RATII'YING THE TOWN MANAGTR'S PROCLAMATION OF THT �XIST�NC�
OF A LOCAL �M�KGENCY DUL TO TH� WORLllWID� SPRI:All
OF THC CORONAVIRUS ("COVID-19")
WHEREAS, the California En�ergency Services Act (California Government Code
sections 8630, 85�0, et. seq.) defines a local emergency as the existence of conditions of disaster
or of extreme pel-i] to tl�e safety of persons and property witllin the territorial limits of a Town,
caused by conditio�is such as ai� epidemic, wllicll are or are likely to be beyond tl�e control of tl�e
services, personnel, equip�nent, and facilities of a Town, and require the combined forces of
other political silbdivisions to coinbat; and
WI�EREAS, Section 2]-2 of the Town oF Tiburon's ("Town") Municipal Code defi»es
emei-gency as the actua] or tl�reatened existei7ce of conditions of disaster or of extt�eme peril to
the safety of persons and property within tl�is Town, ineluding conditions such as an epidenlic.
which are or are likely to be beyond tl�e conh�ol of the services, personnel, equi�ment, and
facilities of this Town, requii•iilg the combined forces of other political subdivisions to combat;
and
WHEREAS, Section 2l-5(a) of the Tow�1's Municipal Code desigilates the Town
Manaber as the Director of Emergency Services for the Town; and
WHER�AS, Section 21-6(a)(1) empowers tl�e Town Manager, as tl�e Director of
Emergency Services_ to pi•oclaim the existence or tl�reatened existence of a local emergency
wl�en the Town Council is not in session so long as sucl� proclamation is ratified by the �I,own
Council within seven (7) days; and
WI-IEREAS, in Deccmber 2019 atld J�nualy 2020, reports began spreadi�lg worldwide of
a flu-lil<e virus first found in China, that was i7lore deadly than the fll� generally, with th� virus
becoming 1<nown as the Coroi�avirlis ("COVID-l9"); and
WI�EREAS_ fi•o�n .Ianuary 2020 to Mai-ch 2020, COVID-19 spread througl�out the world;
and
WI IERE�S_ on March 3. 2020. the County of Marin proclaimed a Local �mergency due
to the tl�reat of COVID-l9 in the Counry; and
WHER�AS, to date_ the Mai-ii� County Department of Health & IIuinan Sei•vices (HHS)
l�as contirmed eleve�l positive case of COVID-19 i�1 Marin County; and
WI IL-.REAS. as of March l 6. 2020, the Centers for Disease Conh-ol and Prevention
("CDC") has coniirmed 3,487 cases of COVID-1 9 in tl�e United States; with 369 in California;
and

WNEREAS. o» oi• about March 4, 2020; as part of the State of California's response to
� address the globa] COVID-19 oL�tbrealc. Govei-nor Gavin Newsom decl�red a State of
� Einergency to mal<e additio�lal resources available, foi•malize emergency actions already
underway across �nultiple state a�encies and departments, and help the state prepare for broadei-
spread of COVID-19 followin� one official COVID-19 death; and
WHEREAS. on March 13. 2020_ the President of the UniCed States declared a national
emergency i•elating to tl�e COV1D-1 9 pande�nic; and
WHEREAS; on Mai-ch 16, the Mai-in County Public Health Officer issued an order
directing residents to sheltei- �t home for thl-ee weeks beginning March 17, 2020, and furthei•
}�rovides limited activity, travel �nd business functions to only the most esse�7tia1 needs; and
WHEREAS, bas�cl on said events, t11e �Town Manager of the Town of Tiburoi7 declared
the existence of a local emerge�icy within tl�e Town on March 16, 2020.
NUW, TH�R�FORE, BE IT RESOLVED, tl�at the Proclamation of the Existence of a
Local Emergency issued by the Town Manager acting as the Director of Emergency Services is
hereby confirmed and ratified by the Town Cowlcil of the Town of Tiblu•on; and
BE IT FURTHER RESOLVED_ tl�at said local emergency shall be deemed to continue to
exist and shall be reviewed at least o�ice every� 60 days until its termination is proclaimed by the
Town Council of the Town of Tibu�-on per California Government Code section 8630; and
BE IT FURTHER RESOLVED, that tlie Town Ma�lager or his designee is authorized to
take whatever other action is autllorized under the Tiburon Municipal Code and state and federal
law, slibject to any required authorization from the `Town Council, consistent with this
Resolution and its basic puiposes.
