Members of the public were invited to participate in the meeting by live-streaming the meeting on the Town’s website and submitting comments to comments@townoftiburon.org to be included in the public record for the meeting. REGULAR MEETING – 5:00 P.M. Mayor Welner called the regular meeting of the Tiburon Town Council to order at 5:00 p.m. on Wednesday, August 3, 2022. CALL TO ORDER AND ROLL CALL PRESENT: COUNCILMEMBERS: Fredericks, Griffin, Ryan, Thier, Welner ABSENT: COUNCILMEMBERS: None PRESENT: EX OFFICIO: Town Manager Chanis, Town Attorney Stock, Director of Community Development Tasini, Director of Administrative Services Creekmore, Town Clerk Stefani ORAL COMMUNICATIONS Public comment was received by: • Sanna Thomas, who requested the Council participate in Marin County’s recent initiative to adopt green building ordinances. • Josh Sullivan, who advocated for eviction moratoriums in Tiburon. • Shirley Huang, who requested the Climate Action Plan be bolder and include the electrification of buildings. INTERVIEWS FOR VACANCIES ON TOWN BOARDS & COMMISSIONS • Leonor Noguez, Belvedere-Tiburon Library Agency Board of Trustees CONSENT CALENDAR CC-1. Town Council Minutes – Adopt minutes for June 15, 2022 Town Council special and regular meetings (Department of Administrative Services) CC-2. Investment Summary – Adopt investment summary for month ending May 31, 2022 (Department of Administrative Services) CC-6. 22 Marsh Road – Authorize: 1) execution of a Purchase & Sale Agreement to purchase 22 Marsh Road; 2) a budget amendment in the amount of $251,248 to fund the purchase; and 3) adoption of a resolution authorizing the Mayor to execute documents related to the purchase and conveyance of the property (Department of Administrative Services) A member of the public requested Consent Calendar Item No. CC-6 be removed for discussion. MOTION: To adopt Consent Calendar Items No. 1-5, as written. Moved: Thier, seconded by Fredericks VOTE: AYES: Fredericks, Griffin, Ryan, Thier, Welner CC-6. 22 Marsh Road – Authorize: 1) execution of a Purchase & Sale Agreement to purchase 22 Marsh Road; 2) a budget amendment in the amount of $251,248 to fund the purchase; and 3) adoption of a resolution authorizing the Mayor to execute documents related to the purchase and conveyance of the property (Department of Administrative Services) Public comment was received by: • Michael Scippa, who expressed concern on behalf of the Marsh HOA that the Town will own nearly half of the BMR units, leading to an imbalance of renters versus owners in the complex. • Neal Toft, who asked if the Town could make similar BMR arrangements with the developers of the required affordable housing units that must be built. MOTION: To adopt Consent Calendar Item No. 6, as written. Moved: Fredericks, seconded by Thier VOTE: AYES: Fredericks, Griffin, Ryan, Thier, Welner ACTION ITEMS AI-1. Appointments to Town Boards & Commissions – Consider appointment to the Belvedere-Tiburon Library Agency Board of Trustees (Department of Administrative Services) MOTION: To appoint Jeff Slavitz to the Belvedere-Tiburon Library Agency Board of Trustees. Draft Housing Element – Discuss the draft Housing Element, receive public comments, and consider adoption of a minute order direction to staff on any needed revisions to the Draft Housing Element prior to submission to the California Department of Housing and Community Development (Community Development Department) Public comment was received by: • Lorin Schneider, who spoke in opposition to the mandate to add more housing. • Tracy Gary, who spoke about an initiative with the intention of asking the State to reconsider the mandate. • Joe Blum, who spoke in opposition to the mandate and requested more of the allocation be added to the Cove Shopping Center area. • Sanna Thomas, who requested the element include more ambitious climate action goals. • Brenda Bottum, who believed more of the allocation be located west of Trestle Glen. • Neal Toft, who requested any downtown housing be limited in size and scale in keeping with the existing community. • Anne Romero, who said more housing should be located at the Baptist church and at the Cove Shopping Center and believed the buffer should be reduced. • Anne Libbin, who spoke about how local input over zoning results in economic and racial discrimination. • Seth Jacobs, who believed the Town Council should advocate for stronger legislation against the housing mandate and more of the allocation should be planned for west of Trestle Glen. • Josh Dick, who believed the sites near the Cove Shopping Center made more sense for additional housing. • Lorraine Gemigniani, who recommended the community contact the State and Governor Newsom directly about the housing mandate. • Lynn Barr, who believed the Cove Shopping Center to be under extreme risk of flooding and no additional housing should be planned for that location. • Roy, who recommended any residents planning to contact the Governor to remind them that Tiburon Boulevard is a state highway and the State will be responsible for the impacts. • Michael Scippa, spoke in opposition to the mandate to add more housing and believed any housing should be spread out within Tiburon. • Tom Struttman, who expressed satisfaction that the Town Council is aware of and understands the issues in adding more housing and believed Tiburon would be destroyed by so much additional density. • Molly Dick, who spoke about the additional impact of long construction projects downtown. • Kathy Silverfield, who wondered who is responsible for writing the plan and if they understand the impacts on Tiburon residents. The Council directed staff to look for additional potential sites west of Trestle Glen, to reduce the number of united downtown, to reduce the buffer, and to consider the Cove Shopping Center southeast corner as a potential site. TOWN COUNCIL REPORTS Vice Mayor Ryan submitted a written report with an update on the RBRA. TOWN MANAGER REPORT There was none.
