A RESOLUTION OF THE TIBUKON TOWN COUNCIL VACATING A
PORTION OF EXCESS ROADWAY ALONG HACIENDA DRIVE
ASSESSOR PARCEL NOS. 39-271-27 & 28
WHEREAS, a five (5) foot wide right-of-way strip along Hacienda Drive,
approximately 348 feet in length, was dedicated to the Town as a condition of a two-
lot subdivision approved for Mr. Chester Bowles in 1965. The conveyance of this
right-of-way being recorded in Book 1918 of the Official Records of Marin County,
Page 268; and,
WHEREAS, at the time of the dedication of the right-of-way, Hacienda Drive
was planned as an "inter-neighborhood connector", warranting a 60 foot wide
roadway; and,

WHEREAS, the planned use and development of Hacienda Drive has changed
siguificanUy since the time when the dedication was required, such changes being
reflected in the Tiburon General Plan; and,
WHEREAS, the Town has received an request from Mr. Robert Wayne to
abandon the unused roadway dedication in front of his properties at 170 and 180
Hacienda Drive; and,
WHEREAS, the Tiburon Planning Department has determined that the right-
of-way is indeed excess and is not required for any future street purposes;
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town
of Tiburon that:
1. Pursuant to Chapter 4 Section 8334(a) of the California Streets and
Highways Code, the Town does hereby vacate that five (5) foot wide roadway
dedication along Hacienda Drive as described above and shown on the Parcel
Map prepared for Robert Wayne dated July 1979 and attached hereto as
Exhibit "A".

2. This summary vacation is made pursuant to the authority of Chapter 4,
Section 8334(a) of the California Streets and Highways Code which allows
local municipalities to summarily vacate an excess right-of-way of a street or
highway not required for street or highway purposes.
3. This vacation is made because Hacienda Drive is no longer planned as a
through roadway. The roadway now dead-ends into secured open space. No
future improvements or loadings of the roadway are planned.

4. The Town Clerk is directed to file this resolution with the Marin County
Recorder's Office within ten (10) working days of approval. From and after
the date this resolution is recorded, the vacation shall be considered complete
and the portion of the roadway hereby vacated shall no longer constitute a
public right-of-way.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Tiburon held on May 4, 1994, by the following vote:
