SALARY ADJUSTMENTS Movement through the salary ranges will be based upon inerit following a comprehensive writteil performance evaluation by tl7e employee's supei-visoi-. SECTION 3. BENEFITS AND INSUR�INCES The "Town shall conti•ibutc a dollai- an�ount cqual to the combined total of the Ca1PERS Kaiser two-party pl•elniLlm and Delta Dental family pi-emium to each Mid-Ma�labement and Unrepi•esented employee's caf�etel-ia plan to ptirchase medical, dental, ]ife and disability insurance. This dollar amotn�t �vill f7oat witl� the increase or decrease i11 the cost of the Ca1PERS K�iser two-party and Delta Dental family rate. If the full sunl specified is exceeded for gi•oup insui�ances of a ��iven empl��yee. tl�en tl�at employee shall pay the balance of tl�e monthly cost via a payroll cieductioii fi-om 11�e first two payrolls of the month. If the iizll sum specified is not used for the group insurances cost of a given etnployee, then tliat amount_ not to exceed $400 per month. sliall deposited into one of the Town's Delerred Compensation Pla»s in the employee's name. Any employee who on December 31, 2008 receives moi-e than $400 per mo�lth accrtiiing fi-inge shall be capped at the higller amou��t. Sl�ould. at an}� time, sucl� ei��ployee's accruing fringe fall below the grandfathel-ed cap, but more th�n $400 per month, the lower amotmt becomes tl�at employee's new cap. 'l�l�e Town does not �� administer the retireinent program and �nakes uo represei7tation of the specific para�neters of the progranl beyond wl�at is provided i�1 the Town's contract with Ca1PERS. Employees nlay obtain a copy of tihe C�IPERS contract to i•ev�ew all elements of tl�e current program. Effective July 1, 2015, all employees considered "classic" Ln�dei- GaIPERS shall "�ick up" 1% of the Ca1PERS Employei•s i•ate. Tl�is additional ]% is above t]�e Eznployee's normal rate of 7% for Miscellaneot�s and 9% foi• Safety. Employees considered "new" under PEPRA sl�all continue to pay 50% of tl�e normal cost. Tl�e enlployee retirement contr-ibution shall be made on � pre-tax basis as allowed under Internal Revenue Code 414(h)(2). For Miscellaileous Menlbers of the Public Einployee's I2etiremei�t Systen� hired prior to Januaiy 1, 2013, the Town of Tiburon sl�all provide the Ca1PF:RS 2% c�� 55 retireillent formula, with the highest single year calculation. I'ublic Safety members hired pi•ior to Januaiy l, 2013 shall receive the 3% a) 5� retirement formula with the highest 36 months calculation. Miscellaneous members hired after July l 2013, wl�o are "new�nembers" of the retirement system as defined by CA Government Code Sectioil 7522.04(� shall be provided the 2% at 62 benefit formula with the l�ighest 36 months calculation. Public Safety employees hired on or aftei-January 1, 2013, wllo are "new members" of the retirement system as defined by CA Governnlent Gode Section 7522.04(�, shall receive the 2.7% @ 57 retireinent forrnula with the 1lighest 36 ino�iths calculation Medical InsLu•ance - The Town of Tibtiiron oifers its employees and their dependents medical/hospital insurance coverage. An employee covered under this resolution may choose fi�om the plans offered through the Public Employees Retirement System Health Benefits Division for inedical/hospital insurance coverage. Sucl1 insurance is inandatory for employees unless they can demonsti-ate compliance witl� otl�er covei-a�e. Dental Insurance - The Town of Tiburon offei-s elnployees and their dependents a dental plan. Such insurance is inaildatory for all employces unless tlley can den�onstrate compliance with other coverage. Life Insurance - I�'he Town of�I��iburon o11ei-s emplo��ee covered by this i-esolution a $25,000 life insurance policy. St�ch insurance is inandatory. The Town of Tibtu-on offers einployees covered by tl�is resolution additional life i�istirance above the mandatoiy $25,000 poliey, Llp to a combined total of no nlore than $95,000. Participation is optional. Disability Insurance - The 1'own of Tibin-on offers en�ployees covered by tl�is resolution long terin disability insurance which provides two-tl�irds of an employee's salaly up to a znaximuin benefit of$4,SOOhl�onth. Participation is optional. Deferred Co�npensation Plan - The Town of Tiburon offers a cl�oice of two deferred compensation plan to en�ployees. Such monies deposited would become tax-deferred and would be subject to income taaation in tl�e year they are withdrawn fi-om the deferred cotnpensation plan. Participation is optioiial. IRS Section 125 Plan - The Town of Tiburon offers eil�ployees the abiliry to participate in its IRS SEction 125 Plan. Participation is optio»al. SECTION 4. VACATION LEAVE Mid-management and Unrepl•esenteci employees shall acciimulate vacation time in accordance with the following vacation entitlement schedule: Service Work Days 0-5 Years 12 Days 6-10 Years 18 Days 11+ Years 20 Days Upon termination of a covered employee's service �vitl� the Town, such employee shall be paid a lump sum equivalent to his/her accrued vacation leave. Maaimum accumulation of vacation leave is 35 workdays. SECTION 5. SICK LEAVE Mid-management and Uizrepresented employees shall be elltitled to accrue one workii�g day of sick leave for each month or tn�jor fi•action thereof. Sick leave may be accrued by qualified employees without a maximtu» limitation. SEC"T10N 6. SICK LEAVE PAY OFF Mid-management and Unrepresented einployees l�ii-ed p1�io1-to July 1. 2001 may receive casll equivalent compensation of 50% of their accrued sicl< leave, up to a total of 60 days, if the following conditions ai-e met: a. The en�ployee files for a service retirement 1�rom the "Town. or b. The en�ployee volunt�rily separates from the To��rn and has at lea�t 15 years of service with the Town. Effective July 1, 201 l, the cash value of this benetit will be determined based on each emplo}%ee's hourly rate and number of eli�ible houi-s foi-cash-out ��utposes (50% of sick leave balance, up to 60 days). This value ���ill be documented aild tl�e val�ue To��i�«Co�mcil Resohi�ion No. 30-2020 07/01/2020 Page 4 of 7 capped. This value cannot �i•ow thi-ougl� additional accrued sick leave or thougl� inct•eases in pay. Employees witl� 15 years or more service with the 7��own may request a cash-ollt of 60% of t1�E eli�ible ]Zoui-s (early cash-out optio»). Sliould an em}�loyee request ihe early cash-out of 60% of tlie eligible sicic leave hours, they will ilot be entitled to any fiuther sick leave cash-out upon retii-emellt or separation of en7ployment with the Town. Those I�oui•s casl�ed out will be dedi�cted fi-oin tlie einployees sick leave balance. If an employee is not eligible for. or elects not to take, the early cash-out option, they shall be paid tl�e fi�ozen dollai�value tzpon separation of einployment witl� the Town. The only way the �t�rozen doll�i-a�»ount caTl be lowered is if an einployee has less accrued sick leave l�ours upon sepai-atioi� of employn�ent tl�an they do on July l, 201 l. For tax planning ptu-poses, should an e�nployee desire to take the early cash out option, they will be allowed to takc this pay�nent in eitller 2011 or in January 2012. For employees hired after July 1, 2001 in Mid-Mana�en�ent a11d Unrepresented positions may accrue uillitnited sick leave with no option for "casl�back" benefits. SECTION 7. HOLIDAYS The Town agrees to provide Mid-Management and U�ll-epresented employees the following holidays: New Year's Day Januaiy 1 Martin Luther King Day Third Monday in January President's Day Third Monday in Februaiy Memorial Day Last Monday in May Independence Day July 4 Labor Day