A R�SOLUTION OF THE TOWN COUNCIL OF TH� "I'OWN OF TIBURON
� REP�ALING TOWN COUNCIL RI;SOLUTION 42-2018 REGARDING
STANDARDS FOR ACCLSSORY DW�LLING UNITS
WHEREAS, on Decenlber 9, 2019 the Plamling Commission held a duly noticed
��ublic hearing to consider a recommendation to the Town Coiulcil to revise the ordinance for
Accessoly D���ellinb Units and JLmioi• Aceessoi•y Dwelling Unit and to repeal Town Couilcil
Resollltion 42-2018 regarding Accessoiy Dwelling Unit Standards.
WHER�AS, on Deceinber 9, 2019 t11e Planning Coinmission recommended the Town
Co�u�cil approve the proposed Accessory Dwelling Unit and Junior Accessoly Dwelling Uilit
Ordinance with changes and repeal "I'owi� Council Resolution �2-2018 regarding Accessoiy
Dwelliilg Unit Standards.
WHER�AS, on January 15, 2020, the Town Council lield a duly-noticed public
hearin� to co�lsider the Planning Commission's recommendation to revise the ordinance for
Accessoiy D��elling Units and Junioi• Accessory Dwelling Unit and to repeal Town Council
Resolutio�l 42-2018 regarding Accessoiy Dwelling Unit Standards.
WHEREI�S, said revisiar�s to the Town's Accessory Dwelling Unit �nd Junior
Accessoiy Dti�elling tulit ordinance include provisions establishing standards for approval of
accessory dwelling units and junior accessoiy dwelling units, whicl� standards are consistent with
the State laws:
WI��EREAS, foi• this reason, Resolution 42-2018 would be otherwise inconsistent
with the 7�own�s ordinance and should therefore be repealed; �
WI�EREAS, on Februaly 19, 2020, a Resolution i•epealing Town Cotancil Resolution
42-2018 regaz�ding Accessory I)welling Unit Standards was considered and adopted by the Town
Cotlncil;
WI��RE�S, the Town Council finds that the project is eaempt fi�o��� C�QA.
NOW, THER�FORE, BF IT R�SOLVED that the fore��oing Recitals are true and
col�rect and ar� incoi-porated l�erein and forin a part of tllis Resolution.
B�: IT FURTI-�EK RESOLVED that the Town Council of the Town of Tiburoi7
repeals Town Colincil Resolution 42-2018.
