THIS AGREEMENT, made and entered into at Tiburon, California, this
16th day of October , 1975 , by and between
John M. and Mary C. Croxall , hereinafter refer-
red to as "Owners", and CITY OF TIBURON, a Municipal -Corporation, hereinafter
referred to as "City",
W I T N E S S E T H :
WHEREAS, On September 23, 1975 , owners filed with City

application for encroachment permit for the three points of the existing struc-
ture of the hereinafter described real property of owners; and
WHEREAS, the existing structure has been on the public right-of-way
known as Mar East since 1946; and
(Street)
WHEREAS, on October 14, 1975 , City granted a revocable
(Date)
encroachment permit to owners permitting the existing .structure to continue to
encroach subject, among other things, owners' agreement to remove said encraoch-
ments at owners' expense upon the eventuality of City's future plans to improve
said right-of-way;
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
l. That upon receipt by owners of a certified copy of a rsuolution
of the City Council of the City of Tiburon evidencing the intention of City
to improve said right-of-way and requesting owners to remove said encroachments,
- -owners will, exclusively at their own cost and expense, within forty-five (45)
days from receipt of said resolution, remove or cause to be removed said er_croach-

3. That upon the failure of o�•�ners to com�ly c��th any of the aggee-
men�s contained herein, City may declare said i�provemen�s to be a public nuisance,
and may take such action as may be authorized by law to a�ate sai� nuisance. T�e
remedy of City as contained in this paragraph shall not be exclusive.
4. That the ag-reements contained herein are covenants an� servitudes
running caith the land and shall be binding upon atiuners, and their successors,
assignees, executors, administrators and persanal representatives.
