RESOLUTION NO. ~
A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF TIBURON A GRANT OF EASEMENT
FROM OLGA BONIFASI DE SAENZ FOR
DRAINAGE PURPOSES OVER PROPERTY
AT 773 AND 775 TIBURON BOULEVARD
WHEREAS, the Town of Tiburon was one of the parties to a 1983 lawsuit involving
landslide and drainage problems on the property of Olga Bonifasi De Saenz at 773 and 775
Tiburon Boulevard; and
WHEREAS, as part of the resolution of this lawsuit Ms. De Saenz agreed to grant
the Town of Tiburon an easement across her properties for the purpose of installing and
maintaining a storm drain pipe and associated facilities; and
WHEREAS, Ms. De Saenz has now otTered this easement in the grant deed attached
hereto as Exhibit 1.
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of
Tiburon that the easement described in the attached Exhibit 1 is hereby accepted and that
pursuant to Government Code Section 27281 the Town Manager is hereby authorized to
execute a certificate of acceptance for recordation. .
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Tiburon on June 1, 1994, by the following vote:
