For and in consideration of the issuance by the Town
of Tiburon ( "Town") of a certific�te of occupancy for Unit
Noe 155, Bayside Condominiums, Point Tiburon� Tiburon,
Californiaa The Innis�ree Companies agrees t� hold harmless,
defend with competent counsel sa�i�factory to Town and
indemnify �own and its representatives and agent� from all
liability, losses , damages , coats , expenses (including
attorney' s fees and expert' s fees) , causes of action, claims
and/or judgment� arising by ea�on of �h�e occupan.cy, and/or use � 1

of said condominium unit��`" sul �ng rom any cause or causes
what�oever including, but not limited to, claims by
R013FRT and CA.ROL WOLFE and/o.r_ any other occupant, person or
party arising out of any claim of right to pur_chase or occupy
said condominium unit. Thi� indemnity shall extend to, but is
not limited to, any claim� by ROBERT AND CAROL WOLFE against
Town that Town iriterfeied with or prevented consummation of
the WO�,F�° s agreement to purchase said condominium unit.
ThP Innis�ree Companies fur�ther agrees that close of
escrow for sale of condominiums located a�. -�he Point 7C'iburon
p�oject, Tiburon, Californiaa including, but not limited to,

Unit Noa 155a shall no�t occur until Tawn has appraved
Covenan�tsn Conditions and Rest�ictions for sa�d projecto
