'`�TE PR�NT pM7SS�ON Y'�/ � „�2 DR AF T OF • � STORM DRAINAGE ORDINANCE FOR THE CITY OF TIBURON � � Whereas the City Council of the City of Tiburon does find it necessary to improve and construct flood control and drainage facilities, including water ways, pumping facilities, tide control structures, and other facilities utilized for con- trolling drainage, storxn waters, and flooding caused. wholly�or in part by tidal waters within the City in order to promote and protect the public health, safety, peace,cctmfort';, convenience, and the general welfare; and for accomplishment of . the purposes more particularly set forth as follows: A. To assist in providing a definite plan of development within the City and to control and regulate the use of drainage w�exways and tidal control structures, and other flood control and drainage improvements and facilities in accorda.nce with said plans. B. To provide a guide for the intelligent outlay of capital expenditures of said City for drainage and flood control improvements. � C. To provide an authentic source of information for the developmerit of such improvements for present and prospective residents, develope�s and investors in proper�Ey within said City. D. To provide a d.rainage pattern for sucli future subdivision of land as may take place in said City. E. To obviate tl�e xnenace to public safety �esu].ting froxr� inadequate provision for drainage in connection with and as a result of the development within said City. F. 'I'o provide safe and adequate d.rainage in tide3.ands areas and to provide faciliries requirecl to compensate for the loss of natural ponding capacity wi�ich may result from the developrnent of land heing normally beiow the elevation of the maxi- mum Ievel of tidal or estuarine waters within said City. , ; ' _ ,:,�- , , , 6 . _1 E3(lu}t�/��� ���f�7� � , : G. To prevent deterioration of property values and impairment of conditions making for desirable residential, commerical, or industrial development, as the case may be, which would result from lack of definite plans designed to assure the orderly, beneficial, and esthetically pleasing development of lands within said City and the whole thereof. Now Therefore, it is hereby ordained by the City Council of the City of Tiburon as follows: � Section l . Definitions. �1. Waterway. Waterway is defined as a piver, stream, creek, watercourse, channel,. swale, conduit, pipe, or any depression in which water does or may flow. B. Structure. Structure is defined as any wall, retaining wall, crib wall, bulkhead, ciwelling, business structure, garage, school, church, hospital, out- building :, pole, conduit, utility, fence, or anything made or �onstructed which has its foundation or means o£ support upon, �a.nd.er, or within the surfac� of the earth. C. Rubbish. �2.ubbisl� is defined as any substance which is not readily soluble ::n water. D. Bank of a Waterway. Bank of a Waterway is d.efined as the sl oping sides of a waterway and extends to a plane three feet above t�xe highwater pa�ofile as • determined by the City Engineex�. Fo Collector Drainage Facilitieso Collector I�rainage Facilities are defined . , as waterways or othe� s�orm dra.ina.ge and flood control facilities serving a tributary area of less than twenty (20) acres, natupal or manmade, improved or unimproved, �vhich receive and transport storm drainage waters. G. General Engineering Plan. A General Engineering Plan is defined as a plan prepared by a registereci Civil Enginee�r, in conformance with the policies and design critera established by the City Engineer and approved by �he City Council. The � plan must be of sufficient detail that the positions, grade, and size of the facilit.ies. may be readily dis.cernable. . -2- EO�K.oO�� FAGE��� � _ H. City Drainage Plan. City Drainage Plan is defined as a plan developed �� by or under the direction of the City Engineer for trunk storm drainage or other drainage and flood control facilities which is duly approved and adopted by the City Council. Section 2: Financial Provisions. A. There is hereby created and established a special fund which shall be designated as the "Storrn Drainage and Flood Control Fund" into which monegs shall be deposited as hereinafter provided, and all moneys deposited into said fund shall be used by the city only for the purposes of planning, designing, constructing or improving flood control and storm drainage facilities, and the acquisition of land required for said improvements. Said fund shall be used for capital improvement projects only. B. Maintenance and operation expenses shall be paid exclusively from taxes. Section 3. Maintenance of Waterways. . � A. Eve�jyperson, firm, corporation, or public agency through whose property a waterway existsy shall keep the same free from permanent obstacles which will prever�t , c.hange, or retard the flow af watex unless a. permit to alter such water- way has been obtained pursuant to the terms of this Ordi:nance. Section 4. Prohibition, � It shall be unlawful for any person, firm, corporation, public agency, to do, or cause to