing the Town Council to designate areas within which all existing overhead
poles, overhead wires and overhead equipment associated with the distribution of electric
power, telecommunication services and cable television should be removed and replaced
with underground wires and facilities; and
WHEREAS, the Director of Public Works of the Town of Tiburon has consulted with the
affected public utilities and such utilities have agreed or been notified that the proposed
underground conversion district, designated the Tiburon Boulevard Underground Utility
District and more particularly described in Exhibit 1 attached hereto and incorporated
herein by reference, meets the criteria established by the rules of the CPUC, to wit,
that the street or road or right -of -way is extensively used by the general public
and carries a heavy volume of pedestrian or vehicular traffic, AND
that the street or road or right -of -way is considered an arterial street or major
collector as defined in the Governor's Office of Planning and Research General
Plan Guidelines, and
WHEREAS, each year the Town is notified by PG &E regarding the allocation of work
credits for conversion of overhead electric distribution lines and facilities to underground,
known as Rule 20A allocations, and
WHEREAS, the Director of Public Works for the Town of Tiburon has consulted with
PG &E and determined that the Town has accumulated Rule 20A work credits plus PG &E
has agreed that the Town may borrow against future credits sufficient to complete the
proposed overhead to underground conversion project, and
WHEREAS, the Town has notified the affected utilities by letter that each utility shall
complete the engineering of their respective portion of the Tiburon Boulevard Overhead
to Underground Utility Conversion Project, and
WHEREAS, the Town has notified the affected utilities by letter that the Town shall be
responsible for preparation of the trench profile and composite drawings and that the
Town shall be designated as "trench lead" to manage trenching, installation of
substructures, and pavement restoration and such other work, and
WHEREAS the Director of Public Works of the Town of Tiburon and the affected
utilities will coordinate and agree on a work schedule which meets their respective
capabilities, and further agreed to waive any administrative fees, costs or special street
restoration requirements for purposes of this project, and
WHEREAS, to the extent required, the Town has agreed to provide easements or rights
of way on private property as may be necessary for installation of utility facilities in a
form satisfactory to the affected utilities, and
WHEREAS, the Town Council has now received the report from the Town Director of
Public Works recommending that the area identified in Exhibit 1 should be designated as
an underground utility district within which all existing overhead poles, overhead wires
and overhead equipment associated with the distribution of electric power,
telecommunication services and cable television should be removed and replaced with
underground wires and facilities; and
WHEREAS, upon the recommendation of the Town Director of Public Works, the Town
Council has determined that the proposed Tiburon Boulevard Underground Utility
District is categorically exempt from environmental review pursuant to the California
Environmental Quality Act, and
WHEREAS, the Town of Tiburon has notified all affected property owners within the
proposed Tiburon Boulevard Underground Utility District and inviting same to attend a
public hearing to discuss formation of the proposed district, and
WHEREAS, the Town Council held a public hearing at which time the Council did
receive and consider the recommendation of the Town Director of Public Works and did
hear any and all objections or protests that were raised by the owners of property within
the above described district pertaining to designating this area an underground utility
district;
NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Tiburon
that:
Section 1. The public interest requires the removal of all existing utility poles [excepting
those poles supporting streetlights or traffic signals], overhead wires and associated
overhead structures and installation of underground wires and facilities for supplying
electric power, communication, or similar associated services within the areas as shown
in Exhibit 1, attached hereto, with such area being designated as the Tiburon Boulevard
Underground Utility District, and
Section 2, That the utility companies, cable television services and other affected services
shall commence work on installation of underground facility installation in Tiburon
Boulevard Underground Utility District and that as each phase of the project is complete
and ready for conversion from overhead to underground utility facilities, all fronting
property owners shall be notified by first class letter, postage pre -paid, of the schedule for
conversion of all utility service lines, and
Section 3, The electric utility shall USE the underground conversion allocation computed
pursuant to decisions of the California Public Utilities Commission for the purpose of
providing to each premises requiring it in Tiburon Boulevard Underground Utility
District a maximum of one hundred feet of individual electric service trenching and
conductor (as well as backfill, paving and conduit, if required) and each other serving
utility shall provide service trenching and conductor in accordance with its rules and
tariffs on file with the California Public Utilities Commission or as required by its
Franchise Agreement with the Town of Tiburon, and
Section 4. It is not anticipated, but if needed the electric utility shall [USE] said
underground conversion allowance allocation, up to a maximum amount of $1500 per
service entrance excluding permit fees, for the conversion of electric service panels to
accept underground service in the Tiburon Boulevard Underground Utility District, and
Town of Tiburon shall be financially responsible for any and all costs not covered by the
electric utility for the installation and maintenance of the conduit and termination box
located on, under or within any structure on the premises served, and
Section 5. It is not anticipated, but if needed, that upon notification as specified in
Section 2, all property owners in Tiburon Boulevard Underground Utility District shall
have underground electrical entrance facilities installed and inspected pursuant to the
Town Electrical Code within sixty (60) days and that should any property owner fail to
install satisfactory underground electrical entrance facilities by the date specified in the
notice, the electric utility shall notify the Director of Public Works who shall, within
thirty (30) days direct the electric utility in writing to discontinue electrical service to the
property, without recourse, pursuant to Rule 11 until electrical entrance facilities are
ready to accept underground electrical conductors and have passed the necessary
inspection requirements, and
Section 6. That once all services have been converted from overhead to underground, the
utility companies, cable television services and other affected services shall remove all
poles (except as specified above) and associated overhead facilities in Tiburon Boulevard
Underground Utility District within thirty (30) working days of completion of
undergrounding.

