THAYER I Recorder I I Ill. 01:85PM 2'HIa~ I Page 1 of 2 RESOLUTION NO. 09-2004 /"'" A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON APPROVING AN AMENDMENT TO THE HIGH MEADOW PRECISE DEVELOPMENT PLAN (pD #38) FOR PROPERTY LOCATED AT I HIGH MEADOW LANE ASSESSOR PARCEL NO. 58-100-75 WHEREAS, on February 11,2004 the Planning Commission held a public hearing to consider the approval of an amendment to the High Meadow Precise Development Plan to amend the building envelope for the property located at 1 High Meadow Lane; and WHEREAS, on February 11,2004, after receiving public testimony and considering the application, the Planning Commission adopted Resolution No. 2004-01 recommending to the Town Council that the Precise Plan Amendment be approved; and WHEREAS, The Town Council has found that the project is exempt from the requirements of the California Environmental Quality Act per Section 15301 of the CEQA Guidelines; and -. WHEREAS, on March 3, 2004, after hearing all testimony and reviewing all documents on the record, the Town Council concurred with the findings made by the Planning Commission and found that the proposed precise plan amendment to modify the building envelope for the property located at 1 High Meadow Lane would be consistent with the overall intention of the High Meadow Precise Development Plan and the policies contained within the Land Use Element of the Tiburon General Plan. TlBURON TOWN COUNCIL RESOLUTION NO. 09-2004 MARCH 3, 2004 1 - /~ NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Tiburon does hereby approve of the requested amendment to the High Meadow Precise Development Plan, subject to the following conditions: 1. The approved building envelope for Lot 1 of the High Meadow Precise Development Plan shall be amended as reflected on the Building Envelope Modification Plan, prepared by J.L. Engineering, dated January 21, 2004 (one sheet), except that the northerly amendments to the approved building envelope are not approved. 2. This approval shall in no way alter other provisions of the High Meadow Precise Development Plan not specifically described herein. 3. The expanded building envelope area approved herein shall be limited to private recreational uses, with no structures permitted other than retaining waIls less than five feet (5') in height. No fencing is permitted in this area. Retaining waIls shall be surfaced or finished with rock or other materials designed to create a natural appearance. ,"-" !'
