A RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF TIBURON
DENYING AN APPEAL AND AFFIRMING THE DECISION
OF THE DESIGN REVIEW BOARD TO
APPROVE SITE PLAN AND ARCHITECTURAL
REVIEW FOR 14 CECILIA COURT (TUTTLE)
WHEREAS, on December U, 1991, the Design Review Board ("DRB") held a duly
noticed public hearing to consider an application for a new residence at 14 Cecilia
Court (Lot 7, Tiburon Highlands); and
WHEREAS, after CUlly considering the application, and all other oral, written
and documentary evidence submitted, the DRB approved the application; and
WHEREAS, the DRB's decision was appealed in a timely manner; and

WHEREAS, the Town Council held a public hearing on January 7, 1992, at which
public testimony was received. After considering all testimony, written materials and
visual evidence, the Council voted 2-1 (Thayer and Kuhn voting yes; Logan voting no;
Coxhead abstaining; and Friedman absent) to deny the appeal and affirm the decision
of the DRB.

NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the Town of
Tiburon that the appeal from the decision of the DRB approving site plan and
architectural review is denied and the DRB's decision affirmed based on the following
findings:
1. The project complies with the zoning ordinance, the Hillside Design
Guidelines and the Highlands subdivision regulations.
2. The appellants had notice of the DRB hearing through conversations with
the applicant and their viewing of the story poles. In spite of this,
appellants failed to speak against the project although they were at the
DRB hearing.

of Tiburon on January 21, 1992, by the following vote:
