The rate increase proposal also includes a new optional commercial composing service. Managing Partner, Jim Iavarone, was present and provided an overview of the rate increase proposal and answered questions. The matter was continued to the regular meeting of June 18, 2014 to a public hearing on the general rate increase and new services. ANALYSIS As indicated in the June 4, 2014 Staff Report, MVRS must change the way they currently collect refuse as the carry cans used by their drivers are no longer being produced. This change will require their employees to take more time to collect garbage that is not placed at the curb. In the past rate payers who placed their cans at the curb were somewhat subsidizing those who had backyard service, as everyone paid the same rate. MVRS's proposal would now require those with On- Premise and On- Premise Plus service to pay an additional fee, thereby eliminating the subsidy of curbside service rate payers. At the Council meeting, discussion ensued regarding appropriate documentation of disability for exemption of rates for the new On- Premise service. There was also discussion whether a disabled owner of record or lessee, even if there others in the household who were able bodied, should be eligible for the exemption. MVRS had proposed that any physical disability exemption would require certification by a physician. After discussion with Staff, MVRS has indicated a willingness to accept a copy of a DMV handicapped plaquard in lieu of a doctor's certification. MVRS has also indicated that after the public hearing on the matter in Belvedere, they (MVRS) are going to have to broaden their exemption form to also include seniors over a certain age, and have suggested age 70. Attached, as Exhibit 3, is their revised Request for Curbside Exemption, which includes residents 70 or older, and those who are physically disabled. MVRS will accept either a doctor's Town Connell \leering June 15, 2014 certification of disability or proof of possession of a current California Disability Placard. Jim Iavarone will address the exemption definition and certification form at the Council meeting. Any exemption would require the resident to certify that there is no other person in the household able to place the garbage can at the curb -side. To qualify for the physical disability or age exemption, garbage would have to be placed on the property consistent with the definition of On- Premise service (can is visible form the street, no more than 25' from curb and no steps allowed unless in an MVRS- designated area). MVRS will work with all those who qualify under the exemption definition on an acceptable location on the resident's property for pick -up placement. A copy of the June 4, 2014 Staff report and exhibits are attached as an exhibit to this report. FINANCIAL IMPACT The Town of Tiburon receives a franchise fee of 15.5% of the revenue generated in Tiburon by MVRS. The rate increase, as well as the additional revenue anticipated from the On- Premise service is expected to generate approximately $7,200 in additional Franchise Fees. RECOMMENDATION Staff recommends that the Town Council: 1. Conduct a public hearing on the rate increase and service changes, and 2. Adopt the exhibit resolution approving the proposed rate structure Exhibits: 1. Report dated June 4, 2014 and accompanying exhibits 2. Draft Resolution approving MVRS Rate Increase for 2014 3. MVRS has submitted a Collection Rate Application that seeks approval for a rate adjustment of 2.45% from July 1, 2014 through June 30, 2015 and to establish rates for Curbside Service, On- Premise Service and On- Premise Plus Service, In the past, MVRS did not charge for these services, which staff will describe in more detail later in this staff report. MVRS is also requesting to offer additional food composing services to commercial food services businesses, such as restaurants and supermarkets. This matter is agendized to allow MVRS to describe the proposal and to answer any questions of Council or the public. Jim Iavarone, MVRS Managing Partner, will be present at the Council meeting to make the presentation. The matter would then return on the June 18, 2014 Council meeting agenda for public hearing and adoption of the rate increase and new services, as may be amended. ANALYSIS General Rate Increase Application The Franchise Agreement set rates for the 2011/2012 fiscal year and outlines the process for future rate adjustments. In 2012 and 2013, MVRS requested and received rate increases that did not exceed the CPI; the agreement allows MVRS to increase rates for two consecutive years without Council approval, provided that the requested increases do not exceed the CPI (up to a 3% cap). We are now in the third year, thus any rate change requires MVRS to submit a base rate change application for Council review. Staff notes that this year's requested 2.45% increase exceeds the 2.2 CPI, so would have required Council review in any case. The Franchise Agreement provides that rates shall be set to give MVRS a "fair rate of return," a phrase deliberately left undefined to reflect the possibility of changing standards. The parties Town Council Niccting .June 4, 2014 agreed that rates that allow MVRS to recoup a ten percent return on Allowable Costs plus all Pass - Through Costs allow a reasonable rate of return.' However, the Agreement expressly allows the Town to apply a different formula that would result in a lesser rate of return. If the Council allows the requested increase, MVRS projects their rate of return will be 8.9% in FY 2014 -15. MVRS states the reason for the requested increase is due primarily to financing 14 new trucks to meet California diesel engine emission rules, and a substantial increase in workers' compensation insurance expense due to recent claims history. New Backyard Service Charge Approximately two years ago, MVRS advised those agencies to which it provides service that the carry -cans their drivers use to go into backyards to collect trash were no longer going to be mass produced. MVRS purchased a large supply from the vendor and that supply is now running out. Without these carry -cans, MVRS must change the way it collects trash cans in off street locations and wishes to establish different rates for Curbside, On- Premise, and On- Premise Plus services. This proposal includes an exemption to On- Premise rates for those who qualify due to physical disability. The exemption does not apply to On- Premise Plus service. MVRS analyzed the time it took to collect trash from cans left at curbside vs. in backyards and determined that on an average work day, it takes nearly as long to pick up cans for the 31 % in off - street locations as it does for the 69% left at the curb. They concluded that current rates reflect conditions of the majority of households where cans are left curbside and that an additional charge should be established for those accounts that wish to retain one - premise collection. The following outlines the three levels of service a resident may select: 1. Curbside Service — would be defined as cans one to five feet from the curb (or in an MVRS designated location beyond five feet if there is not suitable flat area at the curb). 2. On- Premise Service — would be defined as cans visible from the street, six to 25 feet from the curb, and accessible to a wheeled cart (no steps allowed unless in a MVRS designated location). 3. On- Premise Plus Service — would be defined as cans beyond 25 feet, not visible from the street, up or down any number of stairs, or not in a location accessible to a wheeled cart. The rate for curbside service would be charged to all customers. On- Premise Service would be charged an additional $5 /can per month and On- Premise Plus Service would be charged an additional $15 /can per month. The proposed 2.45% rate increase will take effect for all customers on July 1, 2014. The new On- Premise and On- Premise Plus service rates will take effect on October 1, 2014, which will be on an opt -in basis. MVRS will conduct outreach in their July 2014 billing and a newsletter advising of the new service and that garbage will not be collected after October 1, 2104 from the "backyard" unless the resident has opted -in. ' This formula is known as the "Operating Margin of Profit. Under this method, the rates would equal 110% of Allowable Costs plus Pass - Through Costs. TowN OFTIB[ IRON Page 2 of 3 Toy ii Council Mectin, unc 4. 2014 Tiburon Municipal Code Section 26 -6 requires that solid waste receptacles be maintained in a manner that they are not visible from the public street (except on collection day). One consequence of the proposed On- Premise and On- Premise Plus service may be that residents will opt for the curbside pickup and may want to build an enclosure to maintain their cans closer to the street. A permanent enclosure that is more than 3 -1/2 feet in height would require design review and a building permit. New Commercial Composting Charge MVRS is also proposing to offer a new commercial food composing rate structure. Since implementing composing service three years ago, businesses such as restaurants, delis and supermarkets, have not been allowed to participate fully due to landfill restrictions. Redwood Landfill has been granted permits to accept additional food waste and MVRS would like to make additional services available on a volunteer basis. Currently food establishments are provided 2- 32 gallon compost cans with regular service, and these cans are picked up the same number of days as regular garbage service. However, some restaurants or food establishments may need more than two cans or need daily compost pickup service. If a commercial food establishment desires extra compost cans or requires service on extra days, MVRS has proposed a new rate of $14.33 per month per additional can or for each additional pickup day. These businesses may be able to reduce their regular garbage service costs by migrating more food waste to the compost can. FINANCIAL IMPACT The Town of Tiburon receives a franchise fee of 15.5% of the revenue generated in Tiburon by MVRS. The rate increase, as well as the additional revenue anticipated from the On- Premise Service, is expected to generate approximately $7,200 in additional Franchise Fees. RECOMMENDATION Staff recommends that the Town Council: 1. Receive a presentation from the representatives of Mill Valley Refuse Service on the proposed rate increase and new services; 2. Take public testimony on the proposal; 3. Direct staff to bring back the appropriate documentation to implement an increase and service additions at the June 18, 2014 regular Council meeting as proposed or amended. C(1SUluU U U L Rc%1%L'oo k Curbside Service and On- Premise Service Rate Proposal Two years ago, Mill Valley Refuse Service (MVRS) learned that the carry-cans its drivers use to perform backyard trash service were no longer going to be mass manufactured. Without these carry-cans, MVRS must change the way it collects trash cans in off - street locations, and a new rate should be established that accounts for the higher cost of collecting trash cans not placed at the curb. Background Historically, refuse hauling companies routinely offered "backyard" service (now more commonly referred to as On- Premise Service) to all its customers. To provide on- premise service, a driver walks from his truck with an aluminum carry-can (in the old days he used a burlap sack) onto a resident's property, dumps the contents of the resident's trash into the carry-can, and carries the trash backto the truck. Over the years, on- premise service has largely been replaced by curbside service as haulers moved to more efficient automated and semi - automated collection trucks. With curbside service, the resident brings his trash can to the curb on collection day, making it unnecessaryforthe driverto spend time going onto the resident's property. Modern trash collection programs have turned to using automated, curbside collection methods to control costs. MVRS has traditionally provided on- premise service fortrash collection, but only curbside service for recycling and compost collection. MVRS was one of the last companies to use carry-cans, and the market for them dwindled so much thatthe manufacturer stopped making them. We