RESOLUTION NO. 3033
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON
APPROVING A MmGATED NEGATIVE DECLARATION OF
ENVIRONMENTAL IMPACT AND A MITIGATION MONITORING PROGRAM
FOR THE CECILIA PLACE SENIOR HOUSING DEVEWPMENT
ASSESSOR PARCEL NO. 34-351-11 & 12
WHEREAS, the Town Council of the Town of Tiburon does resolve as follows:
Section 1. Findines,
A. The Town has received and considered an application filed by Ecumenical
Association for Housing for a Rezoning and Precise Development Plan to
develop the following project:
PRECISE DEVELOPMENT PLAN

Development or an existing graded undeveloped 2,94 acre parcel of land with
16 attached dwelling units for rent, The project also includes development of
an access roadway, parking, utilities, community recreation and laundry
facilities, The dwelling units would be occupied by low and very low income
seniors and would provide opportunities for continued affordable independent
living.
REZONING
After careful review or the project and the Town zoning code staff has
determined that the subject property must be rezoned from RPD (Residential
Planned District) to RMP (Residential Multiple Planned) district to permit
the development, This zoning district permits multi-family attached dwelling
units consistent with the project proposal and with one of the development
options approved by Master Plan and Highlands Development Agreement
adopted in 1988,
B, The Town has prepared an Initial Study Checklist in accordance with the
requirements of the California Environmental Quality Act (CEQA) and the
Town of Tiburon Environmental Review Guidelines,

The Town found that the proposed project has potential environmental
impacts that can be mitigated to a level of insignificance as follows:
a, Mitigation: The project geotechnical study recommends very specific
site preparation and site remediation requirements that must be
followed to mitigate potential impacts. With the implementation of the
study recommendations impacts identified will be reduced to less than
significant. The project proposal includes the geotechnical
recommendations as mitigations in the plan."Report Preliminary
Geotechnical Investigation" prepared by Herzog Associates,Inc,
(geologic engineers) prepared in December 1993.
b, Mitigation: Outdoor lighting will be kept glare free. Safety lighting for
the driveway entry and the parking will be low intensity, hooded and
directed toward the ground to avoid light from spilling on to
surrounding properties and to eliminate glare,

Mitigation: A very extensive landscape plan has been proposed by the
project plan, The plan has mainly been designed to address the view
concerns of the neighbors along the west property line. The project
landscape plan, as proposed, includes extensive planting of trees and
shrubs along the toe of the slope at the western property boundary
and behind the proposed buildings on the cut bank. The project
buildings have various setbacks from the edge of the cut bank and the
variation provides reduction of the appearance of building mass,
Building siting and landscape planting must be consistent with the
project plans to mitigate visual impacts,

d. Mitigation: Seven of the proposed units which face west and look down
on the existing developed lots to the west have outdoor living areas,
window and door openings, At the Design Review stage these openings
should be screened with planting of trees and shrubs to filter the views
of the residents to yards and houses below, Fences surrounding the
outdoor living areas should be translucent to provide sufficient
diffusion so as to eliminate visual perception of distinct images. The
proposed vista point shall be eliminated from the project design to
protect the privacy of surrounding neighbors,
D, The Planning Commission held duly noticed and advertised public hearing
on June 22, 1994, considered all testimony, and recommends approval of the
project Mitigated Negative Declaration and Mitigation Monitoring Program,

The Town Council held duly noticed and advertised public hearing on July
6, 1994 and considered all testimony,
NOW, THEREFORE, BE IT RESOLVED that the Town Council approves the
Cecilia Place Senior Housing Development Mitigated Negative Declaration and
Mitigation Monitoring Program.
PASSED AND ADOPTED at a regular meeting of the Tiburon Town Council
on July 6, 1994, by the following vote:
