HomeMy WebLinkAboutTC Minutes 2014-05-07TOWN COUNCIL MINUTES CALL TO ORDER Mayor Fredericks called the regular meeting of the Tiburon Town Council to order at 7:33 p.m. on Wednesday, May 7, 2014, in Town Council Chambers, 1505 Tiburon Boulevard, Tiburon, California. ROLL CALL PRESENT: COUNCILMEMBERS: Doyle, Fraser, Fredericks, O'Donnell ABSENT: COUNCILMEMBERS: Tollini PRESENT: EX OFFICIO: Town Manager Curran, Director of Community Development Anderson, Assistant Planner O'Malley, Police Captain Hutton, Town Clerk Crane Iacopi ORAL COMMUNICATIONS Shawna Goldberg, Congregation Kol Shofar, invited everyone to join Marin Organizing Committee leaders at a May 15, 2014 meeting at Congregation Rodef Sholom to focus on the establishment of a permanent homeless shelter (and program entitled "REST "). Ms. Goldberg acknowledged the participation of Marin County elected officials, including Vice Mayor Doyle Councilmember Tollini and Councilmember O'Donnell, in recent meetings. Jayni Allsep, Tiburon resident, invited everyone to an informational meeting for Tiburon Peninsula Village on May 20 at the Belvedere Community Center. She described the benefits of both volunteering and participating in the program that serves Belvedere and Tiburon, as well as Strawberry residents. Warren Niles, Del Mar student, spoke of the morbid effects on marine mammals and the environmental degradation resulting from plastic waste. He asked the Tiburon Council to become "part of the solution" by adopting an ordinance to ban plastic bag use in Tiburon and adding a surcharge for use of paper bags in local businesses. • Annual Heritage Preservation Award -- Phil Casson, 2014 Recipient Town Council Minutes #06 -2014 May 7. 2014 Page 1 Vice Chair Amir presented the award presented in honor of Mr. Cassou's instrumental role in the creation of the Railroad Museum and his 15 years of tireless service as curator and docent. He asked Phil Maslin, current Landmarks' Society President, who had nominated Casson, to say a few words. Mr. Maslin talked about the excitement he felt the first time he visited the museum and noted that Mr. Casson had immediately recruited him to help out which he did, and subsequently joined the docent program. He said the railroad museum surely would not exist without the efforts of Phil Cassou. Vice Chair Amir presented a special plaque with a locomotive mounted to it on a trestle -like platform, and credited Superintendent of Public Works Joel Brewer with building it Casson said that the plaque meant more to him than anyone would know, as he was given the exact model (engine number) Lionel train set when he was two years old. He shared some heartwarming and interesting stories of visitors to the museum from near and far, and asked all the docents in the audience to stand to be acknowledged. Casson said there were more than 80 docents in total and he said his goal was for everyone in town to become a docent. He thanked the Commission for its prestigious award. Mayor Fredericks spoke on behalf of the Council in thanking Mr. Casson, stating that his work at the museum and his meticulous attention to detail indeed keeps the past alive and reminds us of who we are. Fee Waiver Request — Request by Reed Heights - Tiburon Knolls Neighborhood to waive fees associated with removal of Eucalyptus trees on Town property (Town Manager Curran) MOTION: To adopt Consent Calendar Item Nos. 1— 7, as written. Moved: O'Donnell, seconded by Fraser Vote: AYES: Unanimous ABSENT: Tollini Mayor Fredericks asked for the Council's consideration to add an item to the agenda. She said it was a proclamation in honor of the Town's upcoming 50th Anniversary. Town Manager Curran noted that staff just became aware of a print deadline that would preclude putting the item on the next regular agenda. MOTION: To add the proclamation to the agenda as an urgency item. Moved: Fraser, seconded by O'Donnell Vote: AYES: Unanimous ABSENT: Tollini Mayor Fredericks read the proclamation into the record: "Town of Tiburon -PROCLAMATION - On the Occasion of its 50th Anniversary of Incorporation WHEREAS: One hundred and forty years ago, in the year 1874, leaders in the ranching community on the Tiburon Peninsula, in their concern for education, established the first school in the present Town of Tiburon; and WHEREAS: One hundred and thirty years ago, in the year 1884, Point Tiburon, because of its proximity to San Francisco, was chosen as the site of a terminal for trains and ferryboats, from which waterfront settlement grew into a town; and WHEREAS: Fifty years ago, in the year 1964, the people Tiburon felt the need for enhanced governmental services and self - determination, so in a free election voted to incorporate and establish the City of Tiburon; and WHEREAS: Thirty -five years