A R�SOLUTION OF THT TOWN COUNCIL OF TH� TOWN OF TIBURON
DECLARING ITS INTENT TO L�VY AND COLLECT'ASSI.SSM�NTS WIT�-IIN LANDSCAP�
AND LIGHTING DISTRICT IN THE CYPRESS IIOLLOW SUI3DIVISION ANll SETTING A
TIME AND PLACE ,FOR PUBLIC HEARING
WHERI�AS, on July 3, 1990 the County of Marin established a Landscape and Lighting District in
Cypress Hollow; and
WHEREAS,tl�e County o�f Marin received assessments fi-om the parcels therein for tl�e purpose of
operating and maii�taining tl�e following areas: (1) la��dscapin� and irrigation ofthe 25-foot sewee sanitary
easemeut on tl�e east bounda�-y,(2)entry landscaping and irri��ation of thc 30-foot storm drainage easement
in the so��thwest bounda�y area, and (3) ownership and mainte��a��ce of the park site, all as part of tl�e
Cypress Hollow Development; and
WHEREAS, in December 1998 the Town of Tiburon annexed tl�e Cypi-ess Hollow Area, and i»
Api-il 1999 accepted the Grant Deed from the Coui�ty of Marin for tl�e Cypress Nollow Public Park; and
WHEREAS, the Town of Tiburon, after completing annexation of the �arcels in the Cypi-ess
Hollow District, stated its intention and continued the operation and mainte��ance activities of tl�e Cypress
Hollow Landscape and Lighting District; and
WHEREAS, Tl�e Town Engineer has prepared and �filed wit�h the Town Clerl< and Town Council
tl�e annual Engineer's Report for I�iscal Year 2020/2021, to which reference is hereby made for a full and
detailed description of the existing improvements, the boundaries of tl�e assessment district, and the
proposed assessments.
WHI;REAS, the Town Council desires to more forward witl� proceedi��gs to levy the Fiscal Year
2020/2021 assessments.
NOW THEREFORE IT IS RESOLVED, as follows:
Sectio» l. The Fiscal Year 2020/202] assessments for the District will rei��ain the sai��e as
the Fiscal Year 2019/2020 assess�nents.
Section 2. The Town Cou��cil approves the annual I�i�gii�eer's Report and declares its
intei�tioi� to levy and collect an assessment for Fisc�l Year 2020/2021.
Section 3. Notice is he��eby given tl�at on the 1'`day oi�July 2020, at the hour of 5:00 pm, or
soon thereaftcr, in the regular meeting place of the To�vn Council is hereby fiaed as the time and place for
a public l�earing when and where all i��terested persoi�s shall be heard on the question of the levy and
collection of the proposed assessments. Wr-ittei� protests may be filed with the Town Cler-I< at ai�y time
pcior-to the conclusion af tl�e hea�-ing. A written protest shal l state all grounds of objection and shal I contain
a description sufficient to idei�tify the property o�v��ed by the ��rotest�in� person or persons.