City /County of Tiburon, (Applicant) has requested PACIFIC GAS AND ELECTRIC COMPANY, a California corporation
(PG &E) to perform the tariff scheduled related work as located and described herein.
General Conditions:
PG &E will, at its expense, replace its existing overhead electric facilities with underground electric facilities as outlined in the
Rule 20 Tariff. To ensure the success of this program, the Applicant agrees to support the Rule 20A Program as follows:
Responsibilities of the Applicant:
1. Consult with PG &E to confirm the requirements and location of the project.
2. Provide a resolution and boundary map as required in Electric Rule 20.
3. Provide a list of all recorded property owners, APN #, phone number and address.
4. Provide a list of the most recent tenant (for rental properties).
5. Provide Base Map (in AutoCAD) showing the following: boundary, roads, future road improvements, sidewalks, curbs,
property lines, buildings, existing water and sewer, easements, and any other known utilities or obstacles.
6. Secure all required rights -of -way and easements, which must be satisfactory to and approved by PG &E.
7. Own and manage all contaminated soils. (Rule 20A funding cannot be used for environmental remediation costs)
8. Own and manage all cultural resource findings. (Rule 20A funding cannot be used for managing cultural resource
findings).
9. Provide recent pot holing /core samplings and soils/paving information from projects that were recently completed.
10. Provide acceptable construction yard for materials and equipment storage.
11. Pay for paving and restoration costs beyond the standard excavations and restorations necessary for the construction
of the project. Joint trench participants will replace paving, landscaping, sidewalk, etc. that is removed during
construction. (Rule 20A funding cannot be used for additional restoration costs).
12. Waive paving moratorium requirements, or pay for additional costs above PG &E's responsibility for restoration.
13. Stake and survey for any associated future grade changes.
14. Should applicant require additional traffic control beyond that which PG &E provides (per California Joint Utility Traffic
Control Committee), Applicant will pay for the additional costs.
15. Should Applicant require a traffic control plan, Applicant will prepare or pay to prepare such a plan.
16. Pay for streetlight costs per Street Light Agreement.
17. Remove Applicant owned streetlights attached to utility poles and located within the underground district at Applicant
cost. .
18. Issue and waive cost of encroachment permit.
19. Waive work hour restrictions for construction, including holiday and /or special construction limitations.
20. Waive all permit fees and other incidental project specific costs, including but not limited to: parking charges; rental
cost of city or county properties; and lost revenues.
Responsibilities of PG &E:
1. Provide consultation to Applicant to establish resolution and boundary map.
2. If designated as the design /trench lead, prepare the Intents, Composite and Form B (costs will be shared by all joint
trench participants).
3. Provide electric design to the design /trench lead agency, if lead is other than PG &E.
4. Identify all locations that require an easement.
5. Prepare easement documents for signature.
6. Upon request of the Applicant, Rule 20A allocation may be used for the Installation of no more than 100 feet of each
customer's underground electric service lateral.
7. Upon request of the Applicant, the Rule 20A allocation may be used for the conversion of electric service panels to
accept underground service, up to $1,500 per service entrance (excluding permit fees). Alternatively, if the Applicant
requests that PG &E manage the panel conversion work, perform such conversions by agreement (Form 79 -1113,
Agreement to Perform Tariff Schedule Related Work, Rule 20A).