bought a large supply of these cans when we heard this news, and now our supply is running out. Without carry -cans, MVRS will have to make curbside service its standard form of service, and change the way it provides on- premise service. Also, an On- Premise Service Rate should be created so that customers who bring their cans to the curb are not made to subsidize the extra labor costs of on- premise collection. Extra Labor Costs? MVRS performed some time trials and learned that cans in some typical off- street locations took as much as two to five minutes to collect. Curbside cans, on the other hand, took an average of just 43 seconds to collect (see Table 1). MVRS also had its drivers use hand counters to tally the number of trash cans people were currently bringing out to their curbs, versus those that were left in off - street locations. We learned that roughly 69% of residences either bring their cans to the curb now, or have their cans located so close to the street that it would be no problem to bring them out to the curb (see Table 2). What we learn from the results of these two studies is that, on an average work day, it takes nearly as long to pick up cans for the 31% in off - street locations as it does for the 69% at the curb. Why a New On- Premise Rate? An obvious question one might now ask is: If the current rates cover going into backyards now, shouldn't those rates be for on- premise service, and the curbside rates be something lower? The answer is not so simple because, strictly speaking, the current rates are not really on- premise rates. Instead, they reflect the true conditions on the street where 69% of our customers already bring their cans out to the curb, or have their cans located very near to the curb, while only 31% are in actual backyard locations. Over the years, we have consolidated trash routes not only because there is less trash due to increased recycling, but also because of the reduced amount of time it takes for our drivers to pick up trash cans from their true locations. As our rates have changed over the years, they have become closer to being curbside rates than they are to being on- premise rates. MVRS will continue to monitor routes and make manpower adjustments as necessary over time. Rates will reflect true costs depending on how many residences choose to pay for on- premise service. Moving to Curbside Service MVRS does not see any contractual obstacle to requiring its customers to bring trash cans to the curb right now. Contract language usually refers to trash cans being placed in a location "mutually agreeable" to MVRS and the customer. Without carry-cans, the number of mutually agreeable locations on any given property naturally becomes more limited. However, MVRS wants to accommodate those who wish to retain some sort of on- premise service or have physical disabilities that prevent them from bringing their cans to the curb. To learn how to do this best, MVRS surveyed hauling companies in Marin and the Greater Bay Area to see what collection methods were most commonly employed. The results of that survey (see Appendix 1) show that curbside service is the predominately standard method used to collect trash. In most areas, on- premise service remains an option for the customer who is willing to pay premium rates. On- premise rates vary considerably and increase in increments the further away a can is located from the curb. A common requirement is that cans not placed at the curb must still be placed in locations that are visible from the street. Some companies supply trash carts with wheels to customers who want on- premise service so that drivers can walk onto the resident's property and wheel the trash cart to the truck. Usually, the empty cart is left at the curb. Other companies require the resident to supply their own trash can, and the driver wheels a cart to the can, empties it into the cart, and then wheels the cart back to the truck to be dumped. Note that in both instances, trash cans must be located in spots that are easily accessible to wheeled carts. No obstructions such as steps, dirt pathways, or narrow side alleys are permitted. MVRS favors the method of requiring that trash cans in "on- premise" locations be visible from the street and accessible to a cart with wheels. We have no plans at this time to purchase and distribute new trash carts similar to the ones used for recycling and green waste. We preferto initiate this program by having residents continue to use the trash cans they already own. This will prevent the waste of perfectly good cans, and eliminate the need to purchase and distribute new trash carts, the costs of which would have to be passed through in the rates. However, we concede that the switch to standard rolling carts may be inevitable if there is a public demand for them. Implementation of, and Exemptions to, New On- Premise Rates Upon approval of new On- Premise Rates, MVRS proposes to notify customers by mail of the new rate and the reasons for it, and provide three months forthose who want to continue on- premise serviceto sign up for that service. (We would automatically charge everyone the curbside rate, so that only those who call to subscribe to on- premise service would begin to be charged for it on October 1, 2014.) It is unknown how many individuals would seek exemptions from the on- premise rate due to physical disabilities. Exemption terms and examples of exemption forms used by other companies in the Bay Area are shown in Appendix 2. MVRS has based its Exemption Form (see page 8 of Appendix 2) on ones used by these other companies, which we would provide upon request and require to be renewed annually. Completed forms will be kept on file. Program Details The devil is always in the details. Our general proposal to implement curbside trash service with new, optional On- Premise Rates would include the following details; 1. Curbside Service would be defined as cans one to five feet from the curb (or in an MVRS- designated location beyond five feet if there is no suitable flat area at the curb). 2. On- Premise Service would be defined as cans visible from the street, six to 25 feet from the curb, and accessible to a wheeled cart (no steps allowed unless in anMVRS- designated location). Any allowed Physical Disability Exemptions would be handled this way only. 3. On- Premise Plus Service would be defined as cans beyond 25 feet, not visible from the street, up or down any number of stairs, or not in a location accessible to a wheeled cart. Curbside Service would be charged at currently approved rates. On- Premise Service would be charged $5.00 per can per month on top of currently approved rates. Our time trials showed that on- premise cans can take as much as 3 -5 times longer to collect than cans at the curb. In,a cost analysis (see Table 3), we estimated taking an average of only twice as long to pick up an on- premise can as a curbside can, and found that the added charge forthis service could be as high as $9.38 per cans However, we feel the $5.00 charge we propose is more in line with the industry standard. The On- Premise Plus Service rate would be $15 per can per month on top of currently approved rates due to the extreme difficulty of having to hand -carry cans or bags long distances and /or up and down steps. Cans with handles in 20, 32 or 45 gallon sizes would continue to be allowed, and could weigh no more than 60 pounds. Empty cans would be left at the curb unless the customer agreed to pay 2X the carry-out rate to return them. Of course, the proposed on- premise service rates have to be approved by each jurisdiction before taking effect. We have added these rates on the Terms & Conditions pages of the 2014 -2015 Rate Sheet. Conclusion While this may seem like a significant development, keep in mind that residents already bring recycling and compost carts to the curb, so this would just add the trash can to that weekly chore. Curbside service has become the industry standard in other communities as a means to hold down costs by increasing efficiency, and there is every reason to believe that a curbside program will be accepted in our communities as well. Where "backyard" service is permitted for recycling and compost carts, usually the carts must be in a location visible from the street and accessible for easy roll out to the truck. (In some cases, even trash carts must be visible from the street to qualify for backyard service.) Only In a very few instances does the backyard rate include returning the cart from the street back to its original location. Backyard or "distance" charges are all per can per month. Senior and disabled exemptions from backyard service charges are fairly common (see examples from several companies in Appendix 2). However, in such cases, a form must be filled out, with a signed statement saying that no one living in the house is capable of bringing cans to the curb. A doctor's note must be included in the case of a physical disability. Some companies require that the exemption request be renewed annually, while others simply cancel the exemption when a change of service request is made for the residence. Marin Sanitary www.marinsanitary.com • Distance service is for trash collection only (except in San Anselmo where a resident can pay extra for recycling and composts carts as well). • Distance charges shown are per cart. • Where no flat spot to put carts exists at the street, MS will visit the site and designate a spot up the driveway where carts may be placed and still receive curbside rates. • Company determines the type of distance collection service provided based on ease and speed of collection (i.e. it may determine that some especially long driveways must be serviced by a small collection vehicle rather than having a driver walk -out carts from the street.) Tamalpais Community Service District (TCSD) www.tcsd.us/ , • No formal backyard service offered. • Accordingto a customer service representative, an elderly resident could be allowed to put carts in front of their house or garage, but not far from the street or in a backyard location. Bay Cities Refuse www.ci.sausailto.ca.us • Backyard service offered fortrash collection only. Recycling and compost carts are collected curbside. Novato Disposal http://unicycler.com/residential/marin/novato In response to our questions through UveChat on the Novato website, a service representative wrote: "In Novato we do provide what we call "walk -in service." The cost for thatservlce is $5.25 per 50 feet. We might be able to provide it for free if there is a medical note stating the reason. Their personal note is also required stating that no one else is living in the house that could bring the cans to the curb." City of Berkeley www.co.berkeley.ca.us/zerowast e • Backyard service offered for trash only, and customers must provide their own 32 or 45 gallon trash can. • In cases where backyard service is requested, the can must still be visible from the street. • The cost for backyard service is DOUBLE whateverthe current curbside rate is. • The exemption process is spelled out in Berkeley's municipal code (form and code language are included in Appendix 2). Republic Services www.republicservices.com/s'ite/richmond • Republic offers what it calls "Carry -Out Service" for trash, recycling and compost carts. • Each cart is charged $7.19 per month, and there is a distance limit of 100' from the curb. • A customer service representative said requests to pick up carts further than 100' from the curb require a route supervisor to check out the site first, and that "additional charges would apply." • On page 6 of the company's FAQ sheet (Appendix 2) it states that exemptions require a "doctor's certificate documenting disability..." Greenwaste Recovery www.greenwaste.com • Procedures and costs vary between the many communities Greenwaste serves. • "On- Premise Collection" is available in San Jose ata huge cost ($60 /month more than curbside rates). An application form showing prices is included in this report. • Los Altos Hills has a base rate from curbside to 100', then prices rise at 100' increments (ranging from about 36% above base to 108% for cans as far away as 500'). • Palo Alto provides carts for curbside service only. Backyard service is offered by subscription, fortrash only, in 32- gallon cans only, and costs $3.35 /residence. • Portola Valley and Woodside customers provide theirown trash cans. The base, curbside rate is from 0 -10', then rises from 10' -25, 25' -100', and in 100' increments thereafter (see rate sheets provided in this report). • Waivers must be renewed annually, and require a doctor's note plus a signed statement from the resident stating that no able- bodied person lives in the house. Recology http://www.recologysf.com • In San Francisco, there are extra charges for both distance and elevation from the curb. • Extra charges are per cart per month. • On the following two pages are a page from the current rate sheet showing distance and elevation fees, plus an actual bill showing the fees being applied. • Recology's disabled service policy requires a signed statement by customers "certifying that (1) they are physically unable to place carts at the curb and (2) there are no able- bodied persons living in their residence." (Policy language shown in Appendix 2.) • Even with an exemption, the policy states that "every effort must be made by customer to place carts in a location as accessible as possible for collection by Company." 2013-04-08 13:52 necowyy 05%mrje;>> P 1/6 Schedule A Residential and Apartment Refuse Rates Effective July 1, 2013 Description of Monthly Chargo Charge Rates for 1-5 Unit Residential Buildings - Basectlar efor service Per dwellln unit $5.00 7Tmah Collection Volume cha for Weekl Collection 20- gallon bin $15.54 32-tiallon bin $24.86 Recycling Collection volume Charge for Weekly CelleeRon 32- gallon bin $2.00 on Collection Volume charge for Vloakly Collection 32- gallon bin 32.00 Low Income Discounts Households with Income less than or equal to 150% of the poverty level may qualify for 25% base and volume discounts. This rate would be for a new food waste collection service we would like to offer to restaurants, supermarkets and other food - related businesses in Tiburon. Since food waste composting service began almost three years ago, businesses such as restaurants, deli's and supermarkets, have not been allowed to participate fully because the compost permit at the landfill restricted the amount of food waste that could be mixed with yard waste for composting. We now have been informed by representatives at the Redwood Landfill that they expect to be granted permits to accept commercial food waste in the very near future, and so we want to be able to offer this option to our commercial customers in the food industry. In a couple of pilot programs conducted this past year, we learned that most restaurants really need food waste carts to be dumped daily, rather than on a weekly basis as is the case with residential food waste. Right now, trash service includes picking up unlimited recycling and one compost cart, and a business that subscribes to trash service multiple days per week will have its compost carts picked up the same amount of days at no extra charge. However, some restaurants may need more than one compost cart, and few restaurants require daily trash service, so if a restaurant needs extra carts or compost service on extra days, a new rate must be created for this additional senxice. A revised Commercial Miscellaneous Terms and Conditions sheet that shows the pricing for this new service is included with this letter. These revised Terns would replace the existing ones on the cturently approved Rate Sheet. This rate is optional, and would only affect those businesses that subscribe to it. Businesses that use this option may be able to reduce their trash service and achieve some overall savings as their food waste "migrates" from their trash cans to their compost carts. Of course, participation in this program will also help to meet State and County zero waste goals by diverting more and more waste fi-om our landfills. Per conversations with the Town attorney a few months ago, it was determined that the best way to proceed was for MVRS to request that the Town consider the merits of this new service, and 112 Front Street • Son Rafael, CA 94901 • 415- 457 -9760 • Fox. 415 -457 -3003 • www.mi1kalleyrefuse.CDm WASTE COLLECT16N • DEBRIS BOXES PORTABLE RESTROOMS • RECYCLING direct its to offer it to our commercial customers per the procedure described in Section 4.0 of our contract. MVRS provides one (1) compost can and one (1) recycling can per customer. Extra recycling cans are available for $6.00 per can per month. Extra compost cans are available for $12.00 per can per month. Single Residence Curbside and On- Premise Service Rates Curbside Service is defined as the can being placed within five (5) feet of, and at the same level as, the curb or side of the principle street. Charges for this service equal the applicable amount for size and number of cans on the currently approved Rate Sheet. On- Premise Service is defined as the can being visible from the street, six to 25 feet from the curb, and accessible to a wheeled cart (no steps allowed unless in an MVRS- approved location). Charges for this service equal the applicable amount for size and number of cans on the currently approved Rate Sheet plus $5.00 per can per month. Empty cans will be left at the curb unless the customer agrees to pay 2X the carryout rate to return them. On- Premise Plus Service is defined as cans beyond 25 feet from the curb, or not visible from the street, or up or down any number of stairs, or not in a location accessible to a wheeled cart. Charges for this service equal the applicable amount for size and number of cans on the currently approved Rate Sheet plus $15.00 per can per month. Empty cans will be left at the curb unless the customer agrees to pay 2X the carryout rate to return them. Disability Exemption from On- Premise Service Rate. Individuals who cannot bring cans to the curb due to disability may fill out a Request far Disability Service form, which is available from our office or may be downloaded from our website (www.millvalleyrefuse.com). Some restrictions on can placement apply, and a doctor's certification of disability is required along with the completed form. On- Premise Service is also available for recycling and compost cans for an additional $5.00 per can per month. Empty cans will be left at the curb unless the customer agrees to pay 2X the carryout rate to return them. On- Premise Plus Service is NOT available for recycling and compost cans. Additional Quantities of Cans Service for additional cans over the quantities listed on the rate sheet will be charged a multiple of the single can, one -time- per -week pick up rate (i.e. five 32- gallon cans are charged the four -can rate plus the one -can rate). Low Income Rate A 20% discount off the applicable residential rate is available to residential Single - Family customers who have already qualified for the PG &E CARE/FERA Program. A copy of the customer's PG &E bill showing the qualified CARE/FERA Program is required for the discount. To maintain the discounted rate, customers must submit a new PG &E bill annually showing the CARE/FERA discount. Apartment/Multi -Unit Residential (A/MUR) Rates A/MUR complexes are defined as multi -unit residential housing with four or more units all paid for by the property owner. A/MUR complexes are charged a minimum of one 32- gallon can per unit per trip at the applicable once - per -week Apartment Rate as shown on the current, approved rate sheet. Additional 32- gallon cans over the minimum will be charged at the additional applicable per -can rate. In cases where 45- gallon cans or I -yard and 2 -yard containers are used instead of, or in addition to, 32- gallon cans, the following equivalency formulas will be applied to determine whether additional 32- gallon cans (over the minimum set forth immediately above) shall be charged at that location: • Each 45- gallon can will be considered to hold one -and- one -half 32- gallon cans. • Each 1 -yard container will be considered to hold seven 32- gallon cans, and each 2 -yard container will be considered to hold fourteen 32 -gallon cans. (If 1-yard or 2-yard containers supplied by MVRS are used, standard commercial container rental rates will be charged in addition to the applicable apartment rate). If the foregoing equivalency formulas result in a higher number of 32- gallon cans than the minimum of one per unit, the applicable once- per -week rate shall be applied to such higher number of 32- gallon cans. If the result is a lower number of 32- gallon cans, then the minimum one - can - per -unit charge set forth above shall be applied (unless composting services are being used). Exception to the one -can- per -unit minimum for participation in food waste composting: A/MUR complexes that actively participate* in food waste composting will be charged a rate reflecting the actual amount of garbage collection requested, measured in 32- gallon equivalents and applied on a per -trip basis at the applicable 32- gallon, once - per -week rate as shown on the current, approved rate sheet. *To qual i) as an Active Participant in food waste composting, the AIMUR complex owner or property manager must request delivery ofkitchen countertop food waste collection pails (available FREEfrom MVRS) and distribute the pails to each unit in the complex. The AIMUR complex must also have outdoor compost carts (also provided by MVRS) available for tenants to empty the contents oftheir kitchen pails into for weekly pickup. To request free kitchen pails, complete with directions for their use, call our office at 457 -9760. MVRS will deliver one pail per unit. Additional pails are available for $6.00 per pail (after initial free delivery of one pail per unit). MVRS will provide A/MUR complexes with up to one recycle can and one compost can per unit at no extra charge. Extra cans are available at $6.00 per month per can. Multiple trips in a week to a single location will be charged a multiple of the applicable once - per -week rate Apartment/Multi -Unit Residential Curbside and On- Premise Service Rates The same definitions and charges for Curbside, On- Premise and On- Premise Plus Services, as described above, apply for A/MUR complexes. HOWEVER, if our service trucks are able to drive right up to trash enclosures on a complex's property, and trash containers are within five (5) feet of where the truck is parked, MVRS will charge the same as if the cans were at Curbside. MVRS provides one (1) compost can and one (1) recycling can per customer. Extra recycling cans are available for $6.00 per can per month. Extra compost cans are available for $12.00 per can per month. Single Residence Curbside and On- Premise Service Rates Curbside Service is defined as the can being placed within five (5) feet of, and at same level as, the curb or side of the principle street. Individuals who cannot bring cans to the curb due to disability may fill out a Request for Disability Service form, which is available from our office or may be downloaded from our website (www.millvallevrefuse.com). Additional Quantities of Cans Service for additional cans over the quantities listed on the rate sheet will be charged a multiple of the single can, one - time -per -week pick up rate (i.e. five 32- gallon cans are charged the four-can rate plus the one -can rate). - Apartment/Multi -Unit Residential (A/MUR) Rates A/MUR complexes are defined as multi -unit residential housing with four or more units all paid for by the property owner. A/MUR complexes are charged a minimum of one 32- gallon can per unit per trip at the applicable once - per -week Apartment Rate as shown on the current, approved rate sheet. Additional 32- gallon cans over the minimum will be charged at the additional applicable per -can rate. In cases where 45- gallon cans or 1 -yard and 2 -yard containers are used instead of, or in addition to, 32- gallon cans, the following equivalency formulas will be applied to determine whether additional 32- gallon cans (over the minimum set forth immediately above) shall be charged at that location: • Each 45- gallon can will be considered to hold one -and- one -half 32- gallon cans. • Each 1 -yard container will be considered to hold seven 32 -gallon cans, and each 2 -yard container will be considered to hold fourteen 32- gallon cans. (if 1-yard or 2-yard containers supplied by MVRS are used, standard commercial container rental rates will be charged in addition to the applicable apartment rate). If the foregoing equivalency formulas result in a higher number of 32- gallon cans than the minimum of one per unit, the applicable once- per -week rate shall be applied to such higher number of 32 -gallon cans. If the result is a lower number of 32- gallon cans, then the minimum one -can- per -unit charge set forth above shall be applied (unless composting services are being used). Exception to the one -can- per -unit minimum for participation in food waste composting: A/MUR complexes that actively participate* in food waste composting will be charged a rate reflecting the actual amount of garbage collection requested, measured in 32- gallon equivalents and applied on a per -trip basis at the applicable 32- gallon, once- per -week rate as shown on the current, approved rate sheet. *To qualify as an Active Participant in food waste composting, the A/MUR complex owner or property manager must request delivery of kitchen countertop food waste collection pails (available FREEfrom MVRS) and distribute the pails to each unit in the complex. The A/MUR complex must also have outdoor compost carts (also provided by MVRS) available for tenants to empty the contents of their kitchen pails into for weekly pickup. Miscellaneous and Extra Charges 32- gallon extra trash can/bag: $ 8.00. 45- gallon extra trash can/bag: $10.00. 32- gallon extra yard waste can/bag: $6.00 Special pickup of recycling or compost can contaminated with improper materials: $25.00. This can be accomplished - whether or not the Town approves the 2.64% rate increase MVRS has requested effective 7/1/14, and also whether or not any additional fees for service for "away from curbside" services are approved - by changing the STRUCTURE of the way rates are charged to encourage minimum waste being sent to Landfills by (financially) encouraging that the maximum is being; composted and rep cy led. This can be accomplished by requesting MVRS to revise their 7/1/14 Residential Rate Increase request to: 1) Include zero charge for one or multiple Recycle Bins. 2) Include zero charge for one or multiple Compost Bins. 3) Include 6 and 10 gallon options to the current 20/32 options. (Locking lid cans are available @ Goodman's, OSH, Home Depot) 4) Set their 6, 10, 20, and 32 gallon can rates to reflect total costs BUT ALSO appropriately reflect that a 20 gallon can "dumps" 37.5% less trash into a landfill (and a 10 gallon can "dumps" almost 70% less trash into a landfill) than a 32 gallon can does. If structured appropriately, this change will move us closer to a Zero Waste Goal by greatly encouraging composting and recycling, while charging overall trash hauling expenses most appropriately for those wastes that must still go to the Landfill. Mayor Fredericks and Councilmembers: I understand Mill Valley Refuse is requesting an additional two rate increases at the June 18th Town Council hearing. I am enclosing two letters which we sent to Mill Valley Refuse last year related to our struggles to get Mill Valley Refuse to comply with mandatory start times for trash pickup. Immediately after we moved in to our home in May 2012, we noticed that the garbage and recycling trucks arrived to empty our garbage and recycling cans at an extremely early hour in the morning. During this time, trucks began arriving and picking up trash and/or recycling as early as 5:20am, even though the earliest official start time is 6am. (In my opinion, even 6am is too early, as construction does not begin until lam which can be equally disruptive.) We made numerous attempts to get Mill Valley Refuse to adjust its route schedule and we faced consistent pushback, delays and unwillingness to make any accommodations. We were extremely frustrated by the early pickups and for a long time, it appeared MV Refuse was not going to do anything about it. Finally, after many months, there was apparently an adjustment to their route and the drivers stopped showing up before 6am. As I recall, I believe MV Reuse requested and received a rate increase just a few years ago. Before the Council authorizes an additional rate increase, I ask that the Council retain authority to oversee MV Refuse and ensure some greater degree of accountability. Thank you, II7ii1 John H. We sent a previous letter dated January 1, 2013, and we have not received a response. I also called your office on February 1, 2013 and spoke with your customer service representative Deborah Hudson. She informed me that you would be calling. I did not receive a call. Your Mill Valley Refuse garbage and recycling trucks continue to arrive before the authorized start time of 6am and continue to cause a great amount of noise and disturbance to our very small and closely -built cul de sac. The homes on Pine Terrace are built very close to the street. Our home in particular is very close to the street and near the end of the street Our master bedroom's window is approximately 15 -20 feet from the curb. The trucks always have to back up and turn around at the end of the street as they cannot make the hairpin, 180 degree turn without backing up. As a result, we hear the truck's beeping backup noise in addition to the sound of trash cans being unloaded and the trash compactors. This is extremely disruptive to our sleep at 5:15 -6am, which is when our recycling is picked up, especially since we have a young son who is woken by the noise and does not go back to sleep. We are making a second request that you change the route so that we will not be further disturbed by these disruptive trucks every Friday morning. It appears the garbage truck changed its route, but the recycling truck comes immediately at 6am or shortly before, around 5:50am. This past Friday, May 31s, the recycling truck arrived at 5 :35am. As long as there is one truck coming that early, it wakes us up. If one of the trucks can change its route, then the other truck certainly can as well. When my wife called your office and spoke with a manager a number of months ago, she was informed that the trucks could not change their