CPUC rules allow participati»g tow»s, cities and counties to establish legislation authoi-izing the ci-eation of iulder�round utility districts within which existing overhead elech-ic distribution and telecominunication dish�ibution and service facilities will be convertcd to underbround; and WH�REAS, the Town of Tiburon (herein i-eferred to as Town), l�as adopted an ordinance authorizing the Town Council to designate ai-e�s witllin which all existing overhead poles, overhead wires and overhead equipinent associated with the distributioll of electric power, telecominunicatioil services and cable televisio�l sl�ould be renloved and replaced with undergi•ound wires and facilities; and WHEREAS, the Director of Public Worl<s of the �I�own of Tibtu�o»has eonsulted with the affected public utilities and sucl� utilities l�ave a�reed or becn notified that tl�e pi•oposed undei•ground conversion disti•ict, designated the Tiburon Botzlevard Undeigrotmd Utility District and more particularly described in Eahibit 1 attached hei-eto and incolporated llerein by reference,meets the criteria established by the t-ules of tlle CPUG to wit, that the street or road or right-of-way is extensively used by the general pLiblic and cai-ries a heavy volume of pedestrian or vehicular traffic, and that the street or road or ri�hi-of���ay is co»sidered an arterial street or major collector as defined in the Governor's Office oj�I'lant�ing v1d Researcl� General Plan Guidelines; and WHEREAS, eacl�yeai-the To�vi� is notified by PG&E i-egarding t11e allocation of work ci•edits for conversion of ovei-head electric disti�it�ution lillcs and faciliiies to undergrotuld, known as Rule 20A allocations_ and WHER�AS, thc Directoi-of Public Worl<s for tl�e To�vn of Tiburon l�as consulted with PG&E and deterinined that the Town has accumulatcd Rule 20A wot�k credits plus PG&E I�as a�reed tl�at the Town n7ay borrow agaiilsl futtu�e cr�dits stlff7cient to complete tl�e proposed overl�ead to underground conversion pro_ject: and WHEREAS, the Town has »otified the attected Litilities by letter tl��t each utility shall complete the engineering of their respective portion of the "I�iburon Boulevard Overhead to Undergrowld Utility Conversion Pi-oject; a�1d WH�R�AS, the Town l�as notified the affected utilities by letter that the Town shall be responsible for preparation of the treJlch pi-ot71e and composite drawi»gs and that tlle Town shall be designated as "trench lead" to mana��e tre�lching. i�Istallation of substi•uct�ures. and paveineilt r�estoration and such other���orl.: and Pa�`e l of 4 7�o��vi� Council Resolution No. 36-2020 08/OS/2020 WHI+,RP�AS, the Director of,Public Worl<s o�t�il�e Tow» of Tiburon and the �ffected utilities will cooi-dinate ai�d agi-ee on a wo1�k scheclule wl�ich meets their respective capabilities. and furthei• agreed to waive a�1y administrative fees, costs oi� special sh-eet restol-ation reqilirements for purposes of this project; and WH�R�AS, to the extei�t requ�red. the "I�own llas a��i-eed to provide easements oi- rights of way on private property as may be nec�ssary for inst�llation of utility facilities in a fornl satisfactory to tl�e affected utilities; and WHER�AS, tl�e To�vn Cotulcil has now z�eceived the repori from tl�e Town Director of Public Wo1-lcs reconlnlending that the ai�ea idelltiiied i�7 E�hibit l should be desibnated as an underground utility disti•ict within which all existing overhead poles. overhead u�ires and overhead equipment associated with the distribution of electric po��er, telecom�nwlication s�rvices and cable telcvision should be removed and replaced witl� tnlder��round ���ires and facilities; and WH�R�AS, upon the recon�mendatio�l of the To�vil Dii-ector of Puhlic Works, the Towi1 Council has determined that thc proposed T�buron Boulevard Undel-grotuld t Itility Disti•ict is categorically exeinpt fi-om envii•onmental review pursuant to tlle Califor»ia Environ�nental Quality Act; and WHEREAS, the Town of Tiburon has notified all affected propert�� ownei•s witl�ii7 the proposed Tiburon Boulevard Under�round Utility