ago, in the year 1979, the City of Tiburon determined it preferred to be known as a Town rather than a city to reinforce and reflect its unique charm and character; WHEREAS: The Town Council of the Town of Tiburon wishes to celebrate fifty years of incorporation and the ensuing progress, improvement, preservation and general advancement in the quality of our community and the way of life it provides. Moved: O'Donnell, seconded by Fraser Vote: AYES: Unanimous ABSENT: Tollini PUBLIC HEARING 55 Monterey Drive — Request to amend the Cypress Hollow Precise Development Plan (PD#45) to create a new secondary building envelope (Community Development Department) Applicant: Silas Edman, Jr. Owners: Sarnia and Derek Robson AP Number: 034 - 395 -03 Assistant Planner O'Malley said the applicants proposed an amendment to the Cypress Hollow Precise Development Plan to create a secondary building envelope on the south side of the property, located at 55 Monterey Drive, to install a swimming pool. O'Malley said the Planning Commission held a public hearing on this application at its April 9, 2014 meeting. She said there was no public comment on the application at the meeting. O'Malley said the Planning Commission raised concerns regarding potential noise impacts from the proposed pool equipment on the adjacent neighbors, but she said the applicant explained that the new equipment would be covered and located within the existing building envelope on the side of the house. O'Malley said the Commission recommended a condition of approval requiring that the pool equipment be located within the pre - existing building envelope on the Town Council Minutes #06 -2014 May 7,1014 Page 4 west side of the house. In sum, she said the Planning Commission found the application to be in conformance with the Cypress Hollow Precise Development Plan and the Tiburon General Plan, and voted 4 -0 to recommend approval of the application to the Town Council with conditions (as described more fully in the exhibits to the written report). Mayor Fredericks asked about the pool size and how it would fit into the envelope. She said it did not leave much room for pool furniture and the like, and she asked staff whether this would result in furniture and people congregating in the private surrounding open space. Ms. O'Malley said that the property sloped fairly steeply below that point and did not lend itself to this use. She said the majority of the furniture would be on an existing deck on the north side of the pool, near the residence. She also said the applicants had stated that they would keep the open space and natural vegetation as it existed now. Councilmember Fraser said that there was adequate screening that would be added on the south side for privacy and that the down slope of the lot would preclude the use of the open space. He said the Planning Commission had reviewed the application thoroughly and had made a good decision. Mayor Fredericks opened the public hearing. There being no public comment, Mayor Fredericks closed the public hearing. MOTION: To adopt the resolution approving the precise plan amendment, as written. WEEKLY DIGESTS Town Council Weekly Digests — April 18 & 25, 2014 Town Council Weekly Digests — May 2, 2014 Councihnember Fraser noted the memo from Director of Community Development Anderson I� concerning the FEMA Coastal Hazard Flood Study in the April 25 Digest. He said he thought it Town Council Minutes 406 -2014 May 7, 2014 Page 5 would be beneficial to both residents and local business owners to understand how the FEMA flood rmaps worked and how that information might affect Tiburon in future. He asked that a l representative be invited to address the Council on this topic. Fraser also noted the memo [from Director Anderson, in the same Digest] regarding the CalTrans proposal to install metering lights at the Highway 101 and Tiburon Boulevard interchange. He said this item was of great interest to Tiburon residents who sit backed up in traffic along Tiburon Boulevard waiting to get on the freeway. He proposed that a CalTrans representative be invited to come to the Council to explain the project, its proposed benefits, and to answer any questions of the Council and residents. Mayor Fredericks said that it might be helpful to wait until the project was a little further along in the planning process so that more details would be available for discussion. She also suggested that someone from the Transportation Authority of Marin might be more knowledgeable about it, or perhaps the Metropolitan Transportation Commission (under whose auspices the project would be funded). Vice Mayor Doyle said the traffic back -up on Tiburon Boulevard was indeed an issue. Mayor said she concurred with her colleagues about scheduling the presentations.
