HomeMy WebLinkAboutTC Res 1994-02-02 - r RESOLUTION NO. 2997 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON AUTHORIZING THE MERGER OF FOUR PARCELS INTO TWO LOTS AND AUTHORIZING A LOT LINE ADJUSTMENT AT 2255,2265, AND 2275 PARADISE DRIVE ASSESSOR PARCEL NOS. 59-142-04. 05. 06 & 08 WHEREAS, the Town Council has held hearings on July 21, 1993 October 6, 1993, and December 15, 1993, to consider the merger of four parcels into one lot; ~d - WHEREAS, the Town Council has determined that the most appropriate solution is to merge the foufparcels into two lots (one with frontage on Centro East Street, the other with frontage on Paradise Drive) with limitations on both lots of single family use only; and other conditions imposed concerning height, parking, and access; ~d r WHEREAS, it has been determined that a combination of voluntary lot mergers with conditions and a lot line adjustment will achieve the solution specified by the Town Council, provided that the Council authorizes an exception to the Subdivision Ordinance necessary to formalize lots of less than 7,500 square feet (ie., nonconforming lots); and WHEREAS, the Town Council finds that an exception to the development requirements of Section 14-9.4 concerning minimum lot size is warr~ted for the following reasons: a. The Town is substantially improving the current situation of four grossly substandard parcels by merging them into two lots only slightly less than the standard 7,500 square feet. b. The Council finds that the proposed lot pattern is more consistent with, and in greater harmony with, the existing lot pattern than a single parcel of approximately 15,000 square feet. c. The Council finds that the single family use restrictions and other limitations gained through the voluntary merger process, which could not be obtained through the statutory merger process, are significant concessions which will result in a more logical, consistent, and harmonious pattern of development in the vicinity. Ir 1 J -: f' NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Tiburon that: ' 1. The Town of Tiburon hereby authorizes the Planning Director to approve the application for voluntary merger of Assessor Parcels 59- 142-04 and 08 into one lot, attaching conditions of approval as directed by the Council. 2. The Town of Tiburon hereby authorizes the Planning Director to approve the application for voluntary merger of Assessor Parcels 59- 142-05 and 06 into one lot, granting an exception to the development standard of the Subdivision Ordinance concerning minimum lot size, attaching conditions 9f approval as directed by the Council. 3. The Town of Tiburon hereby authorizes a lot line adjustment between the above twlf lots upon their merger, granting an exception to the development standard of the Subdivision Ordinance concerning minimum lot size. . 4. The Town of Tiburon conditions these actions upon an agreement by the owner to record the voluntary mergers and the lot line adjustment within 30 days following the Council's decision. Failing that, the Town Council authorizes the Planning Director to statutorily merge the four parcels into one lot prior to expiration of the 30 days. r 5. The Planning Director is hereby directed to ensure that all appropriate documents are recorded with the Marin County Recorder's Office to secure the intent of this approval. 6. Provided that all of the above are performed, the Planning Director shall file a Release of the Notice of Intention to Determine Status to the property owner and file it for record with the Marin County Recorder's Office. ~ 2 ." ~ r..