Dist�i-ict and inviting same to attend a public hearing to discuss forination of the proposed disCrict; aild WH�R�AS, the 1'own Council l�eld a public heai-ing at which time the CoLmcil did receive and consider the recommendation of the Town Director of Public Works and did hear any and all objectiol�s or protests that were raised by the owners of property witl�in the above described disti•ict pertaining to designating this area an under�round utility district. THER�FORE, BI; IT R�SOLVED; b}� the To���n Council of the Town of Z��iblu-on that: Section 1. Tl�e public inte3-est i-equires the re�l�oval of all existi�i� utility poles [ excepting those poles supporting str�etlights ol- trai'tic signals), ov�i-l�ead wires and associated overhead structures and installation of uncler��round wires �nd facilities for sup}�lying electric power, cominunication, or similar associated services within the areas as shown in Exhibit 1, attaclled hereto, with such area bein�� designattd as t�l�e Tiburon Boulevard Underground Utility Dis2rict: and Section 2. That the utility companies_ cable television servic�s and other affected services shall con7nlence work on installation of under«round farility installation in Tiburon Boulevard Undei-bround Utility District and that as each phase of the project is complete and ready for conversio» from ovei�l�ead to undei-�row�d utility facilities, all fi�onting propeT•ty owners s11a11 be notified by first c]ass lettel-, postagc pl-e-paid, of tl�e schedule for conversion of all utility service lines: and Section 3. The electric utility sl�all use the undct-grolind convci-sion allocation computcd pursuant to decisions of the Califo��nia Public Utilities Commission for the purpose of � Page 2 of 4 �To��n Council Re�solution No. 36-2020 0�/OS/2020 providing to each pre�nises requiring it in Tiburon Boulevard Underground Utility District a maxiinum of one hundred feet of individual electric service trenclling and conductor (as well as backfilL pavinb and conduit. if requil-ed) and each other serving utility sl�all provide � service trenching and conductor in accordance witl� iCs rules �lnd tariffs oi� file with the � California Pllblic Utilities Commissio�l or as i-eqLiii�ed by its Fr-ancllise �greenlent witll the Town of Tiburon; and Section 4. It is not a»ticipated, but if needed the electric utiliry shall use said undErground conversion allowance allocation, up to a maaimum amount of$1500 per service enti•ance excluding permit fees, for the co�lversion of electric service pa�lels to accept underground seivice in the Tiburon Boulevai-d Underground Utility Disti-ict; and Town of Tiburon shall be financially responsible for any and all costs not covered by tl�e electl-ic utility foi- thc installation and maintenance ol�the conduit and termi»ation box located on, under or wi�hin any structure on the premises served: and Section 5. It is not anticipated, but if needed, thzt upon notification as speciiied in Section 2, all property owners in Tibtu•on Boulevard Undergroluld Utility District shall have underground �electrical entrance facilities installed and inspected pursuant to the Town Electrical Code within sixty (60) days and that should any properry owner lail to install satisfactory underground electrical entrai�ce facilities by the datc specified in the notice, the elech�ic utility shall notify tl�e Dii-ector of Public Works �vl�o shall, within thirty (30) days direct the electric utility in wl-iting to discontinue electrical service to the property, without recourse, pursuant to Rule 11 ui�til electrical entrance facilities are i-eady to accept underground electrical conductors and have passed the necessary inspection requirements; and Section 6. That oilce all services have been coilverted ��i�on� ovei-l�ead to underground, the utility companies, cable televisio�7 services and other �ffectcd services shall remove all poles (except as specified above) and associated ovcrl�ead facilities in Tiburon Boulevard Undergrotuid Utility District witl7in thirty (30) ��orlcing days of colnpletion of under•gi-ounding.
