WH�R�AS, tlle Town Cotmcil of the Tow» of Tibui-on l�ereb�� finds. declares and determines
that t11is Resolutioil is necessary for the immediate p3�ese1-vation of the public peace_ healtl� a�1d
safety based upon the findii�gs and recitals set forth herein:
WHER�AS, Oi1 March 3, 2020, the Marin County Public IIealtl� Officer issued a Declaration of
Local I�ealt�h Emergency pui-suant to Health and Safety Code section l O1080 due to an i�nminent
and pi-oximate tllreat to public health from thc introdt�ction of COVID-l9.
WI�3�R�AS, On March 4, 2020, the Governor of the State of California, in I;x�cutive Order N-
29-20 proclaimed a state of emergency to exist in California due to the thl�eat of�COVID-l9.
WI��IEI2�AS, On March 10. 2020, the Mai-in County Board of�Supervisol-s cieclal�ed a state oi
local emErgency due to conditions of extreme pci-il ai�d sai-ety of persol�s presented b}% t11e
potential introduction of COVID-19 into Marin Coul�ty_
WH�I2EAS, On March 18, 2020, the Tow�1 Council of tlze To���n of Tibui�on issued Resolutio�l
No. 08-2020 ratifying the proclamation of the e�istence of a local emer��ency due to the
��oi-ld�ide spi-ead of COVID-19.
��'�IER�AS, "lo protect tl�e public healtl�, safety and ����lfare. the Marin Countv Board of
Supei-visors has adopted and approved various ordei�s. resolutions and ordinances related to tlle
COVID-19 pandenlic including but not limited to orders mandating the �-�-earin� of m�sl:s.
protectil�g renters, providin� assistance to busi�lesses. tem}�orarily prohibitin�? short term rentals,
and ad��pting procedures foi-the safe reopening of businesses;

Tiburon have conlplied with Public Health Orders to curtail t11c 5pread of COVID-1). IIo���ever.

WI-�EREAS, On July 21; 2020. the Board of Supervisors of th� Cou»t�� of Marin adopted an
urgenc�� ordinance adding Chapter 7.99 to the Marin Countv Code. Chapter 7.99 authorizes the
issuanc� of adini�listrative cilations for ihe violation of any o��del- isst�ed by the County I��Iealtl�
Ofticei- undei- alithol•ity grantied by State law:

��V1-IER�AS, Tl�e Marin County Code Chaptel� 7.99 delegates to local_jurisdictions ��-itllin the
Count}� tl�e al�thoritv to utilize civil enforcement procedures to encourage compliance ���ith
Public Ilealth Oi-ders. (MCC �� 7.99.02, 7.99.05.)
WI��REAS, Marin County Code Chapter 7.99 declares violation of Public Health Orders to
constitute a public �7uisance tllroughout the County; including within incoipc�rated cities. (MCC
� 7.99.03.j
WHEREAS. this Kesolution revises the Town's e�isting resolution establisl�in�,� administi-ative
cit�tions (Reso. No. 01-2016) to establish cit�ation amounts for violatio» of Public I-�ealth Orders,
includin� those i-elated to COVID-19.
WHLREAS, Adi1�i�listrative citations contemplated by this Resolutio» �vould be issued b}� Town
ot'ficials under the existing provisions of Cl�apter 31 of the 'l�iburon Municipal Code, which
autl�orizes the Town to issue adlninistrative citations foi-public nuisatices. (TMC � 31-] l.)
NOW, 'I�H�REFOR�, B� 1T R�SOLVED, that tlle Town Coullcil oi�the 7�ow�� of Tiburoi�
does hereby resolve:
Section 1. T11e i-ecitals set forth herein are trLie and correct.
Section 2. �I�he 1�ow�i Council hereby amends Resolution O1-2016 (�1 Resolution Setting Fortl�
the Viol�tions of the Municipal Code that may be Enforced by Administrative Citation Pursl�aut
to Chapter 3l of tl�e Municipal Code and Adopting an Updated Schedule of Fines for Violations)
to add a paragraph 14_ to Exhibit A (Administrative Fi�ies Se}Iedule). �s �f�ollows:
14. All ��iolations of"Public Healtl� Ordei-s" as that term is de1�i�led is Marin Cotnity
Code Chapter 7.99 (Mwlicipal Code S 3]-1 1, Marin County Cocle Cl�. 7.99): $100.00 Ior
violation of eacl� non-coillinercial violation; $250.00 for each violation involving a
commercial activity.