be done, any of the following without having first secured a permit from � the City Engineer. A. Construct, place or maintain any structure upon or between the banks of a � � ` wate rway o B. Excavat e upon or within the banks of a waterway. C. I)eposit rubbish upon o'r wizhin tlze banks of a wates�way. ^ � D. Construct or place any outlet for discharging drainage waters upon or within the banks of a v�a.ter�ray. _ -3- �Ot�K�o�l� FACr�E��� _ ___. _ E. Plant or install any object or plant any form of flora other than grasses within the banks of a waterway. • Section 5. Application for Permit. A. Any person, firm, corporation, or public agency desiring a permit to perform any of the acts for which a permit is requirecl pursuant to this Ordinance, shall make application for such permit to the City Engineer. The appl'acation shall specify: 1 . Action intended. 2. Applicant's name, address, andt�elephone number. 3. Date of application. , 4. Location of proposed work. 5. Name o� owner of proper�y, 6. Name of engineer who will plan and designthe work. �ing . 7. General Engineer Plan clearly d.escribing any proposed structures and the materiaTs and �ype of construction to be employed which shall show cross sections, plan, and profile of said proposed structure. 8. A description and plot plan of existing structures. � B. Any person, firm', or corporation filing a, subdivision map and desiring to do any of the acts for whiclx a permit is required pursuant to this Ordinance, slzall in lieu of the applica�ion procedure set for the in paragraph A above, submit }mprove- ment plans prepared by. a registered civil �ngineer. C. The City Engir�eer sliall charge a fee of thirty dollars for any permit issued under this Sectiot�.tv recover the cost of plan checking and inspection unless plans o£ such improvem.ents are inclucled in general improvement plans for which a plan checking fee has already been paid. Section 6. Granting Qr Denial of Permit. A. Upon receip.t of such application for permit or of improvement pla.ns, prepared by a registerecl civil engineer, including such additional info�mation as -4- BQOK.����� F�GE��� may be required, the City Engineer shall, within thirty (30) days make such inves- tigations as he deems necessary to c�termine whiether or not the proposed work or activities intended will impede, restrict, retard, change the direction of the flow of water, catch or collect debris carried by such water, or is located where natural flow of the storm and flood waters will carry any intended structure, or any part thereof, downstream, or will, in his opinion, damage., weaken, erode, or reduce the effectiveness of the banks to withhold storm and flood waters or interfere with drainage facilitties, or will impose any liability upon the City of Tiburon for such works, or any damage caused thereby. In order to make said investigation he may return said application or improvement plans to the applicant for additional information, structural analysis, or soils tests as may be required to complete � his investigation. In the event said application is returned, the thirty (30) day period hereinabove referred to shall not commence to run until the date of Eesub- mission of said application. , B. After investigation, said Ci�y Engineer shall a.pprove, approve conditionally, or disapprove, the application or improvement plans on the basis of his investigations. C. If a permit is granted, it shall state the conditions upon which it is granted. Section 7. Appeal. , - A. In the event an applicant is �g,�rievelcl�bythe action of the City Engineer, or by reason of the requirements of this Ord'tmance, he may,within fifteen (15) days from date of ciecision of the Engineer, make an appeal in writing to the City Council, The City Clerk shall set a t�m.e for hearing �n such,�.ppeal within three (3) weeks from the date of receipt of said appeal, which he aring sliaAl be held within thirty (30) days of the meeting thereof, and shall anail or deliver, notification to the applicant and City Engineer of said date at least two (2) weeks prior to the date so set. . � B: At the hear ing of sixch a�peal, it shall be incumbent upon the appellant � to show to the satisfa.ction of the City Council that eienial of the permit or conditions attached thereto will cause undue hardship on the applicant and prevent him from making a reasonable use of the property, and that such structure so pro osed will not � -5- 804�ft�l��l� FA.GE��� � impede, restrict, retard, or chang e the direction of the flow of water in the water- way; will not catch debris carried by such water; is not placed where the natural flow of the sbrm and flood waters will carry the structures, or any part thereof, downstream; will not damage, weaken, erode, or reduce the effectiveness of the banks to withhold storm and flood water, and will not interfere with facilities neces- sary for flood control and drainage, nor will it impose upon the City any liability therefore. � C. If the City Council determines that �he permit should be issued by the City Engineer, or that the permit shall be modified, it shall issue to said City Engineer instructions setting forth such directions or modifications and direct the issuance of the permit in accordance therewith. Section 8. Performance of Perrnitted Work. � A. The permit, when iss�.ed shall constitute authority for the applicant to proceed according to the conditions, if any, o� the permit, except as to ithat work for which other periizits are required. by �he City of Tiburon, County of Marin, or the public agency on whose property the work is to be performed; when other per- mits are required, such permits must be obtained from the proper legislative body, and the permit granted pursuan� to the terms of this Ordinance shall not be effective until such other permits have been obtained, it shall be the responsibility of applicant to determine the need for such other permits o S. All work for which a permit is required shall be subjecteci to administrative requirements of the City Engineer, Section 9. For single family residences and buildings, structures and improvements thereto the fee shall be computed as follows: 1. In receipt for payment of the above mentioned drainage fees, the City shall issue Certificates of Drainage Participation, which shall be in such form that the description of the particular parcel of real property to which fees apply may be described therein. When a Certificate of Drainage Participation is issued the des- cription of the parcel of real property to which it is appurtenant shall be ins erted therein prior to its issuance, and such Certif icate shall thereafter at all times be and remain appurtenant to said parcel of real property and shall pass with and follow the title to said property and shall not be separated therefrom. I;t shall be the duty and obligation of the City when funds in sufficient amounts are available therefor, to construct and improve, and implement as possible those portions of the City Drainage Plan which may be determined b� the City Engineer to most d'irectly benefit those areas from which funds have accrued. 5ection I0. Special Provisions of g'ees '�'he following special provisions shall be applicab}:e to the fees authorized her ein. A. The construction costs of trunk or collector drainage facilities located in publicly owned streets, or on rights of way for drainage facilities downstream there- from, or on rights of way traversing a parcel of property for the serving of more than twenty (2(�) acres of whfch were or wotzld be required to be canstructed by the City, may be deducted from the fees set forth in 5ection 9 as will be determined by the City Engineer. B. Whenever the City Engineer requires construction of trunk and/or collector drainage facilities ad�a.cent to a development, such construction costs are eligible for deduction as will be determined by the City Engineer. C. Costs eTigible for computing deducti�ns may include the land acquisition costs, profits, overhead, inspection, and engineering in addition to direct cons- ' truction cost. D. In the event an assessment district.is formed for the �onstruction and financing of drainage facilities, any fees previously collected to finance such faci- lities within the assessment district so formed shall be contributed to the Assess- ment District and the assessment which wo�il.d be levied against the �roperty to which said fee was related shall be reduced by the amount of such fee or fees. E. At the time of approval of a building permit and determination of the fee therefor, the City Engineer shall give consideration to any fees previously paid applicable to the land proposed for improvement. Credits for facilities constructed prior to the effective date of this or- dinance may be allowed and shall be apportioned against the parcels of land in question at the determination of the City Engineer provided that the following con- ditions are satisfied: 1 . That facilities have been actually constructed and conform to the City standards for such construction. 2. That the value of facilities shall be determined by the City Engineer, � 3. The construction of such facilities were part of improvements required by the County of Marin. G. Wherever actual construction of drainage facilities to a terminal disposal point is cnmpleted to the satisfaction of the City Engineer and said construction cost, including rights of way, is egual to an amount less than the authorized fee per acre as prescribed herein, the City Engineer shall exempt from sa-id fee provisions such parceP or parcels foa� which said constpuction was cornpleted. '�'erminal dis- posal point, for purposes of this section,- shall mean San Francisco Bay. " Section 11 . . Violations. Any person, firm, association or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and. upon �onviction shall be punished by a fine of not to exceed or by imprisonment in the County Jail of the County of Marin for a period not to exceed or by both such fine and imprisonment or the City Council may authorize the City Council to proceed by injunction process ta abate �,ny violation of this Ordinance. 5ection 12.
