Members of the public were invited to participate in the meeting by live-streaming the meeting on the Town’s website and submitting comments to comments@townoftiburon.org to be included in the public record for the meeting. SPECIAL MEETING – 4:30 P.M. Mayor Welner called the special meeting of the Tiburon Town Council to order at 4:30 p.m. on Wednesday, February 16, 2022. Mayor Welner called the regular meeting of the Tiburon Town Council to order at 5:00 p.m. on Wednesday, February 16, 2022. CALL TO ORDER AND ROLL CALL PRESENT: COUNCILMEMBERS: Fredericks, Griffin, Ryan, Thier, Welner ABSENT: COUNCILMEMBERS: None PRESENT: EX OFFICIO: Town Manager Chanis, Town Attorney Stock, Director of Community Development Tasini, Chief of Police Monaghan, Director of Administrative Services Creekmore, Associate Engineer Eshoo, Town Clerk Stefani ORAL COMMUNICATIONS DocuSign Envelope ID: A35BFBD9-8DB0-439D-8A44-812C98A002B6 Page 2 of 4 Tiburon Town Council Minutes #04-2022 February 16, 2022 Robert Walley, Wendy Walley, Bob Nadjibi, and Lalita Waterman requested the Council consider adopting an urgency ordinance to amend Section 15-10 of the Town’s Municipal Code related to view obstructions, citing expensive lawsuits and impacts on senior citizens. Matthew and Arin Mesa requested an item be added to a future Council agenda to discuss not using Blackie’s Pasture as a construction staging area. CONSENT CALENDAR CC-1. Town Council Minutes – Adopt minutes for February 2, 2022 Town Council special and regular meetings (Department of Administrative Services) CC-2. Teleconference Meetings – Adopt resolution that would allow the Town to continue to operate virtual board meetings in accordance with AB 361 (Department of Administrative Services) CC-3. Municipal Code Amendments – Adopt amendments to Chapter 16 (Zoning) of the Tiburon Municipal Code related to accessory dwelling units and junior accessory dwelling units (Community Development Department) CC-4. Municipal Code Amendments – Adopt amendments to Chapter 20 (Animals) related to the prohibition of dogs on McKegney Green (Department of Public Works) CC-5. Investment Summary – Adopt investment summary for month ending December 31, 2021 (Department of Administrative Services) CC-6. MMWD Easement Agreement – Approve the Easement Correction Deed and authorize the Town Manager to execute the agreement (Department of Public Works) CC-7. Budget Amendment – Approve a fiscal year 2022 budget amendment in the amount of $40,091 from the General Fund Operating Reserves to pay for the costs of the November 2, 2021 Special Municipal Election (Department of Administrative Services) Councilmembers Fredericks and Thier requested Consent Calendar Items No. 3 and 4, respectively, be removed for discussion or a vote. MOTION: To adopt Consent Calendar Items No. 1-2, and 5-7, as written. Moved: Thier, seconded by Fredericks VOTE: AYES: Fredericks, Griffin, Ryan, Thier, Welner CC-3. Municipal Code Amendments – Adopt amendments to Chapter 20 (Animals) related to the prohibition of dogs on McKegney Green (Department of Public Works) Councilmember Fredericks said several documents on the website still make reference to or imply dogs being permitted on McKegney Green and requested those documents be updated. Vice Mayor Ryan requested local signage about the new regulations be added to the area. MOTION: To adopt Consent Calendar Item No. 4, as written. Moved: Fredericks, seconded by Ryan VOTE: AYES: Fredericks, Griffin, Ryan, Thier, Welner ACTION ITEMS AI-1. Special Event Permit – Consider approval of a special event permit for a parade and block party in downtown Tiburon, including the closure of Main Street, hosted by the Tiburon Peninsula Little League (Department of Administrative Services) MOTION: To approve the Special Event Permit, including the closure of Main Street from 4PM-9PM on March 18, 2022. Moved: Thier, seconded by Ryan VOTE: AYES: Fredericks, Ryan, Thier, Welner NAYS: Griffin AI-2. Town Audit Report – Recommendation to accept and file the Town’s FY 2020-21 Basic Financial Statements and Independent Auditor’s Report (Department of Administrative Services) MOTION: To accept the FY 2021 annual financial audit as prepared by Marcello & Company, CPAs. Moved: Thier, seconded by Ryan VOTE: AYES: Fredericks, Griffin, Ryan, Thier, Welner AI-3. Appointments to Town Boards and Commissions – Consider appointment to the Diversity Inclusion Task Force (Department of Administrative Services) MOTION: To appoint Tina Shah Paikeday to the Diversity Inclusion Task Force. Moved: Fredericks, seconded by Ryan VOTE: Fredericks, Griffin, Ryan, Thier, Welner AI-4. Diversity Inclusion Task Force – Consider appointment of Chair and Vice Chair to the Diversity Inclusion Task Force (Department of Administrative Services) DocuSign Envelope ID: A35BFBD9-8DB0-439D-8A44-812C98A002B6 Page 4 of 4 Tiburon Town Council Minutes #04-2022 February 16, 2022 Public comment was received by Carol Korenbrot, Ruben Kalra, Lynn Feinerman, Bronia Hill, and Leela Stake, who all spoke in support of Councilmember Thier retaining the Chair position. Public comment was also received by Nora Noguez, who spoke in support of Councilmember Fredericks assuming the Chair position. MOTION: To appoint Councilmember Thier as Chair of the Diversity Inclusion Task Force. Moved: Griffin, seconded by Ryan VOTE: AYES: Fredericks, Griffin, Ryan, Thier, Welner MOTION: To appoint Councilmember Griffin as Vice Chair of the Diversity Inclusion Task Force. Moved: Thier, seconded by Fredericks VOTE: AYES: Fredericks, Griffin, Ryan, Thier, Welner DISCUSSION ITEMS DI-1. Automatic License Plate Reader System Expansion Update The Council requested a future agenda item to consider a proposal for additional automatic license plate reader cameras. TOWN COUNCIL REPORTS The Council discussed adding the following items to an upcoming agenda: • Town Council rules and protocols. • The use of Blackie’s Pasture as a construction staging area. • A reusable food ware ordinance. • Amendments to tree/view ordinance. TOWN MANAGER REPORT There was none.
