RESOLUTION NO. 3055 I A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON IN SUPPORT OF "NO ON 188" THE PHILIP MORRIS INITIATIVE WHEREAS, Environmental Tobacco Smoke (ETS), or second hand smoke, has been categorized as a cancer causing substance by the Environmental Protection Agency, and exposure to ETS kills an estimated 53,000 persons every year, and WHEREAS, the State of California and the County of Marin conduct aggressive public education campaigns to discourage tobacco use, particularly among children, and WHEREAS, in the past several years, the County of Marin and ten Marin towns and cities have enacted ordinances which protect the public from exposure to ETS by banning smoking in workplaces, restaurants and indoor public places, and reducing access to tobacco by children, and . r lit WHEREAS, Proposition 188, mis-titled the "California Uniform Tobacco Control Act", would repeal all of these Marin smoking ordinances and replace them with a statewide law which could permit smoking in every restaurant and workplace in the state, and WHEREAS, Proposition 188 is being sponsored by Philip Morris, the largest cigarette manufacturing company in the world, and WHEREAS, Proposition 188 would prohibit local and state government from ever passing any tobacco control legislation, or legislation limiting tobacco advertising or access by minors, and WHEREAS, STAMP, the Stop Tobacco Access to Minors Project, a nonprofit organization, has, throughout Marin County, assisted enforcement and enactment of laws restricting tobacco access by minors, and Proposition 188 would prohibit such activities by community organizations, and WHEREAS, the indoor ventilation standards proposed in Proposition 188 were designed to deal solely with the aesthetic impact of ETS but specifically disclaim that they protect occupants from the health impact, and .. WHEREAS, Proposition 188 would remove the ability of county, city and town regulatory staff to enforce state and local smoking laws, and would reserve that ability solely to police and to CAL-OSHA, thus virtually eliminating enforcement of such laws. NOW, THEREFORE, BE IT RESOLVED, that the Town Council of the Town of Tiburon finds and declares that Proposition 188 is a cynical attempt by a large tobacco company, under the guise of a health initiative, to mislead the electorate into drastically weakening protection from second hand smoke for everyone in California, and - BE IT FURTHER RESOLVED that the Town Council ofthe Town ofTiburon therefore declares its strong opposition to Proposition 188, and BE IT FURTHER RESOLVED that the Marin County Director of Health and Human Services is directed to inform Marin residents of the negative impact of Proposition 188 on the community, and to communicate this resolution to the cities and towns of Marin with an invitation for them to consider the issue.