8. Provide inspection services for the installation of PG &E facilities.

Status Report on Litigation Settlement and Ongoing Residential Construction
at 110 Gilmartin Drive
The Town issued building permits for construction of a new 18,500 square foot residence at 110
Gilmartin Drive on June 23, 2010. Pursuant to Chapter 13 of the Municipal Code, the Building
Official, issued a series of extensions, then referred, the request for an additional time extension
to the Town Council. On May 15, 2013, the Town Council voted to authorize an extension
through December 23, 2014 upon payment of reactivation charges and penalties in accordance
with an adopted schedule of payments.
The owners of the project subsequently threatened litigation disputing the Town Council's action,
and the matter was settled by mutual agreement on July 17, 2013, when a modified payment
schedule was adopted. The completion date of December 23, 2014 remained in place, but the
agreement provided for lower initial penalties and a sharply escalated fine accruing if the project
was not completed by that date. The property owners have complied with the provisions of the
settlement to date.
Construction on the project continues apace, and based on representations by the general
contractor's Construction Manager and by the owner's independent Project Consultant, appears
to be on schedule for completion by December 23, 2014. The Town Council was recently
provided (in a Digest item) a memorandum from the Building Official describing the progress on
the project as well as a copy of the current Construction Site Management Plan.
RECOMMENDATION
Staff recommends take any public comment and accept the status report.

According to Senior Project Manager Patrick Davis:
The 110 Gilmartin Project has continued to progress at an extremely fast pace since June
2013. On average there are over 100 workers on site each day, working in all areas of the
project as scopes become available. Work hours have been extended to Saturdays for those
scopes quiet enough to occur within the parameters of the noise ordinance.
The focus on the structures has moved from the completion of the structural shell of the
buildings and the installation of MEPs, to the installation of finishes. Scopes such as cabinets
have been in progress for several months, with cabinet shops being approved ahead of time to
allow cabinet fabrication to sequence just in time to allow for installation to occur as areas
become available after drywall. The same has been true for the interior doors, the wood ceiling
paneling, and hardwood flooring.
The landscape scope [has] also progressed with the majority of the hardscape concrete scopes
being completed. And, with the rain season coming to an end, the hardscape and softscape
scopes are being accelerated. Rough grading, soil import, fine grading, softscape installation
and utility installation have all continued through the rain season, when weather permitted, and
are moving full steam ahead.

Periodic site visits and inspections performed during the past year by Building Division staff
(primarily myself) can generally confirm the above as being an accurate assessment of
where the project stands at this point. Further, I have consulted with Mr. Davis and Mr.
David Whiteside, Construction Manager and Project Consultant representing the owner,
and both have unequivocally asserted that the project will be completed before the
December 23, 2014, deadline. Attached are recent project photos.

CONSTRUCTION SITE MANAGEMNT PLAN REVISIONS:
Due to ongoing neighborhood concerns regarding parking and construction traffic
attributable to this project, I have requested the project management team to revise their
site management plan to better address these issues. They have, and these revisions
include: establishment and enforcement (by both Thomson Brooks and the Building
Division) of a maximum 1 to 4 ratio of on- street parked vehicles to workers on the site on
any given workday; no parking on both sides of the street; cessation of parking in the third
turnout on Gilmartin Court, which will be blocked off and only available for guests visiting
the residents of Gilmartin Court; no parking in areas immediately in front of 111 Gilmartin
Drive; and increased utilization of on -site parking areas for worker commuter vehicles.

Dust Control:
During all phases of construction, aspects of the work that generate dust
(demolition /deconstruction, site grading, landscaping, masonry) will be mitigated with moisture.
• The moisture will be used only where necessary and will be contained specifically within the
construction areas.
• Piles of debris will be consolidated and covered with tarps to minimize the potential effects of
air born dust.

• All chemical toilets and wash stands will be placed on site within the outlined staging areas in
such a way as to minimize exposure to neighbors and restrict their view from Gilmartin Drive.
Depending on the number of individuals on site, the chemical toilets will be serviced at least
once a week. Toilets will need to be located appropriately to allow access for the service
trucks.
Fire Safety:
• Prior to the start of the Deconstruction phase of the project, Thompson Brooks, Inc. met with
the Tiburon Fire Marshall to survey the site and review the plan for the deconstruction. As a
result, Thompson Brooks, Inc. has adopted several suggestions made by the Fire Marshal,
including the following:
• The use of cutting torches for the removal and installation of structural steel will stop one hour
prior to the daily job closing and the general area where the scope is taking place will be
monitored and inspected prior to departure.
• Fire Department access to the site through the upper and lower entry gates will be achieved
through the use of non case hardened chains and a padlock system. During the deconstruction
phase, the upper and lower entry gates will be unlocked and open during the site hours of
operation.
• A means of constant communication (cell phone) shall be on site during the deconstruction
phase to report emergencies.

All welding activities will include a fire watch. Fire blankets are required to protect any
combustible adjacent areas.
• ABC fire extinguishers will be on site at all times.
Hours of Operation:
• Hours will be limited to times specified by Chapter 13 of the Tiburon Municipal Code:
o Monday — Friday: 7am — 5pm
o Saturday: 9:30am — 4pm
o Sunday & Holidays: No Work Permitted
o Heavy Equipment: Monday — Friday Barn — 5pm
Neighborhood Notifications:
• Prior to the commencement of the project, a Letter of Introduction will be sent to all neighbors.
The Letter will contain contact information for Thompson Brooks, Inc. personnel, hours of
operation, projected duration of overall project, etc.
• Signs will be posted at all entries to the site. These signs will contain all information required
by Chapter 13 of the Tiburon Municipal Code, including the job site address, hours of
operation, name of the General Contractor, emergency contact, and contact information for
pertinent Thompson Brooks, Inc. personnel.
• Prior to the commencement of the Deconstruction phase, the Project Superintendents will
make every effort to introduce themselves in person to neighbors living adjacent to the project
site.
• In the event it is deemed necessary to notify neighbors of upcoming scope (i.e. major events,
large deliveries which could impact traffic, etc.) Thompson Brooks, Inc. will attempt to contact
the neighbors by telephone, email, and /or in person (door to door).
Parking:
• Thompson Brooks, Inc. requires all site personnel to carpool to achieve the goal of an average
of 4 people per vehicle. The only exception may be those trucks and vans that are required on
site to perform scope, and those vehicles should be used for carpooling whenever possible.
Parking for the project will be contained within the site whenever feasible, but street parking
will occur in designated areas only. Designated areas include:
• South of the Lower Driveway, along the property between 110 Gilmartin and the Fire
Road (300 Round Hill). No parking is allowed South of the Fire Road, and definitely not
along the curved section of Gilmartin Drive.
• Area between the Lower and Upper Driveway along Gilmartin Drive. The area
immediately in front of the driveway for 111 Gilmartin Drive will be blocked off to allow
the neighbor easier access in and out of his driveway.
• North of the Upper Driveway, along Gilmartin Drive, until the property line.
• Gilmartin Court, at the first and second turnouts and along the job site side of the road
towards the East property line.
At no time will vehicles be allowed to park on both sides of a street, even if turnouts are
available. For example, parking will be allowed in the turnout on the West side of Gilmartin
Drive, but not on the East side of the street.
Parking will not be allowed in the third turnout on Gilmartin Court. This turnout will be blocked
off and remain available for guests visiting the residents of Gilmartin Court.
Non -heavy equipment vehicles (pickups, cars, motorcycles, scooters, mopeds, priuses, etc.)
may enter and park on the site anytime provided no equipment, lumber, or other building
materials are off - loaded before 7am or after 5pm.
Noise Control:
• Thompson Brooks, Inc. will follow all noise ordinances and guidelines per the Town of Tiburon,
as well as limiting the hours of operation per the requirements specified in Chapter 13 of the
Tiburon Municipal Code.
Street Maintenance:
• Every effort will be made to maintain Gilmartin Drive & Gilmartin Court free and clean of debris
potentially left by incoming and outgoing construction traffic.
Traffic Control:
• Traffic control will be implemented and adhered to throughout all phases of the project.
Thompson Brooks, Inc.'s policy is to have traffic control in place when trucks are entering and
exiting the site. Traffic control will include having 2 lookouts, one at each end of the property
on Gilmartin Drive. The lookouts will wave down oncoming traffic with signs to proceed
cautiously, and /or stop until the road is clear and safe for passage of other vehicles.
• Managed access will be maintained at all times for all local traffic and emergency vehicles.
• Deliveries to the site will only be accepted and scheduled to take place during accepted
construction hours (Monday — Friday: 8am — 5pm), as outlined in Chapter 13 of the Tiburon
Municipal Code.
If it is known in advance that a delivery will significantly restrict traffic on Gilmartin Drive or
Gilmartin court for an unusually long period of time, advance notice will be provided to the
immediate neighbors.

BACKGROUND
There is currently a vacancy on the Tiburon Planning Commission resulting from the
appointment of Councilmember Tollini to the Town Council in November 2013. The Town
Clerk has advertised the vacancy in the Ark and Marin Independent Journal, and has posted
notices at Town Hall and Belvedere- Tiburon Library, pursuant to Town policy.
The Town has received five applications for the opening as a result of advertising. The applicants
will be interviewed at the meeting tonight.
The Town has also received numerous applications for the vacancies on the Marin Commission
on Aging and the Heritage & Arts Commission. Those interviews will commence at the next
meeting. There is also a vacancy on the Parks, Open Space and Trails Commission due to a
resignation earlier this year, and the Tiburon incumbent's term is expiring on the Library Agency
Board in June.
RECOMMENDATION
Staff recommends that the Town Council:
Consider making an appointment to fill the vacancy on the Planning Commission; or
2. Direct staff to continue advertising for the position.

Purpose: The Planning Commission reviews and acts on applications for

Attached is my application and resume for the Tiburon Planning Commission or other assistance you may
need. I recently moved from San Francisco to Tiburon with my family and would love the opportunity to
get more involved in my local community.
For the past twenty-six years, I have practiced law mostly in the San Francisco Bay Area. I am a seasoned
attorney with extensive experience handling land use, administrative law, municipal law, real estate, trial
work, appearances, depositions and arguing motions, but who has also been fortunate to work as a
mediator, as an arbitrator, as an Administrative Law Judge, and as a Judge Pro Tem for the San Francisco
Superior Court.
After graduating from Hastings College of the Law, I practiced complex commercial business litigation for
private firms for four years. During that time, I gained valuable pre- trial, motion, discovery, arbitration and
trial experience. I handled a variety of cases /clients including the State of Alaska, financial institutions,
real estate, businesses, employment, construction, and successfully arbitrated a complex flooring/product
liability case.
During the next five years I learned municipal law at the Vallejo and San Francisco City Attorney's
Offices. I provided advice to City departments, conducted litigation, drafted ordinances, resolutions, and
opinions for the Town Council. I represented the Planning Department and provided advice to the
Commission. I worked on planning, land use, real estate, employment/discrimination, environmental
protection, CEQA, contracts, constitutional law, property, civil rights, public utilities, garbage and civil and
criminal code enforcement, eminent domain, competitive bidding, and other cases/issues. I successfully
mediated a breach of a development and disposition agreement case for the Redevelopment Agency in
which the City had multi- million dollar exposure.
During my work on the San Francisco City Attorney's Code Enforcement Task Force, I worked with
neighborhood organizations, as well as, with the community press in order to strengthen my legal cases by
gathering news articles and declarations from neighborhood residents. 1 then set up my own firm taking on
land use, real estate, administrative law, employment, discrimination, civil rights, environmental, property,
consumer protection, asbestos, and other cases. I also own a construction management and public outreach
company.
I am applying for the Planning Commission due to the fact that I enjoy serving my community, have a great
background in planning, and want to help contribute to the beautiful community of Tiburon that I know we
will all enjoy for many years to come. I have two children, attending the Reed and Bel Aire Schools, and
am active in the PTA, the Rotary Club, and served as President of the League of Women Voters of San
Francisco. I also served as Co -Chair of the Citizens' Advisory Committee on Charter Reform for San
Francisco, and have served on a variety of nonprofit Boards, community organizations and associations.

As a long time resident of Tiburon, I've long noticed that the people who dominate the real estate
market here are more interested In their property value than In the value that property adds to their
life. I'm the latter type of person. I love living in Tiburon because of the closeness to the water and the
feeling that Tiburon is a small town with worldly possibilities. I love raising my kids here and feeling like
I'm giving them the childhood of their dreams. As for volunteering for the planning department or the
Design Review Board, quite simply, I'd like to add my two cents to the decisions being made about what
types of houses are allowed to be built and /or remodeled. I feel like my experience as a parent, a
resident and a business person will add to the board, as well as my belief that people should ideally
build because they NEED something,... not just because they want to become ONE MORE Investor
raising the cost of living in Tiburon. i realize these sentiments are not very popular, but as a middle
child, I've always been known for being fair and for seeing BOTH sides of an argument. I think I'd do a
good job of helping people who really NEED to expand their kitchen, while not necessarily slowing down
those who business relies on them constantly rebuilding the same house. (And hopefully IMPOVING this
house, not just driving up real estate prices!)
APPLICABLE QUALIFICATIONS AND EXPERIENCE
I'm a graduate of the university of Colorado with a Bs in accounting. I actually use this degree as a
payroll agent at my currentjob (of over 18 years!) at Paystar, Inc in MITI Valley, CA. I've also been a
nanny, working as a contractor through RENT -A- PARENT, a downtown Tiburon business. It's through
this job and my soclal life back when there was a restaurant called Mr. Q's on main street, that I've seen
many a home in Tiburon, both with amazing views,... and in my own Belveron neighborhood, without.
In my payroll experience, I've had to work through 3 software changes over the years, and my job
responsibilities have ranged from relatively stress free filing,- to high stress days of transmitting taxes
and calling the IRS, the EDD, _you name it. I think this experience will enable me to handle whatever
stress this volunteer position could possibly produce. It also allows me the perspective to know what
people are talking about in terms of money. I see a lot of salaries and paychecks naturally in my line of
work, and I worry that Tiburon's real estate prices are inflated and geared to the gamblers in our
society, aka the real estate investor. Nothing against Real Estate investing, I know it's the holy grail of
Tiburon's life, .., but I could provide a valuable antidote to the'Property values' v. people's lives debate.
For one, the reason many of our businesses struggled so much during the last economic downtown, in
my humble opinion, is that Tiburon is full of real estate investors, ... and these are not the type of people
who actually spend money at the grocery store or the main street restaurants. A, they're in one of their
3 other houses most of the year, or B, they're overextended, having spent their last dime on their real
estate investment. �-

One last thing, I might mention that I grew up in Ross, and what I remember most about Ross is that
they Insisted on setting all houses 25 feet back from the street, making the neighborhoods more
secluded and the homes seem more isolated. I actually didn't like this as a kid; It was scary to walk the
streets of Ross late at night and I much prefer my own Belveron neighborhood where everyone walks
their dogs around the block, day and night. But Ross had beautiful gardens and didn't allow people to
build a house without a garden, it seems. I really loved that and think that many a Tiburon resident
could benefit from a 'greener' approach. Having said all this, I'm really NOT a tyrant at all*** and am
not looking to tell people what to do with their own hard earned money. But I do feel that I have a solid
background in 'life in marina and that I could add a lot to the planning or the design review boards,

Planning Commission.
I wish to be involved in this community and to contribute from the knowledge and expe-
rience I have gained in my 38 years as a builder and developer of attractive real estate
projects. Since I last appeared before you as an applicant for the Design Review Board
I have participated in the following:
I worked with the Tiburon Open Space Committee generating relevant information on
the struggle with the Martha Property doing the following:
• Researched and quantified square footage amounts of roads and retaining walls
• Quantified number of cubic yards and costs of earthwork required for the proposed
landslide remediations
• Calculated quantity of large truck, light truck, and vehicle trips that would travel on
Paradise Drive during the infrastructure construction and home buildout.
• Attended a couple of meetings with outside important entities.
• Spoke in front of the Marin Board of Supervisors on the above quantities and
turned in a subsequent report. (Copy attached for your interest).
Joined the Board of Directors of the Lyford Cove Old Tiburon Neighborhood Associa-
tion.
• Purchased the home we have been renting on Spanish Trail and have begun making
improvements to it.
• In the last three years I have done maintenance on the actual Spanish Trail walking
path from the end of Spanish Trail Road to the water tower. I have trimmed brush,
placed gravel, and put in planks for bridges over the creek. (The first three of which
were removed by unknown persons).

Here is a summary of the points I made as one of the presenters in front of you on Oc-
tober 22nd that Supervisor Judy Arnold requested I leave with you.
The # of trucks and vehicles a resident standing at the end of her driveway on Paradise
Drive will experience passing by:
The Construction Management Plan states:
Road paving... It is estimated 400 concrete truck trips (i.e.400 in and 400 out)
and 300 base rock truck trips. (700) The vehicles used will be small trucks that carry
about 6 yards of concrete and about 8 yards of base rock/dirt per truck. So in and out =
800 + 600 = 1,400 truck passings
Pg 18 of FEIR states:
It is estimated that site (will generate) 6,499 cu yds of cut material
Assuming 20 cubic yard trucks (This is where they go wrong: No truck capable of
carrying 20 yards will want to go up or down the construction road with a 25% grade)
leaving 2,863 cu yds on site export of 3,636 cu yards.
Or 182 truck loads or generate inbound and outbound 364 truck trips.
However: if we believe the Const Mngmt Plan: and each truck can carry 8 yards
now it is: 454.5 truck trips or 909 truck passings
Sub total truck passings so far on Paradise Dr = 2,309 LARGE trucks passing
Now each house construction in my experience will need a minimum of 25 LARGE
trucks delivering supplies such as concrete, lumber, steel, drywall, roofing.
43 houses x 25 trucks = 1075 truck trips or 2,150 LARGE truck passings
Total LARGE truck passings on Paradise Dr. = 4,459
During both the infrastructure and building of all the homes
Small trucks and passenger vehicles:
5 -8 vehicles per house per day so:
5 vehicles x 5 days x 50 weeks = 1,250 vehicles or an additional
2,500 vehicle passings on paradise drive or Old Tiburon streets.