First Monday in Septe�i�bei- Veterans Day December 26 (observed) Thanksgiving Day I'ourth Thtn•sday in Noveinber Friday aiter Thanl<sgi�-in� Christmas Eve Decembei-24 Chi•istmas Day December 25 New Year's Eve December 31 When a holiday falls on a Saturday, the preccding Friday shal( be observed. However, if a holiday falls on a Saturday and the preceding Frida�� is also a l�oliday, the Town Manager may designate the preceding Thursday or following Mo�lday to observc the holid�y. When a holiday falls on Sunday, the following Monday shall be observed. However_ when a holiday falls on a Sunday and the following Mo�lday is also a holiday, tlle T'own Manager may designate tl�e preceding I�1•iday or following "1�uesday to obsei-ve the holiday ��Tnri�n Coimcil Resola�tion No. 30-2020 07/01/Z020 Pa�e�oj." SECTION 8. HOLIDAY CLOSURE All repl-ese�lted anc� no�1-i•eprese�ltcd employees will be required to take 1 day vacation oi� adn�inistrative leave as part of the holiday closure progran�. The 1�own will also contribute one day off as part of tl�e probram. Tiburon Town Hall will be closed fi�o�n Decenlbei- 2�}, 2020 throu�h Ja�luary 1, 2021. ADMINISTRATIVE LEAVE In reco�nition oi�tl�e lon� houl•s i•ec�uired to perforin at the Mid-Management and Unreprese�lted leveL including atte�idance at numerous meetings outside normal working � hours, the followi»g Adn�inistrative Leave policy sha11 be implemented. Each exeinpt Mid-Managetnent or Unrepl�esented employee may receive up to ten days administrative leave annually; to be awarded at the discretion of the Town Manager. Administrative Leave shall be talce�l iu one hour inci•ements. SECTION 10. DINN�R ALLOWANC� All Mid-Mana�ement and Unrepresen�ed employees who live more thanl0 miles fi-om Town and who ai-e �-ec�uii�ed to attend night ineetings or work after office hours beyond 7:00 P.M. may be reimbursed an amount not to exceed $25.00 for the purchase of dinncr for that night. Employee 1-eimbtu-s�ment is subject to the approval of the Town Manager aud must be �ccompanied by a i-estatu-ant receipt which shall include the an7oimt, date, meeting or purpose. and the emplo��ce's name. SECTION 11. TUITION RrIMBURSEMENT I�7 ol-der to pi-o»Zote continued development of skills, knowledge, and abilities among employees. the 7�own of�Tibui•on shall reimburse the costs of tuition, books and fees at the rate of the California State Uni��ersity system. �rnployees must receiv� pz-ior approval of the Town Mana�er anci submit certified transcripts with the evidence of a grade of"C" oi-bettei-fi-o»> an acci�edited college or university and subinit bona lide rcceipts to qualif}% foi- tiiition i-eimbtarsement This provision l�as beeu suspended since FY 2011-12. RETIRED EMPI.OYEF'.'S MLDICAL ALLOWANCE � Fol- cmployees covered by this Resolution and wllo were hired prior to July 1, 2009, the Town of Tiburon will mal<e contributions toward a retired employee's mcdical insurance plan based tlpon the following conditions: a. Employee nlust i-etire directly i-i-om employment with the Town of Tiburon and apply to PERS for�reiirel��ent benefits. b. The retiree's medical inslu-ailce allowance is fixed and capped at tlle Kaiser single rate that is in effect at the time of the employee's retii-ement. c. The Town's contribution i-ate is based on the following formula: Percent of Kaiser Years of Consecutive Single Rate Service to Town 50% 15 Years � 75% 20 Years 100°/o 25 Yeat•s � Such coverage is not eatended to employee's spouse or dependents. Employees hired after July 1, 2009, shall not be eligible for retiree medical allowance. SECTION 13. PERSONNEL RUL�S & REGULATIONS � In the event any provisioi�s of�this Resolution contradict those included in the Town's Personnel Rules & Regulations. the terms of this Resolution shall prevail.
