RESOLUTION NO. 54-2001
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TffiURON
APPROVING AN AMENDMENT TO THE HEXAN PRECISE PLAN (PD#I)
FOR THE ESTABLISHMENT OF A "FENCING ONLY" ENVELOPE
AT 18 CffiRIAN DRIVE (LOT 4)
ASSESSOR PARCEL NO 38-011-42
WHEREAS, the Town Council of the Town ofTiburon does resolve as follows:
Section 1. Findings.
A. On March 2, 1983, the Tiburon Town Council approved a Master Plan for the Hexan
subdivision (Ordinance 267 N.S.). The Master Plan established development parameters
(including building envelopes) for 7 single-family lots. The Master Plan approval
specifically states that all improvements, including fences, shall be contained within the
building envelopes.
B. On April 6, 1983 the Tiburon Town Council approved a Precise Plan for the Hexan
subdivision (Resolution #2095) which implemented the Master Plan.

On April 3, 1985, the Town Council approved a Precise Plan amendment (Resolution
#2296) which established secondary building envelopes for each lot.

D. The Town has received and considered an application filed by Randall and Sandra Huyser
to establish a "fencing only" envelope at 18 Cibrian Drive. The application consists of the
following:
1. Application form and supplemental information received May 22, 2001
2. Site Plan and Fence elevations received May, 22, 2001
The official record for this project is hereby incorporated and made part of this resolution.
The record includes the Staff Reports, minutes, application materials, and all comments
and materials received at the public hearing.
E. The Planning Commission held a duly noticed public hearing on September 12, 2001 and
heard and considered testimony from interested persons. The Commission then adopted
Resolution No. 2001-12 recommending approval of the application with modifications.
F. The Town Council held a duly noticed public hearing on October 3, 2001 and heard and
considered testimony from interested persons and considered the recommendation of the
Planning Commission.

G.
The Town Council finds that the project is exempt from the requirements of the California
Environmental Quality Act per Section 15305 of the CEQA Guidelines.
H. The Town Council finds that a "fencing only" envelope expansion, as modified, is
consistent with the Tiburon General Plan and the Tiburon Zoning Ordinance, and with the
applicable Precise Plan for the property.
Section 2. Aooroval.
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of
Tiburon does approve the Precise Plan Amendment application (File # 30103) to establish a
"fencing only" envelope at 18 Cibrian Drive, subject to the following conditions:
1. The Precise Plan for Lot 4 ofthe Hexan subdivision is amended to create a "fencing only"
envelope at 18 Cibrian Drive as shown on attached "Exhibit A". No other structures
(including but not limited to accessory structures) may be located within this envelope.
2. Site Plan and Architectural Review approval shall be required for the specific fence design
and placement. Landscaping may be required to mitigate any negative visual impact ofthe
fencing.
3.
This amendment does not otherwise affect any specific provisions of Ordinance 267 N.S.,
Town Council Resolution #2095, or Town Council Resolution #2296.
