� ENTERPRIS�S, INC. FOR THE OLD RAIL TRAIL MAINT�NANCI: PROJ�C I�;

WH�R�AS, the Tow�1 Manager of the Town of Tiburon did on June 3, 2020, �wai-d a conti-act
to MVC Eilteiprises; I�1c. for the Old Rail Trail Maintenance Project, and
WH�R�AS. the Towi� Council of the Town of Tiburon has been advised that tlle worlc of
consti-uction under said contract has been completed; and
WH�R�AS. the Town Council of the Town of Tiburon has been advised tl�at t11e wot-k was
inspected by the Town and was found to be acceptable.
TH�REI'ORE, B�IT R�SOLVED that the Tiburon Town Cotmcil, does resolve, declare,
detier»�in� and order as follows:
1. 1�he Town Council of ihe Town of Tiburon does hereby acccpt thc work ai�d
i�nprovem�nCs i•eferred to in said coiztract, reservin� howevei-, all i-igl�ts against tlle
contractor, and the surety or sureties to any bond posted by them require full and
colnplete pei forinance of the coilti-act, including corrections of any defective worl: whicl�
inay appear in said work oi•impr•ovement.
2. The Direcfor of Public Works shall file a Notice of Com�letioi� witl� tl�e Cotilnty of
Marin.
