SALARY AD.IUS7�MEN"I'S Movement tl�rou�h the salaiy ranges will be based Llpon merit following a comprehensive � writtel� performance evaluation bv tl�e "l�own Mana�er. SECTION 3. BEN�FITS AND INSURANCE The "1 own shall contribute a dolla7�amount egual to the combined total of tl�e Ca1PERS Kaiser two-party premium and Delta Dental f�mily pt�emium towards a Manageme�lt employee's cafeteria plan to l�urchase medical. dental, life and disability insurance. This dollar amount will flo�t with tl�e increase or decrease ii1 the cost of the CaIPERS Kaiser two-party and Delta Dental famil�� rate. If tl�e full sl�m specifed is exceeded foi• group insurances of a given en7ployee, the» tl�at einployee sl�all pay the balance of the monthly cost via a payroll deduction f�rom the fiist two payrolls of the month. If the fiill sum specified is not used for the gi-oup insui-ances cost of a �iveil emplo��ee, then that amou�lt, i�ot to exceed $400 per month, shall deposited into o11e of the Towi1's Deferred Coinpei�sation Plans in tl�e elnployee's naine. Any em}�loyee who on Decei�lber 31, 2008 receiv�s inore than $400 per month aceruing fringe shall be capped at the higher amotimt. Should, at any tinie, such eiliployee's accrliing fi-ii�ge fall belo�� the grandfathered cap, birt inore than �400 per nlonth, the lower alr�ount beconles tl�at enlployee's new cap. Retirement—The Town contracts witll Ca(PERS for the provision of a retirement program for its misccllaneous and public safety employees. The Town does not adrninistei•tl�e retirement progra�n a»cl n�akes no ��epz•esentation oFthe specific paraineters �of the pi-ogram beyond wl�at is provided in tl�e Town's contract with Ca1PERS. En7ployees may obtain a copy of tl�e CaIPCRS contract to review all elements of the current program. Effeetive July l, 2015, all emplo}�ees considered ``classic" under CaIPERS shall "pick up" 1% of t11� Ca1PERS Einployers rate. This additional 1% is above the Einployee's normal rate of 7% for Miscell�neous and 9% for Safety. Eil�ployees considered "new" under PEPRA sl�all continue to pay 50% of t11e notmal cost Tl�e employee retirement contribLltion sh�ll be made on a pre-taa basis as allowed tulder Internal Revenue Code 414(h)(2). For Miscella�leous Members of the Public Lmp,loyee's Retireme7lt System hired �rior to J�t�uar}� 1, 2013. the Town of Tibt�ron shall pl�ovide the CaIPERS 2% �i,� 5� retirement forinula, with the higliest single ��eai� calculation. Public Safet}- members hired prior to J�nuaiy 1, 2013 sl�all receive the 3% c 5_5 retii-enient formula �a�ith the higllest �6 months calculation. Miscellaneous meznbel�s hired after ,lulv l. 2013. who are "new membei•s" of the retire�nent system as defi�led by CA Govei-nment Code Section 7�22.04(� shall be provided the 2% at 62 benetit foi-mula witl� the highest 36 months calculation. A qualified employee nlay choose fi-om . the plans offered tlu-ough the Public L-:mployees Retii-ement System Health Benefits � Division for medical/hosp�tal insurance covera�e. Such insui-auce is mandatory for covei-ed enlployees unless tl�cy can demonsti-ate con�pliance ��itl� other cover�ge. Dental Insurance - The Town of Tiburon offei-s management employees and their depelldents a dental plan. Sucl� i��surance is i�landatoi-�� for all c�ualified employees unless they can denlonstrate compliance with otl�el- covez�age. Life Insurance - The Town of Tiblu�oi� offet�s �li�nagelncnt employees a life insurance policy equal to one year's salary, »ot to exceed $95,000. Such insurance is inandatoiy for all full-time employees. If the mandatory amount is rlot exceeded, the Town of Tiburoi7 offeis management employees additional life insl�rance L�p to a combined total of no inore than $9�,000. Participation is optional. Disability Insurance - The Town o1�Tiburon offers managementi etnployees long term disability instu�ance. Such instu�ance is mandatory. Long Tern1 Care - The Town of Tiburon offers manabement employees a larlg-term care policy. Participation is optional. Deferred Coin�ensation Plan - The Town of Tibiu•on of[ei•s a deferred compensation plan to management employees. Sucl� nzonies deposited would become taa-deferi•ecl and would be subject to income taaation in tl�e year tl�ey ai-e withdrawil fi-oin the deferred compensation plan. Participation is optional. I�RS Section 125 Plan - The 1�own of Tibur�on offers n�all�gement e�nployees the ability to partieipate in its IRS Section 125 Plan. Participation is optional. SECTION 4. V�CATION LEAVE In recobnition of the fact that m�ny top man�i�ement pei�sonnel are i•eci•uited fiom otrtside the Town, that the average tenure for those n�anagen�eilt personnel is substantially more than that of non-manageme»t persot7�lel, and tl��t at least thre� vears prior eapei-ience is required, the following vacation leave polic�� for m�lna«e�nent personilel shall be implemented: Manageinent employees shall accumulat� vacation leave in accoi•dance with the follo�ving vacation time entitlement: � Service Worl< Davs 0-5 Years l s Days 6-15 Yeals 20 Days 16+ Years 25 Davs Pcrge 3 of 8 To���i� Coa�ncil Re.solution No. 31-2020 07/01/2020 Upon termination o��a �na»a�eme�lt eii�ployce's service ��%ith the �I�o�vi�, sucl� employee sl�all be paid a lum�� sum ec�tlivalent to his/her accru�d vacation leave. Maximum , accumulation of vacation ]eave is 40 workclays. SEC"�I'ION 6. SICK LEAVE Manageinent employees sliall be entitled to acei-ue one �%orl:ing day of sick leave witl� pay foi•eacl� month or inajoi-fi-action thereof. Sick leavc ma}� be acct-ued by managen�eilt employees without a maaimiun limitation. SECTION 7. SICK LEAVE PAY OFF Management einployees hired prior to July ], 2001 may receive cash ec�uivalent � compensation of 50% of their acerued sick leave, up to a total of 60 days, if tlle followinb conditions are inet: a. I�he enlployee files for � service retirelnent fi�om tl�e Town, or b. The einployee voluntarily separates fi-om the To�vn and l�as at least 15 years of service with the Town. Effective July l, 2011, the cash value of tl�is bene�l�it��ill be determined based on each einployee's hourly rate and number of eligible hoilrs for casli-out pui-poses (50% of sick leave balance, up to 60 days). Tl1is value will be docun�ent�d and the value capped. 'I'his valuc cannot grow througl� additional accrued sicl< leave oi-though inci�eases in pay. Employees with 15 yeals or �noi-e service with the Town may request a cash-out of 60% of�il�e eligible holus (eai�ly casl�-out option). Should an einployee reqllest the early casli-out of 60% of the eligible sicl< leavc ]�ours, they will not be entitled to any fiirther sicl< leave cash-out upon i�eCirement or sepai•ation of employn�ent with the Town. Those hotir-s caslled out will be deducted fi-oln the einployees sicic leave balance. If an einployee is i�ot eligible for, or elects not to talce, the early c�sh-out option, tl�ey shall be paid the fi-ozen dollar vallie upon separatio» ol employment with the Tow��. Tl�e only ��ay the fi�ozen dolla►- ainount c�n be lowered is if an employee has less accrued sicic leave hours upon separation of eniployment than they do on July 1, 2011. For tax planning purposes_ should an employee desire to take tl�e eai•ly cash out option; tl�ey will be allo�ved to tal<e this paymcnt in either 2011 or in Janualy 20l 2. IIOLIDAY CLOSURE All represented and non-represented employees will be requii-ed to tal:e l day vacation or administrative leave as part of the holiday closul-e pi-o�i-an�. The Town ���ill also contribute one day off as part of the pr�ogram. Tibtu-on Town I-Iall will b� closed from Decetnber 24, 2020 through 3anuaiy 1, 2021. SECTION 11. S�CTION 12. "TERMINATION ALLOWf�NCE In oi-der to foster job security witllin a professional clinlate, n�anagemcnt cmployees will be entitled to severance pay when t11ey al•e tei-minated ii-om To��n sel�vice. However. sucl� employee must be in the employ of the Town for at least three (3) yeai-s. ��ld such termination is not for cause or For i•easons listed in Go>>erllment Code Section 19572. the Town's I'ersonnel Rules & Regulations, SecYion 6, or any employee wl�o voltinitarily resigns fi�om Town Service for personal reasons. Unless otherwise noted in an Em�loyment Agreeinent. VEHICL� tJSAGF/ALLOWANCE Manageinent employees, to a far greater eatent than other Town employees, are i-equired to travel thi•oughout the Town, County, and Bay Area to tulfill their job i•equir-eme�its. This tr•avel is fi-equently i-equired oLltside of norm�l worl<ing hours. In recognitioil of this employlnent requirement,the Town shall provide either the use of� To�vn vel�icle or an automobile allowance, as pi•ovided iu tlle Town budget. Use of a `I�owi1 vel�icle sl�all be in accordance with the Town's Administrative Policies and Proccdures aud is not intended for private use. SEC�I,ION 14. TUITION REIMBURS�MENT In order to promote continued developn�ent of s]<ills, 1:»owledge, ancl abilities among mana�ement employees, the Town of TibLuon sl�all reimbw-sei»ent the costs of t��ition. boolcs and fees at the rate of tl�e California State University systein. Employees must i-eceive pr•ior approval of the Town Manager and subn�it certified transcripts with the evidence of a grade of"C" or bettei-fi-om an accreditec� college or tuliversity and sub»1it bona fide receipts to qualify for tuition i•einlbtusement. PKOFESSIONAL MEMBERSNII' I=EES Most n�anagenlent personnel are eapected to �naintain n�embership in app7•opriate professional orbal�izations. Tl�cse inemberships serve to acquaint the "(�own with current pl�ograi��s and procedures in tl�ese professional are�s b}� l��eans of publications and specitic activities. The Town will include tl�e cost of these �z�embei�sl�ip fees in tlle respective departlnental budgets. SECTION 16. RE"1��IRED EMPLOY�E'S MEDICAL ALLOWANCE For any Manabement employee hired prior to July 1. 2009_ ih� Town of Tiburon ti�ill make contributions toward a retired employee's medical insurance plan based upon the following conditions: a. Fmployee must retire directly from eniploynlent �vith the To�a��i of Tibtu�on and apply to PERS for retirement benefts. b. The retiree's inedical insurance allowance is fiaed al�d capped at the Kaiser single rate that is in effect at tl�e time of the en�ployee's retirement. c. The Town's contributions rate is based on tlie �following fol-mula: Percent of Kaiser Years of Consecuti�%e Single Rate Service to Town 50% 15 Years 75% 20 Yeai-s 100% 25 Ye��-s Such eoverage is not extended to employee's spousc oi• otl�el� depe»dents.
