CONSENT CALENDAR CC-1. Town Council Minutes – Adopt minutes for March 15, 2023 regular Town Council meeting (Department of Administrative Services) CC-2. Appointments to Town Boards & Commissions – Consider making one appointment to the Belvedere-Tiburon Joint Recreation (the Ranch) Committee (Department of Administrative Services) MOTION: To appoint Daniel Fletcher to the Belvedere-Tiburon Joint Recreation Committee. Moved: Fredericks, seconded by Welner VOTE: AYES: Fredericks, Ryan, Thier, Welner ABSENT: One Vacant Seat AI-2. Appointments to Town Boards & Commissions – Consider making two appointments to the Design Review Board (Department of Administrative Services) MOTION: To appoint Alex Rosner to the Design Review Board. MOTION: To authorize the Town Manager to execute a Construction Services Agreement for the Open Space management Project to Capra Environmental Services in the amount of $65,000. Moved: Welner, seconded by Fredericks VOTE: AYES: Fredericks, Ryan, Thier, Welner ABSENT: One Vacant Seat PUBLIC HEARINGS PH-1. Municipal Code Amendments – Consider amendments to Chapter 13 (Building Regulations) of the Tiburon Municipal Code related to automatic gate safety (Community Development Department) – Introduction and first reading of ordinance MOTION: To read the ordinance by title only. Moved: Thier, seconded by Welner VOTE: AYES: Fredericks, Ryan, Thier, Welner ABSENT: One Vacant Seat Mayor Ryan read “An Ordinance of the Town Council of the Town of Tiburon Amending Provisions of Title IV, Chapter 13 of the Tiburon Municipal Code to Adopt a New Section 13-4.1.1(J) Thereby Amending Section 3110 of the 2022 Edition of the California Building Code and Adopting a New Chapter 13G – Administrative and program Regulations on Gate Safeguards”. MOTION: To pass first reading of the ordinance, to waive further reading, and to set the ordinance for final approval and adoption on the Consent Calendar at the next regular meeting. Moved: Thier, seconded by Fredericks VOTE: AYES: Fredericks, Ryan, Thier, Welner ABSENT: One Vacant Seat PH-2. Municipal Code Amendments – Consider amendments to Chapter 13 (Building Regulations) of the Tiburon Municipal Code to adopt building code amendments promoting building and vehicle electrification in new or remodeled buildings (Community Development Department) – Introduction and first reading of ordinance Public comment was received by: • Jim Malott, who expressed concerns that costs of electrification are expensive and recommended the ordinance include exceptions for cost prohibitive work. • Sanna Thomas, who expressed support for all code updates. • Julie Jacobs, who expressed support for all code updates. Moved: Welner, seconded by Fredericks VOTE: AYES: Fredericks, Ryan, Thier, Welner ABSENT: One Vacant Seat Mayor Ryan read “An Ordinance of the Town Council of the Town of Tiburon Amending Provisions of Title IV, Chapter 13 of the Tiburon Municipal Code by Adopting Amendments to the 2022 California Building Standards Code”. MOTION: To pass first reading of the ordinance, to waive further reading, and to set the ordinance for final approval and adoption on the Consent Calendar at the next regular meeting. Moved: Thier, seconded by Welner VOTE: AYES: Fredericks, Ryan, Thier, Welner ABSENT: One Vacant Seat PH-3. 699 Hilary Drive – Consider appeal of Design Review Board approval of exterior alterations and additions to a single-family home at 699 Hilary Drive, including three separate variance requests (Community Development Department) Owner/Applicant: Christina Goebel and Park Allen Appellant: Karina and Andrew Houghton Address: 699 Hilary Drive Assessor Parcel No.: 055-211-02 Public comment was received by: • Marshall Boyd expressed support for the applicant’s proposal. • Jim Malott expressed that view blockage was not a significant issue in this matter. • Tucker Maclean felt the proceedings were unneighborly and felt the view blockage was not a significant issue. • Bryan Breckenridge expressed support for the applicant’s proposal. • Tony S. expressed support for the applicant’s proposal. MOTION: To deny the appeal, upholding the approval made by the Design Review Board, and to direct staff to return with a resolution memorializing that decision at the next meeting.