routes because our street is on the south side of Tiburon Blvd, and the trucks could not make a left - hand turn in to Pine Terrace, as would be required if they picked up trash and recycling later in their routes. The intersection of Pine Terrace and Tiburon Boulevard has a signal, a dedicated left -hand turn lane and a dedicated left turn arrow in to Pine Terrace for vehicles traveling westbound on Tiburon Boulevard. This allows the trucks to quickly and easily enter and exit Pine Terrace after the pick up if they do their pick up's at the end of their routes rather than the beginning. It is apparent that the left - hand turn in to Pine Terrace has not been a barrier for at least one of the trucks which has redesigned its route. Now we simply request that I trucks change their routes to pick up trash, recycling and green waste later in the morning. I understand that 6am is the earliest Mill Valley Refuse is authorized to arrive to pick up trash. However, I believe it was implicit in Mill Valley Refuse's recent new contract with the Town of Tiburon to pick up trash for the entire town that you would have a responsibility to use some flexibility in serving the residents. A "one size fits all" approach is not appropriate here. Most homes in Tiburon are located 40 -50 feet from the curb where a 6am pickup would not be a problem. Pine Terrace is one of the few densely built streets where homes are very close to the street and such an early pickup is very disturbing. Altering one truck's route is not such a great imposition that it outweighs the courtesy it would provide the residents on our street. Please call or e-mail in response to these concerns. Trash and Recycling Pickup on Pine Terrace, Tiburon To whom it May Concern, This letter is regarding a frequent pattern of extremely loud and disrupting pickups by Mill Valley Refuse service trucks on Pine Terrace over the course of the past six months. We moved into our home with our 2- year -old son at 75 Pine Terrace in May of 2012. Our home is located at the end of the cul -de -sac adjacent to a very tight turn. Our trash and recycling pickup is scheduled for Friday mornings. Immediately after we moved in to our home in May, we noticed that the garbage and recycling trucks arrived to empty our garbage and recycling cans at an extremely early hour in the morning. During this time, trucks began arriving and picking up trash and /or recycling as early as 5:20am. The trucks were extremely loud as we were awoken by the sound of trash cans being emptied, and the truck's engine and loud trash compactors. There is often a loud beeping sound as trucks backed up to navigate the tight turn on the cul- de -sac. Our bedroom is located in the front of the house near this tight turn, so we are strongly impacted by the bright lights of the truck and noise. In early October, I finally called Mill Valley Refuse and spoke with a supervisor about the early pickups. The supervisor confirmed that no pick ups were authorized to occur before 6am. He said that he would speak to the drivers to ensure that they would not pick up our trash or recycling before 6am, and that they would turn off their compacting motors, which would reduce, but not eliminate, the noise. I explained that we have a toddler who is woken by the noise and does not go back to sleep after the early morning pick -ups. This leaves the whole family exhausted every Friday. During my conversation with the supervisor, I requested that the route be changed due to the configuration of our tiny street and the early pick -up time. The supervisor agreed to check into this request. Around this time, my husband also contacted Tiburon council member Cnow Mayor) Emmett O'Donnell about this issue. Mayor O'Donnell informed him that trash pickup was restricted to after 6am. We also learned that construction work in Tiburon could not start prior to lam on weekdays and 9:30am on Saturdays. Given how noisy the trash trucks have been, we find it interesting to note that when it comes to construction work, only "quiet work" is allowed on Saturdays, "such that noise from any source ... including but not limited to construction activity, amplified sound, and worker's voices, shall not be plainly audible beyond the property line." Immediately after my conversation with the supervisor, the pick -ups began occurring later than 6am. During October and November, the trucks came later, which was very much appreciated because the garbage pick -ups were at a more reasonable time (lam or later). The recycling pick -ups were still around 6:20am. Within the past few weeks, we have regressed and now the pick -ups are early again. This time I believe it's the recycling truck that is picking up before the 6am start time. For example, on Friday, December 21st, our recycling was picked up at 5:05am. The following week, our pickup was scheduled for a Saturday due to the Christmas holiday. On Saturday, December 29, 2012, we heard a truck idling at the end our street around 5:55am, with the driver apparently waiting for 6am to start his route. The truck was so loud that we could hear and see the truck waiting at the end of our street before the 6am start time. In fact, the special Saturday route should have begun at lam (see Tiburon staff report, Memo from Town Attorney Ann Danforth, dated June 15, 2011, section A.Q. The driver then started his route exactly at 6am. We are pleading with you to change the route so that we are not woken by these disruptive trucks. It appears as though your drivers want to get an early start to their shifts, which is not fair to our family. We are exhausted and angry every time the trucks rumble past our house at 6am, or earlier. Our street configuration is such that the impact of the truck noise and lights is much greater than most other streets in town. Instead of being the irst on the route, could our garbage be picked up last as the trucks are exiting town? We have a left -hand turn lane onto our street off of Tiburon Boulevard, and another left-hand light, which would allow the trucks to quickly and easily exit Pine Terrace after the pick up if they did pick up at the end of their routes.
